Abstract

This study discusses the empowerment of productive zakat aimed at fostering the welfare of mustahik. This research is a programme on the implementation of the Zakat Amil Agency in the distribution of zakat. This research uses qualitative method in order for it be relevant to the results achieved. The sources of the data in this study are relevant literature both in the form of books, journals and articles used to compile theories about problems that are the objects of the research. Based on our findings, the mustahik receive zakat from the Zakat Amil Agency with the scheme of productive zakat. In relation to the data compilation in this study, the techniques used include the activities and the development of the Zakat Amil Agency in daily activities to manage zakat and mustahik’s productive zakat in organizing the programmes. Data analysis was conducted by structuring data in the form of compiling, classifying and testing data during the research. Data analysis was carried out to describe the processes and results of examinations from transcripts and notes and other materials. In relation to the qualitative approach, the data analysis is conducted in three steps, namely data reduction, data presentation, and reduction of conclusions.

Abstract

Penelitian ini ingin membuktikan sejauh mana energi nuklir dipahami secara baik oleh banyak kalangan. Ayat-ayat al-Quran diklasifikasikan kepada beberapa bidang terkait dengan keimuan nuklir yang didapat dari pandangan ilmuwan muslim terhadap ayat-ayat al-Quran yang terindikasi nuklir. Langkah berikutnya ayat yang telah dikumpulkan tersebut dideskripsikan dengan memuat tafsirannya. Pada posisi ini kitab Tafsir yang digunakan adalah Tafsir al-Quran Kementerian Agama RI dan Tafsir al-Mishbah karangan Muhammad Quraish Shihab. Wawancara dengan para ulama dilakukan di beberapa daerah di Aceh dengan pendekatan wawancara terstruktur. Eksistensi ayat-ayat al-Quran dengan keimuan nuklir dapat dipahami bahwa memang ayat-ayat tersebut memiliki indikasi-indikasi nuklir. Penafsiran ulama tentang ayat-ayat tersebut mulai memasukkan istilah pengetahuan modern baik terkait nuklir ataupun lainnya. Para ulama yang menjadi responden masih belum memahami apa dan untuk apa nuklir tersebut. Karena itu, dapat dinyatakan bahwa perkembangan sains dalam masyarakat, terutama tokohnya, masih perlu pencerahan dengan memberikan sumber-sumber informasi terkait.

Abstract

trafficking of narcotics in Indonesia has penetrated into various living environments such as the work environment. One of them is a Penitentiary. For example, Warden in Jambi Class II A Penitentiary and in Sekayu Penitentiary as well as in several other Correctional Institutions have circulated and smuggled narcotics into Correctional Institutions which causes regulations of the Minister of Law and Human Rights Number M. HH.16. KP. 05. 02 of 2011 Regarding Penitentiary Employee Code of Ethics is not implemented to the maximum. The research question in this thesis is what is the legal responsibility for the warden who conducts narcotics distribution, what are the factors causing narcotics circulation by the warden and how is the view of Islamic criminal law towards the warden who circulates narcotics in prison. In this study the authors used a normative juridical research method that is based on legislation and relevant books. Form of legal liability for Warden who circulates narcotics in LP according to public view as a full responsibility including medeplager (participating) category, according to Law Number 35 of 2009 concerning Narcotics forms of responsibility in the form of criminal threats (death sentence, life sentence, imprisonment) and fines. According to the Regulation of the Minister of Law and Human Rights Number M. HH.16. KP. 05. 02 of 2011 concerning the Penitentiary Employee Code of Ethics is subject to administrative sanctions (terminated) if there is a decision of gingkah. Factors causing the Warden to circulate narcotics in Corrections Institutions are economic factors, the low mentality of the Warden involved, oversight in prison is weak, the number of narcotics addicts who are only in prison without rehabilitation. According to the Islamic Criminal Law the Warden who circulates narcotics in a Penal Institution is liable to a sanction in the form of rahmah ta'īr (bodily punishment, independence, and a fine).

Abstract

Strategi penggalangan dana penting dilakukan untuk mengoptimalkan penerimaan zakat sebagai salah satu sumber pendapatan asli daerah. Penelitian ini bertujuan untuk mengetahui cara pelaksanaan strategi penggalangan dana, hambatan dalam penggalangan dana zakat, dan dampak dari strategi penggalangan dana yang dilakukan di Baitul Mal Kabupaten Aceh Barat. Penelitian ini menggunakan metode penelitian deskriptif kualitatif. Pengumpulan data dilakukan dengan observasi, wawancara, dan dokumentasi pada sumber-sumber yang relevan. Analisis data meliputi reduksi data, penyajian data, dan penarikan kesimpulan. Temuan menunjukkan bahwa Baitul Mal melakukan dua strategi penggalangan dana: langsung dan tidak langsung. Penggalangan dana langsung dimaksud adalah sosialisasi langsung kepada masyarakat termasuk perusahaan/PT, toko/CV, instansi vertikal, perorangan, maupun kemitraan. Penggalangan dana tidak langsung yang dimaksud adalah promosi melalui media cetak dan elektronik, antara lain pemasangan baliho, penyebaran brosur, penulisan di surat kabar, penerbitan penyaluran zakat di saluran berita Aceh, seruan zakat di radio, khotbah keagamaan dan Jum'at di masjid-masjid, dan penyelenggaraan seminar. . Namun, strategi penggalangan dana tersebut belum berjalan dengan baik atau menunjukkan dampak positif karena beberapa kendala seperti kurangnya sumber daya manusia yang profesional, program yang kurang inovatif, kurangnya kesadaran masyarakat tentang zakat, dan anggota yang sering berubah. Akibatnya, jumlah penerimaan zakat di Baitul Mal Kabupaten Aceh Barat tidak mengalami peningkatan.

Abstract

This study wants to examine the suitability of Aceh Qanun with National Law related to the Hierakicity of laws and regulations in Indonesia. In theory it is possible that the Aceh Government can build its own hierarchies that are not the same as the Central Government. This relates to the authority of the Aceh Qanun which is not the same as the Regional Regulation but the hierarchy that is built but meets the basic norms of the Indonesian constitution. There are two focuses which are the focus of this research. First, what is the character of the Aceh Qanun as a legal umbrella in the implementation of post-autonomy Aceh and post-peaceful Aceh? Second, What Is the Future of Law in Aceh? The results of the first research, the character of the Aceh Qanun as a legal umbrella in the implementation of post-autonomy Aceh and post-peaceful Aceh is expected to be able to build Aceh better because of the presence of Law Number 18 Year 2001 and Law Number 11 Year 2006 regarding new hopes for the people of Aceh itself specifically in the field of Islamic sharia. Second, the future of law in Aceh in the discussion of legal development, is greatly developing from creating new norms in Aceh Qanun Number 6 of 2014 concerning Jinayah Law, because regulating jinayah law in Aceh does not have to draw the Criminal Code or the Criminal Procedure Code.

Abstract

Aceh becomes the only region in Indonesia, where Islamic law is formally implemented. This paper aims at discussing the implementation of shari’a in Aceh, to compare between its ideal and factual achievements. Employing a qualitative socio-legal approach, data is obtained from interviews with the chairperson of Ulama’s Consultative Assembly (Majelis Permusyawaratan Ulama), head of Shari’a Office (Dinas Syariah), scholars, and community leaders. Apart from that, an observation was undertaken to record the process of whipping punishment. This study finds out that shari’a implementation in Aceh has been sufficiently supported by shari’a institutions (MPU and Shari’a Office), religious figures, community, and available punishment execution for the violators. However, some aspects need to be improved, especially those that are related to the role of other law enforcers such as police, prosecutors, and judges; and sustainable socialization.  AbstrakAceh menjadi satu-satunya provinsi di Indonesia yang menerapkan syariat Islam secara formal. Penelitian ini  mengkaji penerapan syariah di Aceh dengan membandingkan antara yang ideal sebagaimana diharapkan dan yang faktual. Dengan menggunakan pendekatan kualitatif dan sosio-legal, data diperoleh melalui wawancara dengan Majelis Permusyawaratan Ulama, Dinas Syariah, akademisi, dan tokoh masyarakat. Selain itu, observasi dilakukan untuk melihat pelaksanaan hukuman cambuk.  Hasil penelitian ini menunjukkan bahwa implementasi syariah di Aceh sudah didukung dengan institusi syariah (MPU dan Dinas Syariah), dan tokoh agama, masyarakat. Adanya eksekusi bagi pelanggar hukum menguatkan pelaksanaa syariah di daerah itu. Akan tetapi, ada pula aspek-aspek yang perlu ditingkatkan, yaitu peran penegak hukum seperti polisi, jaksa, hakim, dan juga keberlangsungan sosialisasi kepada masyarakat.

Abstract

This research analyzes the issue of the practice of inheritance of patah titi and substitute heirs in Acehnese society according to the Compilation of Islamic Law (KHI), Islamic jurisprudence (fiqh) and local custom (adat). This empirical legal research uses a legal pluralism approach. Legal pluralism is a theory that analyzes the diversity of laws applicable and applied in the lives of society and the state. Data collection techniques include in-depth interviews and literature review. The findings reveal that the people of Aceh practice a religious legal system, which consists of the KHI, fiqh, and adat in the distribution of inheritance. In the customary law, the practice known as “patah titi” concerns the case of inheritance in which an heir predeceases the testator, thus preventing the heirs’ living descendants from receiving inheritance rights. The customary practice in regards to patah titi bears a similarity to fiqh, in which it does not recognize a substitute heir, as fiqh only recognizes the replacement of the heir’s position. According to ulamas and traditional leaders, the practice of patah titi causes a divergent of opinions in which some agree whereas others do not. Those who disagree are more likely to use the term “will”, meaning that even though grandchildren do not inherit, sometimes they get property by way of a will. Furthermore, substitute heirs as confirmed in the KHI, although unavailable in fiqh and adat literature, are still recognized as they are in accordance with maqāṣid sharīah (the objectives of Islamic law), i.e. for justice and benefit purposes. To conclude, such a practice is a consequence of legal pluralism, which prioritizes harmonization and integration between the three legal systems.   Abstrak: Penelitian ini menganalisis persoalan praktik pewarisan patah titi dan ahli waris pengganti dalam masyarakat Aceh menurut KHI (Kompilasi Hukum Islam), fikih, dan adat setempat. Penelitian hukum empiris ini menggunakan pendekatan pluralisme hukum. Teknik pengumpulan data meliputi wawancara mendalam dan studi pustaka. Temuan mengungkapkan bahwa masyarakat Aceh menganut sistem hukum agama, yang terdiri dari KHI, fikih, dan adat dalam pembagian warisan. Dalam hukum adat, praktik yang dikenal sebagai patah titi menyangkut kasus pewarisan di mana seorang ahli waris mendahului pewaris sehingga mencegah keturunan ahli waris yang masih hidup untuk menerima hak warisan. Kebiasaan patah titi memiliki kesamaan dengan fikih, yaitu tidak mengenal ahli waris pengganti, karena fikih hanya mengenal pengganti kedudukan ahli waris. Para ulama dan tokoh adat berpendapat bahwa praktik ini menyebabkan terjadinya perbedaan pendapat yang ada yang setuju dan ada yang tidak. Mereka yang tidak setuju lebih cenderung menggunakan istilah “wasiat”, artinya meskipun cucu tidak mewarisi, terkadang mereka mendapatkan harta dengan cara wasiat. Selanjutnya ahli waris pengganti yang ditegaskan dalam KHI, meskipun tidak ada dalam fikih dan literatur adat, tetap diakui sesuai dengan maqashid syariah (tujuan hukum Islam), yaitu untuk tujuan keadilan dan kemaslahatan. Kesimpulannya, praktik semacam itu merupakan konsekuensi dari pluralisme hukum yang mengutamakan harmonisasi dan integrasi antara ketiga sistem hukum tersebut.

Abstract

Keterangan Ahli di atur dalam Kitab Undang-Undang Hukum Acara Pidana Pasal 183, dan jelas dikatakan bahwa keterangan ahli itu merupakan alat bukti yang sah menurut kitab uundang-undang hukum acara pidana, namun dalam konteks Hukum Islam terkait keterangan saksi ahli forensik ini tidak dijelaskan dan tidak di bahas secara spesipik.            Penelitian ini bertujuan untuk mengetahui kedudukan saksi ahli forensik dan tinjaun Hukum Islam terkait keterangan ahli forensik ini. Kemudian penelitian ini menggunakan metode penelitian hukum normatif. Adapun yang dimaksud dengan penelitian hukum normatif adalah penelitian yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder belaka. Kemudian Penelitian ini bersifat deskriptif analisis. Adapun yang dimaksud dengan penelitian deskriptif yaitu penelitian yang memberikan uraian mengenai fenomena sosial yang mendeskripika nmengenai nilai variable mandiri baik dari satu variable atau lebih tanp amembandingkan atau menghubungkannya. Penelitian yang dilakukan terhadap Kedudukan Pembuktian Keterangan Ahli Forensik Di Tinjau Menurut Hukum Islam diperoleh hasil sebagai berikut: Kedudukan saksi ahli forensik ini bisa dikategorikan kedalam alat bukti qarinah karena kedudukannya yang sah didalam hukum Islam namun tidak dijelaskan secara spesik terkait ahli forensik ini, alat bukti ini digunakan apabila ada perkara yang memang membutukan peranan saksi ahli forensik untuk mengungkap sebuah kebenaran dan alat bukti ketrangan ahli forensik ini dapat diterima. Mengingat dengan semakin canggihnya zaman, tidak mungkim hakim menguasai seluruh bidang, sehingga di butuhkanya saksi ahli forensik yang bertujuan untuk memudahkan hakim dalam menyelsaikan sautu perkara. Kemudian Bahwa perspektif hukum Islam akan keterangan ahli forensik itu tidak tidak dijelasakan secara tegas dalam urutan alat-alat bukti. Akan tetapi keterangan ahli forensik menjadi sama seperti alat-alat bukti yang lain dan sah dalam KUHP dan dalam Hukum Islam, pada dasarnya tidak scara jelas diterangkan dalam urutan alat-alat bukti. Akan tetapi keterangan saksi ahli sebagai alat bukti menjadi sama dengan alat-alat bukti yang lain dan keberadaannya sah dalam hukum Islam juga dalam KUHAP. Karena keteranga saksi ahli forensik merupakan alat bukti pendukung dalam hukum Islam, bahwa Rasulullah mengakui dan mengamalkannya sebagai alat bukti kepastian hukum.

Abstract

The Employment Social Security Administration (BPJS) is the responsibility and obligation of the State that focuses on social security and labor protection in Indonesia to provide socio-economic protection to the community by organizing Work Accident Insurance (JKK), Death Insurance (JKM), Old Age Security programs (JHT), and Retirement. In accordance with the state's financial capacity. With the existence of BPJS for Employment, it is proper to help workers who are at risk and get the compensation or services that should be obtained. In this case the Gampong apparatus is required to become a participant of BPJS Employment in accordance with the Gampong's financial capacity. Riseh Tunong Village apparatus, Sawang District, North Aceh Regency, participated in two social security programs, namely the JKK and JKM programs. The contribution is calculated based on the percentage of wages/salaries per month, representatives from the Gampong apparatus will pay all other village equipment fees to the Lhokseumawe BPJS Employment office, the contributions are taken from the Gampong Revenue and Expenditure Budget (APBG). The purpose of this study was to determine the system of agreement and BPJS employment insurance benefits for the Gampong Riseh Tunong apparatus, Sawang District, North Aceh Regency. And to find out the review of the kafalah contract in the insurance agreement on BPJS employment on the Riseh Tunong Village apparatus, Sawang District, North Aceh Regency. This research is qualitative with descriptive analysis research type, namely the author uses field research methods and library research methods. The results of the study show that the substance of BPJS Employment is the same as conventional insurance. This is because there are two things that are not in accordance with sharia in the scheme that occurs in BPJS Employment, namely the element of transfer of risk (uncertainty) and interest-bearing loans in the determination of contributions.
