Abstract

Bank is an intermediary between a party who have surplus of funds and those who have lack of fund. In this respect,  public trust depends on bank work performance and its ability to manage risk, professionalism and integrity of the bank board and public transparency.  This article discusses the role of Audit Committee to optimize the internal auditor function in the implementation of good corporate governance in BNI 1946 Limited Company.   The article examines   some challenges of the Audit Committee in optimizing such function.  These include the Audit Committee’s inability to (1) boost the Bank Commissioner  in doing supervision and (2) assist Supervision Internal Unit in obtaining accurate data. The author recommends  that accountability and commitment of company board should be conducted professionally in order to effectively optimize the  role of Audit Committee.

Abstract

Penelitian ini adalah penelitian tindakan kelas. Permasalahan dalam  penelitian  ini  adalah  apakah  dengan menerapkan metode diskusi dapat meningkatkan hasil belajar siswa kelas III pada pembelajaran IPS di SD SD Inpres  1 Bolapapu Kecamatan Kulawi, melibatkan 31 orang siswa terdiri atas 14 orang laki-laki dan 17 orang perempuan yang terdaftar pada tahun ajaran 2011/2012. Penelitian ini terdiri atas dua siklus. Di mana pada setiap siklus dilaksanakan dua kali pertemuan di kelas dan setiap siklus terdiri empat tahap yaitu perencanaan, pelaksanaan, observasi, dan refleksi. Hasil penelitian menunjukkan bahwa pada tindakan siklus I yang tuntas secara individu 18 orang dari 31 orang siswa sehingga diperoleh ketuntasan klasikal 58,06% dan daya serap klasikal 60,08%, skor presentaseh observasi siswa 65,25% dan observasi guru 62,5% dengan kategori cukup. Pada tindakan siklus II yang tuntas secara individu 29 orang sehingga diperoleh ketuntasan klasikal 93,54% dan daya serap klasikal 84,51%, skor presentase observasi siswa 90,62% dan obsevasi guru 93,75% dengan kategori sangat baik. Hal ini berarti pembelajaran pada siklus II telah memenuhi indikator keberhasilan dengan nilai daya serap klasikal minimal 70% dan ketuntasan belajar klasikal minimal 85%. Berdasarkan nilai rata-rata daya serap klasikal dan ketuntasan belajar klasikal pada kegiatan pembelajaran siklus II, maka dapat disimpulkan bahwa perbaikan pembelajaran dengan menerapkan metode diskusi dapat meningkatkan hasil belajar siswa kelas III pada mata pelajaran IPS di SD SD Inpres  1 Bolapapu Kecamatan Kulawi. Kata Kunci: Hasil Belajar Sisawa, Metode Diskusi.

Abstract

Setiap peraturan perundang-undangan bersifat abstrak dan pasif. Abstrak karena sifatnya umum, dan pasif karena tidak menimbulkan akibat hukum. Kalau tidak terjadi peristiwa konkrit. Peraturan yang bersifat abstrak itu memerlukan rangsangan agar dapat aktif. Oleh karena itu, setiap peraturan perundang-undangan perlu ditafsirkan terlebih dahulu sehingga dapat diterapkan. Dalam Pasal 33 UUD 1945 merupakan dasar peraturan perekonomian di Indonesia, sehingga Pasal tersebut sangat penting bagi pembentukan peraturan-peraturan yang ada dibawahnya. Pemahaman terhadap Pasal 33 UUD 1945 tersebut perlu di tafsirkan, sehingga niat dari pembentukan Peraturan tentang perekonomian dapat berjalan sesuai dengan apa yang diinginkan dalam Pasal 33 UUD 1945.

Abstract

In Article 33 paragraph (3) of the Constitution of 1945, states earth water and natural resources contained therein controlled by the state and used for the welfare of the people. The realization of such mastery by delegating the authority to manage the natural resources of the state to the company is to provide state Mining Permit or Special Mining Permit. In protecting and overseeing the company that is engaged in coal mining government passed Law Number 4 of 2009 on Mineral and Coal Mining. In Article 162 of Law Number 4 of 2009 states that every person who impede or interfere mining activities from business license holders of mining and business permit of the mining specifically penalized by fines or imprisonment. The article shows a process of criminalization an action (criminal policy), which aim to protect the companies that already have a Mining Permit, but the criminal policy is contrary to the purpose of the criminal policy is an effort for the welfare of society and policies the protection of society, the existence of Article 162 of Law Minerals coal and coal mining communities can impede convicted. In the case of the counteraction form caused they want to protect the environment or their ancestral lands from exploration activities. So it is activity is not uncommon form of criminal policy by means of criminal law that gives rise to new conflicts. Therefore the criminal policy should be shifted from penal facilities to non-penal policy more accommodating community participation, so that the purpose of the criminal policy, namely the welfare of society and protect the community can be realized.Keywords: Political Criminal, Mining, Non-Penal

Abstract

Registering and protecting Beras Pandanwangi CIANJUR aims to avoid counterfeit product. Protected Geographical Indications are a relevant and effective tool to showcase the quality of the products, protect their names and reputations, and develop profitable market. A Book of Specification of Geographical Indications as the main requirement of registration decribes the good and the production methods. the registration system is first to file. Inter professional organization of Beras Pandanwangi CIANJUR which bring together all kind of operators such farmers, processors and traders contribute all the information into the book, submit and manage the registration.  The result revealed that the Geographical Existing rules (Peraturan Pemerintah Nomor 51 Tahun 2007 Tentang Indikasi Geografis) only determine standards of information. Due to technical constrains and lack of cultural documentation, it is need to set up a technical  standardization how to fiil in the information. The effort shall begin with strategic planning by local government by forming the Inter Professional organization (MPIG) of Beras Pandanwangi Cianjur and distributing task according to their competencies.Keyword: Book, Specification, Geographical Indications, Pandanwangi. ABSTRAKBelum terdaftarnya Beras Pandanwangi Cianjur di Dirjen HKI sebagai produk yang berkarakteristik Indikasi Geografis, mengakibatkan penegakkan hukum terhadap praktik-praktik pemalsuan produk tersebut sulit dilakukan. Kendala teknis dan kurangnya budaya pendokumentasian menyebabkan terhambatnya penyusunan Buku Persyaratan yang merupakan prasyarat Pendaftaran Hak Indikasi Geografis. Untuk itu, perlu ditemukan langkah-langkah penyusunan Buku Persyaratan melalui permasalahan apakah terdapat standarisasi dalam penyusunan Buku Persyaratan dan bagaimana langkah penyusunan Buku Persyaratan Beras Pandanwangi Cianjur. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi deskriptif analitis. Hasil penelitian mengungkapkan bahwa Peraturan Pemerintah Nomor 51 Tahun 2007 Tentang Indikasi Geografis baru mengatur standarisasi uraian yang harus dimuat dalam Buku Persyaratan sementara standarisasi teknisnya belum diatur. Langkah penyusunan Buku Persyaratan Indikasi Geografis diawali dengan penyusunan renstra oleh Pemerintah Kabupaten Cianjur dan dinas terkait untuk membentuk lembaga Masyarakat Perwakilan Indikasi Geografis (MPIG) dan distribusi tugas untuk mengisi uraian Buku Persyaratan sesuai kompetensinya.Kata Kunci: Buku, Persyaratan, Indikasi Geografis, Pandanwangi.

Abstract

In this study, will be assessed the implementation of corporate social responsibility by coal corporate to look for an alternative model of corporate social responsibility and environtment protection in the context of protecting and managing of natural resources with environmentally concept. Juridical with conceptual approach, the source analysis data technique derived from literature studies and documents. Dalam penelitian ini akan dikaji pelaksanaan tanggung jawab sosial perusahaan dan lingkungan oleh perusahaan batubara untuk kemudian mencari model alternatif tanggung jawab sosial perusahaan dan lingkungan dalam konteks perlindungan dan pengelolaan sumberdaya alam yang berwawasan lingkungan. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan undangundang dan pendekatan konseptual, sumber data yang digukana diperoleh dari studi kepustakaan, teknik analisa data diperoleh dari studi literatur dan dokumen.

Abstract

Complete systematic land registration is regulated in Ministerial Regulation Number 6 of 2018 concerning Complete systematic land registration.Ministerial Regulation Number 6 of 2018 concerning Complete systematic land registration. Land registration is a form of implementation of government obligations to ensure certainty and protection of land ownership. The Government has guaranteed the legal certainty by Article 19 of Law Number 5 of 1960 concerning Agrarian Principles. Implementing the Basic Agrarian Law related to complete systematic land registration, in the Minister of Agrarian Regulation No. 6 of 2018 concerning Complete Systematic Land Registration, Article 22 states that if you do not have evidence, then in good faith, make a statement. This study will discuss the excellent faith theory of complete systematic registration in realizing legal certainty.    As a guarantor in complete systematic land registration, the state guarantees the truth of the land registered in good faith.
