Abstract

This study aims to analyze the problem of legal uncertainty for MHA related to the establishment of a Land Bank as mandated by the Job Creation Perppu. This research is a normative legal research with a conceptual and statutory approach. The results of the study concluded that the obligation to involve the Customary Law Community in land use through the Land Bank agency is said to be urgent, especially in an effort to maintain the mandate of the 1945 Constitution of the Republic of Indonesia and the UUPA to provide guarantees for recognition, protection as well as empowerment of the Indigenous Peoples. Efforts to realize legal certainty for Indigenous Peoples (MHA) in land use through the Land Bank agency with reference to grammatical, authentic, and teleological (sociological) interpretations, it is necessary to expand the meaning of the word "community" in Article 8 paragraph (2) PP Agency Land Bank which does not only cover society in general (individuals as legal subjects) but includes the Customary Law Community.

Abstract

This study explores the urgent need for reforms in Indonesia's land law system, specifically focusing on incorporating legal pluralism into the national legal framework. Utilizing a normative legal research method, the study scrutinizes primary and secondary legal documents, including the 1945 Indonesian Constitution, the Basic Agrarian Law, and the Job Creation Law, while also incorporating insights from related literature. The main finding indicates that although the Basic Agrarian Law (UUPA) has attempted to blend principles of customary and religious law into the national land law framework, its implementation still exhibits signs of weak legal pluralism, where state law dominates. This research suggests that adopting legal pluralism as a foundational principle in the UUPA could serve as a catalyst for fostering greater harmony between state and non-state laws, encouraging the development of policies that are more accountable and responsive to local realities. This holds significant implications in promoting agrarian justice and sustainability in land management in Indonesia, offering vital insights for ongoing legal reform efforts. Highlights: Inadequate integration of customary and religious law principles in the existing Basic Agrarian Law (UUPA). The potential of legal pluralism as a foundation to foster greater harmony between state and non-state laws. The urgent need for responsive policies that align with local realities to promote agrarian justice and sustainable land management in Indonesia. Keywords: Legal Pluralism, Land Law Reform, Agrarian Justice, Policy Development, Indonesian Constitution

Abstract

The high purchasing power of society and within lengthy periods will cause the state falls into inflation. Inflation has its influence on domestic savings. Hence, the government tries to limit the amount of money which circulates and reduces inflation risk by offering higher interest rates for the people who deposit their money in national banks. The socialization program of early saving is carried out with the purpose of creating national program in creating a generation who isable to manage their finances well. Other than that, the program hopefully has the ability to leverage the interest in saving for children. The children may develop the habit into an insurance for their later life, and autonomously learn to save and to be responsible in managing the money, hence the goals of the program.Teaching the children to save early may also develop positive personality; to save means teaching the children how to be patient, and saving is useful for future savings.

Abstract

This study examines the influence of accounting digitalization and financial literacy on the performance of MSMEs in Pematangsiantar City. MSMEs are an important sector in the local economy, but they face challenges in increasing competitiveness, especially related to financial management and technology adoption. Digitization of accounting can improve the efficiency and accuracy of financial data, while financial literacy helps MSME owners make wiser financial decisions. Using quantitative methods and multiple linear regression analysis, the results show that accounting digitization and financial literacy have a significant positive influence on the performance of MSMEs, both partially and simultaneously. A determination coefficient of 0.411 indicates that these two variables explain 41,1% of the variation in MSME performance. These findings support the importance of increasing digital capacity and financial literacy for MSMEs in strengthening competitiveness and sustainability
