Abstract

Divorce in households can occur due to several factors, such as economic factors, ongoing arguments, and domestic violence. Therefore, an alternative solution in such a situation is necessary by involving the role of the village customary leaders as a ḥakam (peacemaker). The effectiveness of the role of the village customary leaders as a ḥakam must fulfill five aspects: purpose, strategy, policy, planning, and implementation. In this study, the aim was to examine the role of the village customary leaders as a ḥakam in resolving divorce in Kuta Alam Subdistrict, Banda Aceh City and the effectiveness of the role of the village customary leader as a ḥakam in resolving divorce in Kuta Alam Subdistrict, Banda Aceh City. The study used a qualitative research method, using a normative sociological approach, and collected the data by means of interviews and document study. The results showed that village customary leaders such as ḥakam play the role of mediators in marital disputes, in which they investigated and found the roots of the problems with the hope that the disputed could be reconciled and reunited in their households. Further, the role of the village customary leaders as a ḥakam has been considered effective as seen from several peace processes carried out. However, some cases of conflict have not been resolved because some parties demand settlement in court. The study suggests that village customary leaders as ḥakam need to pay attention to the aspect of legal force in handling divorce and that the village institution should prepare administrative staff in the deliberation process

Abstract

Indonesia possesses a rich cultural heritage consisting of both tangible and intangible artifacts that continue to exist in the present day. This cultural heritage has significantly contributed to the advancement of human civilization, encompassing economic, social, and scientific dimensions. This study seeks to examine the state's involvement in safeguarding cultural assets in Bone Regency, located in South Sulawesi, Indonesia. The article employs an empirical research methodology that applies both the constitutional law and the Islamic law. Data were gathered by comprehensive interviews, direct observation, and the collection of relevant documents. The sources for the study included the tourism office, members of the People's Representative Council (DPR), as well as religious and community leaders. The investigated papers consisted of legal regulations, including laws, regulations, and relevant journal articles. The findings indicate that the government plays a crucial role in the protection of the cultural assets in Bone Regency. Within the realm of the constitutional law, the government has enacted Law No. 11 of 2010, which pertains to Cultural Heritage. Similarly, the Bone Regency government has also enacted Regional Regulation No. 7 of 2020, which concerns the Preservation and Management of Cultural Heritage. To enforce this protection, many cultural legacies have been designated, such as the burial grounds of the Bone monarchs and significant cultural and historical locations. Within the framework of the Islamic law, the preservation of cultural assets is considered advantageous. The advantages derived from cultural heritage include the reinforcement of national identity and character, historical education, the promotion of tourism attractions, and the provision of a religious lesson for present and future generations.

Abstract

This study discusses the way in determining ‘illat through the munasabah method proposed by Imam al-Ghazali in the perspective of Islamic law. The study focuses on two main problems: the identification of ‘illat through munasabah and the legal formulation to utilize hikmat to obtain ‘illat according to al-Ghazali. This normative legal research used a legal history approach as an analytical tool to examine the Islamic scholars’ thoughts on concepts, theories and ways of doing istinbath. The study concluded that according to al-Ghazali there are three kinds of munasabah in determining ‘illat, consisting of munasib mu’atstsir, munasab mula’im, and munasib gharib. In munasib mu’atstsir, there is no issue found in seeking ‘illat because the ‘illat is understood directly from the nash or ijma’. Therefore, munasabah is no longer needed in the determining ‘illat. Here, the munasabah method focuses on munasib mula’im and munasib gharib in identifying ‘illat. Munasib mula’im seeks for the genus ‘illat, an ‘illat drawn from every event that has been predetermined by the nash, by examining the same hikmah in each of the events. Such hikmah is then used as the genus ‘illat which will later be applied as qiyas for other events that have been legally stipulated by the nash. On the other hand, munasib gharib seeks for the species ‘illat, an ‘illat obtained from an event that has been predetermined by the nash, with no comparison found in other events. ‘Illat determined from munasib gharib is also hikmah, having no concrete nature. In the perspective of legal history, this method of seeking ‘illat is inseparable from kalam and philosophy as was the development of the Islamic sciences at the time. As such, this had also affected al-Ghazali’s mastery in Islamic law as well as in other Islamic disciplines.

Abstract

ABSTRAK          Jurnal ini membahas tentang Problematika Nikah Siri yang ditinjau dari Hukum Islam di Desa Ujung Salangketo Kec. Mare. Permasalahan dalam penelitian ini adalah bagaimana probelematika nikah siri di Desa Ujung Salangketo dan bagaimana tinjauan Hukum Islam terhadap problematika nikah siri yang terjadi di Desa Ujung Salangketo. Tujuan penelitian ini untuk mengetahui problematika nikah siri di Desa Ujung Salangketo dan tinjauan hukum  Islam. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif.          Hasil penelitian menunjukkan bahwa terdapat  beberapa problematika yang menyebabkan terjadinya nikah siri di Desa Ujung Salngketo Kec. Mare di antaranya: ketidaktauan masyarakat tentang dispensasi nikah di Pengadilan Agama, tidak adanya keinginan untuk mengurus ke Pengadilan Agama karena jarak yang jauh, dan tidak adanya keinginan untuk mengurus berkas-berkas bagi mereka yang sudah menikah. Adapun solusi yang diberikan oleh pihak KUA Kec. Mare yaitu dengan melakukan isbat nikah di Pengadilan Agama dan mencatatkan pernikahannya di KUA. Tinjauan Hukum Islam terhadap problematika nikah siri yang terjadi di Desa Ujung Salangketo yaitu pernikahan tersebut dianggap sah menurut agama karena pernikahan tersebut telah memenuhi rukun dan syarat pernikahan, tetapi menurut hukum negara atau hukum positif pernikahan tersebut belum dianggap sah karena belum melakukan pencatatan pernikahan. Dalam rangka mendapatkan kepastian hukum.

Abstract

AbstrackThis research discucces the Pledge of Talak Outside the Court Reviewed According to Islamic Family Law (Case Study in Pattimpa Village, Ponre District, Bone Regency). The problem in this study is how the perception of the people of Pattimpa Village, Ponre District about the Talak Pledge outside the court and how the review of Islamic Family Law about the Talak Pledge outside the court in the people of Pattimpa Village, Ponre District. The purpose of this study is to find out the perception of the people of Pattimpa Village, Ponre District about the Talak Pledge outside the court and the review of Islamic Family Law about the Talak Pledge outside the court in the people of Pattimpa Village, Ponre District. This research is a field research with a qualitative approach.The results of the study showed that there were several people in Pattimpa Village, Ponre District who divorced out of court. This is due to several reasons, namely: their lack of knowledge of how to litigate in court and the considerable amount of costs, long distance from the court, following previous divorces. Even though divorces carried out outside the court will not get legality, there are still people in Pattimpa Village, Ponre District who divorce outside the court. Divorce out of court results in the perpetrator not being able to legally carry out the next marriage according to the law. This is because her marital status has not been legally broken. In a sense, as a result of this out-of-court divorce, the perpetrator can only carry out the next marriage in a series.Abstrak Penelitian ini membahas tentang Ikrar Talak Di Luar Pengadilan Ditinjau Menurut Hukum Keluarga Islam (Studi Kasus Pada Desa Pattimpa Kecamatan Ponre Kabupaten Bone). Permasalahan dalam penelitian ini adalah bagaimana persepsi masyarakat Desa Pattimpa Kecamatan Ponre tentang Ikrar Talak diluar pengadilan dan bagaimana tinjauan Hukum Keluarga Islam tentang Ikrar Talak diluar pengadilan pada masyarakat Desa Pattimpa Kecamatan Ponre. Tujuan penelitian ini untuk mengetahui persepsi masyarakat Desa Pattimpa Kecamatan Ponre tentang Ikrar Talak diluar pengadilan dan tinjauan Hukum Keluarga Islam tentang Ikrar Talak diluar pengadilan pada masyarakat Desa Pattimpa Kecamatan Ponre. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif.Hasil penelitian menunjukkan bahwa terdapat beberapa masyarakat Desa Pattimpa Kecamatan Ponre yang melakukan perceraian di luar pengadilan. Hal ini disebabkan beberapa alasan yaitu: kurangnya pengetahuan mereka tentang cara berperkara di pengadilan dan jumlah biaya yang cukup besar, jarak tempuh yang jauh dengan pengadilan, mengikuti perceraian sebelumnya. Meskipun perceraian yang dilakukan di luar pengadilan tidak akan mendapatkan legalitas, namun masih saja ada masyarakat Desa Pattimpa Kecamatan Ponre yang melakukan perceraian di luar Pengadilan. Perceraian di luar pengadilan mengakibatkan pelakunya tidak dapat melakukan perkawinan selanjutnya secara sah menurut perundang-undangan. Hal ini karena status perkawinannya belum putus secara hukum. Dalam arti, akibat perceraian di luar pengadilan ini pelaku hanya bisa melakukan perkawinan selanjutnya secara sirri.

Abstract

Management of zakat, infaq and shadaqah funds through philanthropic movements is not only part of social change but also a social transformation. because the funds given to the community are not just to meet consumptive needs such as living expenses, health costs or incentives alone, but the funds are given in the form of business capital, training, education costs, workshops and life skills and equipment assistance. So that the zakat, infaq and shadaqah funds become productive and effective, and the community is empowered in terms of resources, economy, social and skills. The study used a qualitative method analyzed with the theory of the sociology of religion. Religion can encourage humans to carry out social transformation, namely changes in form in the form of ideas, concepts and practices or practices in a better life. In this study, through religious teachings, it can become a spirit that encourages someone to do good and help others such as paying zakat, infaq and shadaqah.

Abstract

This article aims to examine the development of Islamic law codification in Southeast Asia. Southeast Asia is a region with Muslims who have peaceful, tolerant, and moderate characteristics. Islam that developed in Southeast Asia has differences with those in Arabia, Morocco, Turkey, India, Pakistan, Uzbekistan, and China in terms of culture and customs. The main question that will be answered in this article is how the codification of Islamic law developed in Southeast Asia. The study uses empirical legal juridical studies with an approach to the social history of Islamic law. The article concludes that from the perspective of Islamic legal history, the development of legal codification has experienced three phases, namely: the kingdom, colonialism, and post-colonialism. Countries with a Muslim majority, such as Indonesia, Malaysia, and Brunei Darussalam, have experienced quite significant development, while countries such as Thailand, the Philippines, and Singapore have not experienced any significant development, and countries such as Cambodia, Vietnam, and Myanmar tend to have no development. In addition, Islamic law that developed in Southeast Asia accommodates local values ​​and customs that become a new identity or "Malay Islam" and are different from other regions.
