Haryono No. 169 Malang e-mail: masfufah2098@student.ub.ac.id Abstrak Fenomena pandemi Covid-19 turut mendongkrak semakin berkembangnya inovasi teknologi sebagai upaya adaptasi dengan kondisi yang ada bahkan turut menjadi pemicu bergesernya tatanan kehidupan secara global. Digitalisasi berperan penting dalam dunia persaingan usaha. Platform digital yang terkenal dengan kecepatannya berperan penting dalam membangun kepemilikan atas merek. Namun, segala perkembangan yang ada akan seiring dengan risiko yang dihadapi sehingga hukum yang ada harus memadai dalam melakukan pengaturan. Terdapat disharmonisasi norma antara Pasal 41 ayat (8) terhadap Pasal 3 Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dalam konteks pengalihan hak atas merek pada saat proses permohonan pendaftaran merek. Hal ini mengingat bahwa berdasarkan prinsip first to file yang dianut oleh Indonesia dalam sistem perlindungan hukum terhadap hak atas merek, suatu merek terlebih dulu harus diajukan permohonan pendaftaran ke Direktorat Jenderal Kekayaan Intelektual (DJKI) hingga memperoleh sertifikat merek sebagai bukti kepemilikan yang sah dan autentik agar dapat memperoleh perlindungan hukum dari negara. Bagaimana mungkin suatu merek dapat dialihkan kepemilikannya sedangkan status pendaftarannya masih belum terang. Hal tersebut tentu bertentangan dengan konsep kepemilikan hak atas merek. Penelitian ini bertujuan untuk mengharmoniskan ketentuan dari norma yang berkonflik sehingga tercapai kepastian hukum. Hasil penelitian ini memperoleh temuan bahwa ketentuan dalam Pasal 41 Ayat (8) Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis mengandung contradictio in terminis sehingga perlu ditambahkan ketentuan berupa ayat baru agar tercipta kepastian hukum. Kata Kunci: Merek, Hak atas Merek, Pengalihan Hak atas Merek Abstract The covid-19 pandemic has triggered the development of innovation in technology along with the adaptation to the condition that also serves as a contributing factor to the shifting trends of life at a global level. Digitization plays an essential role in business competition. Speed digital access alsoss plays a vital role in the ownership of trademarks. However, all the existing trends of development come with risks, thereby demanding laws to accommodate the issue through regulations. Article 41 Paragraph (8) and Article 3 of Law Number 20 of 2016 concerning Trademarks and Geographical Indications in terms of the transfer of right to trademarks during the process of requesting trademark registration are not in harmony. This is because according to the first-to-file principle that Indonesia follows in the system of legal protection of the right to trademark, the request for registration of a trademark must be filed to the Directorate General of Intellectual Property (DJKI) to obtain a certificate as proof of lawful and authentic ownership to gain legal protection from the state. Trademark status transfer may not be transferred unless the registration has taken place. If any transfer takes place without any clear registration, it contravenes the concept of ownership of rights to trademarks. This research aims to synchronize the conflicting norms to allow for legal certainty. The research result reveals that the provision of Article 41 Paragraph (8) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications can only be done according to particular criteria since it carries contradictio in terminis. That is, a new paragraph of the regulation needs to be added to assure legal certainty. Keywords: trademark, right to trademark, transfer of right to trademark

Abstract

Learning is the process of learning to solve problems with experience and practice. This means that the purpose of learning activities is how to solve problems properly and quickly, both concerning knowledge, skills and attitudes, even covering all aspects of personality. One example is the BMKM (Bimbingan Membaca Kitab Kuning Mandiri) di Pondok Pesantren Darussholah Pakong Modung Bangkalan. The process of learning to teach the yellow book is certain to occur in the world of education, in the delivery of the teaching and learning process the application of the method can vary. One of the important methods found in every pesantren is problem solving. This study uses a phenomenological qualitative approach. With this type of case study. According to Moleong, naturalistic phenomenology means understanding events in relation to people in certain situations, where researchers seek to understand the meaning of a phenomenon. Meanwhile, according to Robert K.Yin, case studies are an empirical inquiry that investigates phenomena in real life contexts, the boundaries between phenomena and contexts are not clearly visible and multiple sources of evidence are used.

Abstract

Pada abad ke-21, manusia mengalami perkembangan ilmu pengetahuan dan teknologi di segala bidang. Salah satu yang paling menonjol adalah teknologi di bidang informasi dan komunikasi.permasalahan yang dihadapi manusia dalam abad 21 ini sangat kompleks,seperti rendahnya kesadaran multicultural disparitas kualitas pendidikan ,dan lain sebagainya. semua ini menunjukkan bahwa di abad 21 ini diperlukan persiapan yang baik untuk membentuk sumber daya manusia yang unggul. Pendidikan memiliki peran untuk membentuk karakter dalam upaya peningkatan sumber daya manusia di abad ke-21. abad ke-21. Pendidikan karakter merupakan solusi atas situasi sikap, perilaku sosial anak, remaja, kaum muda. Kemerosotan atau perubahan sikap dan nilai budaya bangsa harus segera dibenahi melalui peendidikan agama.Pendidikan agama ada bermacam-macam salah satunya dengan menerapkan program tahfidz di sekolah. Adanya program tersebut maka siswa akan dibiasakan menghafal serta mengamalkan ayat suci Al-Qur’an, dengan begitu sikap religius, disiplin, tanggung jawab dan kerja keras siswa akan bertambah dan dapat menciptakan karakter yang lebih baik.Penelitian ini menggunakan penelitian kualitatif deskriptif dengan observasi, dokumentasi dan wawancara sebagai metode pengumpulan data. Adapun teknik analisis data dalam penelitian ini melalui reduksi data, penyajian data, dan verifikasi data. Bentuk-bentuk pendidikan karakter yang dikembangkan dalam Program Tahfidz Al-Qur’an melalui materi dan metode program Tahfidz Al-Qur’an dalam menumbuhkan kesadaran pada siswa akan pentingnya membaca, menghafal dan mengamalkan Al-Qur’an dalam kehidupan sehari-hari.

Abstract

Scholarships have a role in improving the quality of a nation's human resources, but the benefits are still not felt equally in Indonesia. The main obstacle is the limited information about scholarships. To overcome this challenge, scholarship counseling activities need to be held regularly to convey information to the community. Sunan Giri University Surabaya initiated tahfidz scholarship counseling as an effort to provide understanding to the community. The main purpose of this counseling is to provide information about tahfidz scholarships offered by Sunan Giri University Surabaya. In addition, this activity provided an opportunity for counseling participants, who this time came from 60 students of MA Salafiyah Syafi'iyah Seblak Jombang, to ask questions directly to the speakers about the scholarship registration process. In this way, participants were able to understand in detail the intricacies of the tahfidz scholarship program. The tahfidz scholarship counseling organized by Sunan Giri University Surabaya was not only informative but also useful. Participants not only gained knowledge about the requirements and benefits of the tahfidz scholarship, but were also inspired to take a step by applying for the scholarship. Through this activity, it is hoped that counseling participants can become information ambassadors in their environment and invite more individuals to take advantage of tahfidz scholarship opportunities. Thus, the tahfidz scholarship outreach is not only a source of information, but also an effective motivational tool to increase community participation in achieving educational opportunities. With this activity, the benefits of the tahfidz scholarship can be felt more evenly in the community, bringing a positive impact on the development of the quality of human resources and education in Indonesia.

Abstract

Berbagai masalah berkaitan dengan gizi seorang anak balita menjadi perhatian khusus pada bidang kesehatan, selain itu tetap masih diupayakan untuk dituntaskan salah satunya wasting. Studi pendahuluan menyebutkan kontribusi terbesar terjadinya wasting dengan jumlah 173 balita pada area kerja Puskesmas Pantoloan Kota Palu yaitu picky eater, dukungan keluarga (dari segi ekonomi), serta MPASI yang kurang tepat. Pelaksanaan kajian ini memiliki tujuan agar mampu menguraikan korelasi pemberian MPASI bersama tingkat sosial ekonomi yang di mediator tingkah laku picky eater berkenaan dengan peritiwa balita wasting pada Puskesmas Pantoloan Kota Palu. Jenis kajian ini ialah kuantitatif beriringan desain case control. Populasi yang dimanfaatkan dalam kajian ini ialah para ibu yang mempunyai balita 12-59 bulan disertai akumulasi sampel sejumlah 41 balita dengan menerapkan metode cluster sampling. Temuan kajian ini menunjukkan balita wasting memiliki tingkat sosial ekonomi rendah sebesar 79,1%, pemberian MPASI tidak tepat sebesar 84,6% dan perilaku picky eater sebesar 83,8%. Secara simultan, sosial ekonomi dan pemberian MPASI yang di mediator perilaku picky eater mempunyai keterkaitan penting atas fenomena balita wasting. Namun setelah dianalisis secara parsial, tingkat sosial ekonomi tidak memberikan pengaruh terhadap kejadian balita wasting yang di mediator perilaku picky eater.

Abstract

This research aims to examine the application of digital-based learning in increasing student creativity at SMP Islam Parlaungan Waru Sidoarjo, Sidoarjo. This research is qualitative research, while data collection uses observation, interviews and documentation methods. The research results show that PAI teachers in delivering lesson material in the classroom use digital media such as PowerPoint, learning videos, and use smartphones as learning aids. By using digital media in the teaching and learning process, it can be concluded that, one of the teacher's methods is to enliven the class atmosphere so that discussions occur between students, making it easier for teachers to convey the material and students easily understanding the material. PAI subject teachers use digital media in their learning by displaying PowerPoint slides and interesting learning videos. By using digital media, the teaching and learning process becomes more effective and efficient. The use of PPT and learning videos can help students understand the material better and spark creative ideas, while smartphones facilitate wider access to information and interaction. Thus, implementing digital-based learning at SMP Islam Parlaungan Waru Sidoarjo can be an effective strategy for increasing student creativity, which can support more active and innovative learning.

Abstract

Islamic religious education has an essential role in shaping the character and morals of the younger generation, especially in the context of Indonesian society, which is predominantly Muslim. One important element of religious education is the teaching of the Koran, which is carried out at the Al-Qur'an Education Park (TPQ). However, the quality of teaching at TPQ often faces significant challenges, including low reading and writing skills of the Qur'an among students. TPQ in rural areas sometimes still experience difficulties in implementing the method (Rahmawati, 2018). This problem can be caused by several factors, including lack of resources, and limited study time. A more interactive and personal teaching approach will be able to improve Al-Qur'an reading skills (Zulkarnain, 2017). The program "TPQ Assistance by Optimizing Al-Qur'an Reading and Writing to Create a Quranic Generation" aims to achieve several main results. First, this program aims to improve the reading and writing ability of the Al-Qur'an of children at TPQ in the villages of Tambak Lekok, Tampung, and Jati Rejo. In this activity, the ABCD (Asset Based Communities Development) strategy or method is used, where this method is a community development approach that focuses on the strengths and assets that already exist in the community.

Abstract

Perundungan atau bullying merupakan fenomena yang mengganggu keharmonisan lingkungan pendidikan. Permasalahan ini tidak hanya berdampak pada individu yang menjadi korban, tetapi juga merusak dinamika kelompok secara keseluruhan. Lingkungan sekolah idealnya menjadi tempat yang mendukung perkembangan peserta didik secara optimal, baik akademik maupun sosial. Namun kenyataannya di lapangan, beberapa peserta didik masih menghadapi tantangan berupa tindakan bullying yang mampu mengganggu proses belajar mereka. Hal tersebut menjadi urgensi, sehingga penerapan program anti bullying perlu di implementasikan guna mencegah dan mengatasi permasalahan tersebut. Melihat kondisi ini, MI Darul Ulum, Desa Rowo Gempol, menginisiasi pelaksanaan sosialisasi anti-bullying yang digagas oleh mahasiswa Universitas Sunan Giri Surabaya. Sosialisasi anti-bullying ini bertujuan menciptakan lingkungan sekolah yang aman dan mampu mendukung perkembangan peserta didik. Kegiatan ini juga memfokuskan pada peningkatan keterampilan guru dalam mengidentifikasi dan menangani kasus bullying, serta melibatkan orang tua untuk mendukung anak mereka dalam menghadapi dan mencegah perilaku bullying. Objek kegiatan ini ditujukan untuk seluruh peserta didik MI Darul Ulum, Desa Rowo Gempol, dengan melibatkan partisipasi aktif dari kepala sekolah, guru dan juga orang tua. Metode yang dipilih guna pengimplementasian sosialisasi bullying di MI Darul Ulum, Desa Rowo Gempol yakni Participatory Action Research (PAR), dengan langkah berikut: 1) identifikasi masalah, 2) perencanaan, 3) implementasi, 4) evaluasi dan refleksi, 5) diseminasi, serta 6) keberlanjutan. Hasil dari pengimplementasian sosialisasi bullying di MI Darul Ulum Desa Rowo Gempol menunjukkan pelaksanaan kegiatan sosialisasi anti-bullying di MI Darul Ulum telah berhasil mencapai tujuan utamanya yakni menciptakan lingkungan sekolah yang lebih aman. Melalui sosialisasi yang komprehensif, peserta didik, guru dan orang tua mendapatkan pemahaman mendalam terkait bentuk bullying beserta dampaknya, baik secara fisik maupun psikologis. Selain itu juga mendorong terciptanya budaya sekolah yang lebih inklusif dan saling menghargai satu sama lain, serta meningkatkan kesadaran akan pentingnya dukungan dari orang tua dan guru dalam mencegah terjadinya bullying di lingkungan sekitar, khususnya sekolah. Dari kegiatan ini, diharapkan dapat memberikan dampak jangka panjang dalam menciptakan lingkungan sekolah yang lebih aman dan kondusif bagi perkembangan siswa.

Abstract

Spiritual well-being is interconnected with mental health and significantly contributes to health maintenance and recovery from mental illness for all individuals, especially women who marry later in rural regions. The unfavorable perception of rural communities towards individuals who delay marriage manifests in stereotypes such as “old maid,” leading to gossip and labels like unmarketable, selective, playing hard to get, ugly, and very career-oriented. The research aimed to identify the conditions and factors affecting spiritual well-being in rural women who marry later, employing a qualitative phenomenological methodology. Fisher's theory of spiritual well-being was utilized for data analysis, as it offers a comprehensive conceptual framework that accommodates the diverse perspectives articulated in public discourse on spirituality and the viewpoints of historical figures. The study indicates that the spiritual well-being of rural women in Bilapora Rebba Village aligns with four aspects or domains of spiritual well-being, though it does not entirely encompass every element within each domain. The determinants affecting the spiritual well-being of village women who marry later in Bilapora Rebba Village encompass identity, life meaning, forgiveness, respect, kindness, environmental harmony, creator worship, peace with God, prayer practices, self-awareness, and relationships with nature and its wonders.

Abstract

Improving the quality of education in Indonesia requires schools to continue to optimize the whole potential of the learning environment as an effort to support student motivation and learning outcomes. The conducive learning environment has proven to be one of the important factors that influences intellectual development, creativity, and student motivation. This study aims to describe the management of the learning environment and its relationship with students’ learning motivation at MA Al-Khoziny. Employing a qualitative approach with phenomenological methods, data were collected through participatory observation and structured interviews with teachers and students during the even semester of the 2024–2025 academic year. The results show that a conducive learning environment—physically, socially, and psychologically—plays a crucial role in enhancing students’ learning motivation. Classroom management, the availability of facilities, and positive interactions between teachers and students have a significant positive impact on learning quality. These findings emphasize that optimizing the learning environment in madrasahs should be a priority to support the improvement of student motivation and learning outcomes.
