Abstract

The presence of a local regulation containing religious teachings has recently been challenged in the form of criticism, which considers that the existence of this regulation product is a form of discrimination and is not effectively implemented. The results of the study, Gorontalo Province, dubbed "Serambi Madinah", the majority of the population is Muslim, putting religion as the main thing in the affairs of life. The urgency of the teachings of Islam in the formation of legal products in Gorontalo is based on several things, in addition to being considered a local wisdom, the law instead presents justice, prosperity and prosperity for its people and serves as a benchmark for how to live a national life based on Pancasila without violating the value of tolerance towards other people. Local regulations based on religious teachings also contain solutions to overcoming the problems of poverty, economic, social and cultural areas that originate from the Qur'an where the teachings are for the salvation of humanity from moral damage. Therefore, it is important to present regulations containing the content of Islamic teachings as a form of preventive and repressive measures for all forms of crime and deviant behavior. Islamic teachings are considered important to be the substance, in addition to supporting parents to provide assistance to children's activities, it also supports the government in carrying out its duties and responsibilities in social affairs.

Abstract

Penyusunan Peraturan Perundang-udangan termasuk produk hukum Daerah (Perda) hendaknya menyesuaikan dengan system pembentukan hukum Nasional berdasarkan ketentuan terbaru dalam UU No. 12 Tahun 2011, serta memperhatikan prosedur dan tata cara yang baik guna menciptakan hubungan (harmonisasi) antara regulasi satu dengan lainnya. Dari hasil penelitian dapat disimpulkan bahwa, Perda Transparansi No 3 Tahun 2002 di Kota Gorontalo masih memiliki kekurangan dan kelemahan, khususnya dari latar belakang pembentukan yang belum memenuhi landasan dan asas penyusunan peraturan perundang-undangan termasuk memuat landasan hukum (yuridis) aturan terbaru sebagai rujukan yakni ketentuan UU Keterbukaan Informasi Publik. Selain itu, Perda belum mengimplentasikan UU No. 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan yang menginginkan penyusunan setiap produk hukum berlandaskan filosofis, sosiologis dan yuridis yang semuanya tercantum dalam lembaran Naskah Akademik serta memperhatikan asas pemberlakuan aturan berdasarkan kronologis pengeluarannya yaitu Undang-undang baru menyampingkan undang-undang yang lama atau (lex posteriori derogat lex priori), dan asas tingkatan Hirarki yang di dalamnya memuat ketentuan peraturan rendah (Perda) tidak mempunyai kekuatan hukum serta tidak mengikat apabila isinya bertentangan dengan ketentuan peraturan perundang-undangan yang lebih tinggi kedudukannya. Oleh karena itu, dalam rangka memenuhi ketertiban hukum dan menguatkan keberadaan serta eksistensi Perda Transparansi, maka hal yang perlu dilakukan adalah menyesuaikannya dengan sistem penyusunan hukum nasional berdasarkan undang-undang No. 12 Tahun 2011 serta memperhatikan landasan dan asas pembentukan peraturan daerah yang baik. Abstract

Through access to regional autonomy, the desire of various regions to formulate Islamic law into their laws and regulations in order to fulfill rights and obligations and respond to various problems of society becomes more open. Therefore, the purpose of this research is to reveal how the function of Sharia Regional Regulations in the implementation and fulfillment of basic service duties of local government, especially from the aspects of education and socio-culture in Gorontalo Province. This type of research includes normative legal research supported by empirical data, which examines comprehensively and analytically the primary and secondary legal materials, using statute approach and case approach. The result of the research indicates that the existence of these regional regulations is one of the provisions ensured in Law no. 23 of 2014 on Local Government and Government Regulation Number 38 of 2007 on the Division of Government Affairs, between the Provincial Government and Regency/Municipal Government. The regional regulations drafted and compiled by the Gorontalo provincial government actually assure harmony of life, security, and order. As it is in the field of one's religious education. The existence of the Regional Regulation of Reading and Writing Al-Qur'an in Gorontalo is able to embody the desire of students to develop their education to higher level, as a condition for entering the next school level. Meanwhile, from the socio-cultural aspect, the existence of Regional Regulations on the Prohibition of Gambling, Prostitution, and Liquor, helps the government create order and tranquility in people's lives, maximize regional potential and development, especially with regard to local wisdom. Therefore, the Regional Government requires to implement and maximize the provisions of sharia regional regulations in order to support development, especially those related to basic services in various aspects, in order to maximize the regional potential and local wisdom.

Abstract

This study aims to analyze local regulations with syari'ah nuances and their relationship with the implementation of local government duties and obligations. The method used in this research is normative juridical using a descriptive analytical approach. The results show that: Regional Autonomy in principle hands over authority to local governments to regulate and manage their territories, including in the preparation of legal products. Perda Syari'ah is drafted as an arrangement for the ins and outs of one's worship, and is also related to social interaction in the community which is called the Muamalah aspect. In this regard, of course this is part of the mandatory affairs of which the regional government is carried out based on the concurrent authority as contained in Article 11 and Article 12 of Law Number 23 of 2014, as well as Article 7 of Government Regulation (PP) Number 38 of 2007. In relation to regional autonomy, the power to manage and regulate the regions becomes the duties and responsibilities given by law and is even contained in the contents of the constitution, the aim is to facilitate the task of the regional head in handling social affairs. Therefore, it is important to respect the traditional rights of the region including the regional regulations with the content of Shari'ah as contained in Article 18A Paragraph (1) and Article 18B Paragraph (1), as well as Paragraph (2) of the 1945 Constitution of the Republic of Indonesia, and simplify religious affairs which are regional rights within the framework of service to the basic needs of the community

Abstract

The existence of abandoned children who are victims of economic exploitation in Gorontalo City is very concerning, because there are many cases related to violence and unfulfilled guarantees of human rights to children. This study aims to find out how to fulfill the constitutional rights of abandoned children as victims of economic exploitation and its inhibiting factors in the city of Gorontalo. The research method uses a case approach and is analyzed qualitatively, data collection through observation, interviews and documentation. The results showed that the fulfillment of children's rights in Gorontalo city was carried out through assessment efforts, cooperation in regional apparatus organizations (OPD), the implementation of raids and interventions, the provision of protection cars (Molin) and mobile motorcycles (Torling) as well as the use of shelter facilities. Factors Hindering the fulfillment of rights include the Economic Difficulties of Parents, Education to children and families has not been sufficiently helpful, because the reasons for carrying out economic activities on their own desires and the demands of needs.

Abstract

Program dalam kegiatan ini berupa Penyuluhan Hukum Adat dengan topik “Optimalisasi Pemahaman Hukum Adat Masyarakat Pesisir Guna Membangun Kesadaran Hukum Adat di Daerah Gorontalo”. Tujuan lain kegiatan pengabdian adalah agar masyarakat mengetahui dan memahami regulasi berkaitan dengan keberadaan hukum adat serta potensi di Desa Botubolu’o. Pengetahuan diberikan khususnya bagi masyarakat dan generasi muda dalam memahami kedudukan serta pentingnya hukum adat ditengah masyarakat. Selain memberikan manfaat dalam pengembangan kehidupan sosial budaya masyarakat, program yang dilaksanakan juga untuk meningkatkan partisipasi desa dalam menjaga adat serta budaya Gorontalo sebagai bagian dari usaha mendukung Gorontalo sebagai salah satu daerah adat di Indonesia. Kegiatan lain yang dilaksanakan adalah pelatihan tarian adat bagi siswa-siswi baik SD, SMP maupun SMA, serta Pembentukan Kelompok Pemuda Pencinta Budaya Desa Botubolu’o. Kegiatan ini dilakukan sebagai bekal untuk menguasai tarian adat bagi generasi mendatang di desa Botu Bolu’o. Selain kesadaran hokum masyarakat, tujuan lain pelaksanaan kegiatan pengabdian ialah membangun kesadaran masyarakat dalam mengelola potensi khususnya kawasan pesisir laut guna pengembangan desa ke depan, serta terjalinya kemitraan Desa dengan Perguruan Tinggi khususnya Fakultas Hukum UNG.

Abstract

The development of the home industry is currently increasingly stretched and is important for economic growth for the country. The more businesses, the more jobs. Micro, Small and Medium Enterprises (MSMEs) are also an important pillar in economic growth, so it is necessary to innovate to make it easier for MSMEs to carry out their roles and activities after the COVID-19 pandemic. However, its development still has obstacles, one of which is the difficulty in obtaining business legality and formality. The problem of MSMEs in the aspect of obtaining business permits and certification must be a serious concern, because the costs are relatively large and need assistance. Anticipating this requires a policy that is able to guarantee and protect business actors so that they can compete in the midst of global economic liberalization. This is experienced by MSMEs in Bendungan Village which consists of several business groups such as; Palm Sugar Producers, Pastries and Egg Nut Manufacturing Groups, who do not yet have legality such as a business license. Based on the existing problems, the solutions offered are specifically in Bendungan village, namely; Counseling on licensing and certification laws. The implementation of this counseling aims to provide understanding to the community, especially business actors to register their products so that they have legality and are recognized for their validity in the community. Not only that, training and Business Management Guidance were also carried out such as product packaging. Counseling was carried out in collaboration with the Office of Investment and Energy and Mineral Resources of Boalemo Regency as a resource person. The licensing process only needs to be done in a system (online) on the Online Single Submission (OSS) page by entering personal data in the form of the business owner's KTP and NPWP. Having a permit for this business makes it easier for people to market their products in supermarkets, and provides opportunities for people to get financial support from the government. While other activities are training in making packaging for community business products accompanied by students. Constraints faced by the community such as ownership of NPWP, it is suggested to the sub-district and village governments to hold a management and procurement program directly in the village to make it easier for the community. In addition, the village needs to map out the marketing locations for community business products and support packaging for the progress of the village, through economic empowerment in home industries.

Abstract

Efforts to optimize existing customary institutions in the province of Gorontalo in law enforcement during society are significant. The organization of customary institutions needs to be addressed and arranged so that they can be enjoyed and utilized. This study uses a sociological juridical approach by obtaining data by interviewing figures from the Gorontalo traditional institutions. This research carries out by analysis through reduction, presentation of data, and conclusion?Gorontalo customary institution. The study results show that the position of traditional institutions in Gorontalo Province is one of the guidelines for people's lives. Customary institutions are the tools that are used and considered to be able to maintain the values of customary law itself. Imposing sanctions through traditional institutions is more effective because an adat institution grows based on values that live in society and recognize and adhered to for generations. In addition, customary institutions help prevent the accumulation of cases in court. The maximum of this research lies in the space given by the government to customary institutions both in ceremonial activities such as marriages and in law enforcement processes. In addition, community participation needs to maintain and utilize the presence of this traditional institution.

Abstract

The purpose of this writing is to discuss the paradigm of the electoral process which is now showing a new face, through technological sophistication, which in foreign terms is called E-Voting (Electronic Voting), and legitimized through Indonesian national laws and regulations. This model is used during the implementation of voting and counting through an electronic device and has begun to be used in several countries, including Brazil, India, Switzerland, and the United States (US), including the Boalemo District Government, which is the umpteenth time using this system in Simultaneous Village head elections implementation in the region. The writing method used is empirical, seeing how a rule works in society. The data obtained is systematically arranged and then processed using descriptive analytical techniques. The study results show that the Village Head Election through the E-Voting system has been carried out for the fourth time by the regional government of Boalemo with an electronic device intermediary based on its legal umbrella, namely Regulation of the Regent of Boalemo Regency Number 48 of 2015 concerning Procedures for Election, Appointment and Inauguration of Village Heads. In practice, there are problems related to the fulfillment of voter rights in the E-Voting Based Village head elections, which are influenced by several things, namely; Location, Time, and Distance of polling stations, Not Accommodating Voters Under Certain Circumstances, Convoluted Voting Systems, and Procedures, Lack of Availability of Human Resources and Infrastructure.

Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui bagaimana bentuk modus operandi serta upaya kepolisian dalam penanganan tindak pidana perjudian togel online di Kota Gorontalo . Jenis Penelitian yang digunakan oleh peneliti dalam menyusun Penelitian ini adalah jenis Penelitian normatif-empiris, Adapun pendekatan yang digunakan oleh peneliti dalam menyusun penelitian ini adalah, antara lain: Pendekatan Perundang-Undangan (Statue Approach); Pendekatan kasus (case approach). Hasil penelitian menunjukkan bahwa upaya kepolisian dalam penanganan tindak pidana perjudian togel online ini pertama mereka melakukan Pertama sosialisasi, meminta bantuan kepada aparat – aparat desa juga mungkin menghimbau kepada mereka biar lebih aktif agar tidak melakukan perjudian. Kedua, Patroli Rutin Aparat Kepolisian Resort Gorontalo Kota, kegiatan ini sebenarnya adalah salah satu tugas rutin dari Kepolisian Resort Gorontalo Kota yang bertujuan untuk memberikan rasa aman dan penertiban pada wilayah hukum Polres Gorontalo Kota ini dan agar tidak terjadi lagi hal – hal yang seperti itu. Dan faktor penghambat dalam penanganan tindak pidana perjudian togel online yakni peran kepolisian dalam menangani kasus perjudian online belum begitu efektif dikarenakan masih adanya hambatan-hambatan yang ditemukan dalam proses penanggulangan tindak pidana tersebut, diantaranya adalah kendala IT yang masih terbatas, sehingga terhadap pelaku judi tersebut hanya dikenakan Pasal 303 KUHP tentang perjudian. Dan dalam penanganan kasus judi online pun mengalami beragam hambatan yang ditemukan dilapangan baik dari segi waktu, biaya dan proses yang tidak mudah dibayangkan. Kata Kunci : Upaya kepolisian; Tindak pidana perjudian; Togel online ABSTRACT This study aims to determine how the modus operandi and the efforts of the police in handling the crime of online lottery gambling in Gorontalo City . This type of research used by researchers in compiling this research is a type of normative-empirical research. The approaches used by researchers in compiling this research are, among others: The Legislative Approach (Statue Approach); The case approach. The results showed that the police's efforts in handling the crime of online lottery gambling were first carried out by them. First, socialization, asking for help from village officials, they might also urge them to be more active so they don't gamble. Second, the Routine Patrol of the Gorontalo City Resort Police, this activity is actually one of the routine tasks of the Gorontalo City Resort Police which aims to provide a sense of security and order to the jurisdiction of the Gorontalo City Police and so that things like that do not happen again. And the inhibiting factor in handling the crime of online lottery gambling, namely the role of the police in handling online gambling cases has not been very effective because there are still obstacles found in the process of overcoming the crime, including IT constraints that are still limited, so that the gambling perpetrator is only subject to Article 303 of the Criminal Code concerning gambling. And in handling online gambling cases, there are various obstacles found in the field, both in terms of time, cost and process that are not easy to imagine.
