Abstract

The purpose of this study is to evaluate the extent of community involvement in the general elections of 2019-2024 using the perspective of fiqh siyasah. This study was conducted in Nagari Tiku Selatan, Agam Regency. The main objective of this research is to understand the factors influencing voter participation in the context of general elections and the extent to which the principles of fiqh siyasah play a role in this process. This research adopts a qualitative descriptive method as the primary data collection and analysis approach. Data were obtained through documents, observations, and interviews selected representatively from the community of Nagari Tiku Selatan. The results of the research indicate that there are contributing factors to the low level of participation in general elections in Nagari Tiku Selatan. These factors include economic aspects, employment situations, and the level of community awareness. On the other hand, this research also reveals the relevance of the principles of fiqh siyasah, particularly the principle of consultation or "shura," in the context of political participation in Islam. However, the passive attitudes and actions of the community in general elections are considered inconsistent with Islamic teachings that encourage participation in choosing leaders. This research provides valuable insights into community participation in general elections and emphasizes the importance of understanding the factors influencing political participation. The implications of this research can be used as a basis for designing more effective strategies to enhance community participation in future election processes.

Abstract

One of the hallmarks of the indigenous custom of luhak Limo Puluh Kota in West Sumatra, Indonesia, is the rompak page custom. This custom involves the marriage of a couple who comes from a different area or far from the bride's nagari location. The groom by custom must deliver to the woman's family some money or gold as a sign of respect and recognition for the bride. The purpose of this study is to gain an understanding of the view of al-'adah muhakkamah (objective law) regarding the rompak page tradition in the context of the life of the indigenous community in luhak Limo Puluh Koto. This principle of Islamic law states that if a custom or action does not conflict with Islamic law and is considered clear and valid, then this custom may be preserved. In this study, researchers analyzed the views of Islamic scholars and scholars regarding the rompak page tradition in the context of al-'adah muhakkamah. In this analysis, we examined whether the rompak page tradition is following Islamic teachings or whether there are aspects that need to be adapted to the principles of Islamic law. This study has relevance and significance in understanding the suitability of the rompak page tradition with Islamic teachings in luhak Lima Puluh Kota.

Abstract

The evolution of trade dynamics in the digital age has brought forth a landscape filled with both opportunities and challenges. This study delves into the realm of trade transformation within the context of the digital era, employing the theoretical framework presented by Anthony Giddens. Giddens' concepts surrounding modernity, the structure of society, and the role of agents in shaping modern-day interactions serve as the lens through which this analysis navigates the multifaceted landscape of contemporary trade. This study investigates how digital advancements have reshaped trade mechanisms, revealing a landscape marked by significant opportunities for growth alongside challenges stemming from rapid technological change. Through the description of the opportunities presented by digital technologies, as well as the obstacles they introduce, the study provides insights into the dual nature of trade evolution in the digital era. It emphasizes the need for a nuanced understanding of how digital tools and platforms are integrated into trade activities, and how these integrations affect both the opportunities available for economic expansion and the challenges of adapting to a swiftly transforming commerce ecosystem. By examining the interplay between digital advancements and trade mechanisms, this research sheds light on the intricate balance between opportunities for growth and the challenges posed by rapid technological evolution, offering insights crucial for navigating the complexities of today's global trade environment.

Abstract

Buy Now Pay Later (BNPL) services have gained significant popularity among Indonesian customers, particularly within the younger demographic that values convenience and flexibility in online shopping. This research uses a qualitative approach to examine the applications of Islamic law on the utilization of BNPL inside digital transactions in Indonesia, while also assessing its effects on consumer behavior and economic stability. The findings indicate that although Buy Now Pay Later (BNPL) provides ease and accessibility for consumers, substantial obstacles exist in aligning this practice with maqāṣid sharia principles, especially with usury and consumer protection issues. Factors such as financial literacy, governmental laws, and product transparency significantly impact the adoption of BNPL, shaping customer comprehension and utilization of these services. Islamic financial institutions bear a significant obligation to deliver several itemsthat not only meet the demands of consumers but also sharia compliance. As such, this research contributes to strengthening the integration between digital technology and the financial system, as well as supporting sustainable economic growth that is compliant with Shariah principles.

Abstract

Islamic political power is not always related to Islamic parties. Nurcholish Madjid tried to convey a more substantial view of Islam, not just symbolism. This research uses the library research method. Research carried out using literature, both in the form of primary sources, namely research data sources obtained from original sources that contain this information and secondary sources, namely data sources obtained from books and other literature that discuss the topic of the problem. The data processing techniques in this study using content analysis techniques, namely after the data is collected, the next step is to describe the data completely, sequentially, and regularly, and after that the analysis is carried out by looking at each discussion of the themes discussed. Based on the results of this research, it is revealed that Nurcholish Madjid chose Islam that is more substantial than just symbolism. This is rooted in the universal values of Islam, not just the symbol of the "Islamic party" itself. If we look at the current situation, Nurcholish Madjid's criticism is still relevant because currently the politicisation of religion is generally used to attack political opponents or increase party electability.

Abstract

This research focuses on discrimination against religious minorities in Indonesia, Malaysia and Brunei Darussalam, three countries with strong religious traditions and legal systems. As a result of this diversity, different religious backgrounds often raise significant legal and social issues when they want to register their marriages, resulting in unpredictable events and difficulties when settling serious matters. This research utilises a qualitative methodology to examine legal texts, court judgements, court decisions, and data from case studies and interviews, which illustrate the complex interaction between religious and sectarian law. Through a comparative analysis of laws in Indonesia, Malaysia and Brunei Darussalam, this study explains how religious and sectarian norms in the legal system impact discriminatory practices. The research findings of legal and administrative challenges faced by interfaith couples, such as denial of marriage registration and the risk of social stigma, suggest a broader tension between religious authorities and state governance. With comprehensive legal reforms that not only address religious issues but also protect the rights of all individuals, and provide valuable insights and recommendations that can be implemented globally by those responsible for the practice of law, particularly in Indonesia, Malaysia and Brunei Darussalam

Abstract

This article analyses the influence of Soekarno's secular nationalism in forming the Indonesian state. Soekarno, as one of Indonesia's proclaimers of independence and its first president, had a key role in shaping the new country's national identity and political direction. This article describes how Soekarno's secular views influenced the struggle for independence and the formation of the Indonesian state and how this vision of secular nationalism was reflected in various policies and programs of his government. In his writings, Soekarno emphasized the importance of Pancasila as the basis of an inclusive state ideology and reflected the spirit of secular nationalism. Soekarno's vision of secular nationalism was also reflected in his efforts to advance social and economic equality among the Indonesians and promote national independence through industrialization and the nationalization of vital assets. However, this article also highlights the controversy and criticism that Soekarno faced regarding his approach, which tended to be authoritarian in dealing with political opposition and resistance from certain religious groups. At the end of his reign, Sukarno's secular nationalist views began to be challenged by various groups who emphasized religious identity in political discourse. Overall, this article presents a comprehensive picture of the influence of Soekarno's secular nationalism in forming the Indonesian state. Although some aspects of his political approach are controversial, the legacy of Soekarno's secular nationalism remains an important part of Indonesia's national identity. It is relevant in facing the nation's future challenges.
