Abstract

Muhammad Syahrur bin Daib, insinyur teknik sipil kelahiran Syria ini adalah seorang yangpernah menggoncangkan dunia pemikiran Arab sekitar dua dekade lalu. Ia merupakan sosok yangmengagumkan bagi sebagian orang, tetapi menakutkan bagi yang lain. Ia dikagumi karena, walaupuntidak memiliki basis keilmuan formal dalam studi Islam, namun mampu memberikan tawaran yangcukup radikal dalam studi-studi keislaman, bahkan ia sempat dinilai sebagai eksponen utama pembaruanhukum Islam karena gagasannya yang sangat revolusioner dan inovatif itu. Seorang Syahrur mampubertahan melakukan riset--yang kemudian ia sebut sebagai pembacaan kritis--terhadap al-Qur'an hampir20 tahun. Upaya yang sama belum tentu dapat dilakukan oleh mereka yang tamatanan perguruan tinggi Islam atau studi-studi keislaman. Di sisi lain,gagasannya cukup ditakuti karena "mengancam"bangunan hukum Islam dan studi-studi keislamanyang selama ini dianggap sudah mapan.

Sosiolog yang lahir pada14 Januari 1945 di Birmingham, Inggris, ini adalah Direktur Centre for the Study of Contemporary Muslim Societies di University of Western Sydney dan Direktur The Committe on Religion at The City di University of New York. Ia juga tergabung sebagai peneliti pada the American Sociological researchAssosiation. Selain menulis dan mempublikasikan banyak karangan, Turner juga tercatat sebagai editor utama berbagai jurnal, seperti Body and Society,Citizenship Studies, Journal of Classical Sociology,British Journal of Sociology, European Journal ofSocial Theory, Cotemporary Islam, dan Journal ofHuman Right.

Abstract

Ancient manuscripts with uṣūl al-fiqh themes remain rare amidst the increasing efforts to inventory, categorize, and digitize old manuscripts in present-day Indonesia. Nevertheless, literacy initiatives related to uṣūl al-fiqh can still be identified within manuscripts exploring different subjects. This study aims to elucidate how a non-uṣūl al-fiqh-themed manuscript can encompass uṣūl al-fiqh insights intended for a local community. Employing a documentary approach, it relies on primary data from Risālah Marḍiyah by Shaykh Mukhtar Ambai Kerinci. Subsequently, content analysis utilizing a qualitative model captures messages, meanings, linguistic styles, and symbolic interactions. The study reveals that uṣūl al-fiqh’s topics in the manuscript are conveyed using five methods: illustration and exemplification, the statement-argument-example pattern, comparison, argumentative conjunction, if-then pattern, and citation models. The argument posits that scholarly uṣūl al-fiqh literacy efforts in the past need not be solely assessed by the quantity of ancient uṣūl al-fiqh-themed manuscripts; instead, they can be discerned in other manuscripts employing more operationally creative, contextual, and easily comprehensible delivery methods, serving a broader audience.

Abstract

In the context of Indonesia’s digital public sphere, Islamic fatwas disseminated through mainstream media play a pivotal role in shaping religious narratives. This study investigates the actualization of religious moderation within Islamic fatwas published by Republika Online, a prominent media outlet known for its Islamic orientation. The research aims to analyze how the values of religious moderation—as defined by Indonesia’s Ministry of Religious Affairs—are reflected in fatwa content, particularly in the areas of national commitment, tolerance, anti-discrimination, and cultural accommodation. This study employs a qualitative-descriptive design, combining media text analysis with field research and applies Teun A. van Dijk’s Critical Discourse Analysis (CDA)framework to unpack ideological structures behind fatwa discourse. The findings reveal that Republika’s fatwas tend to support religious moderation, especially in relation to national and anti-violence commitments. However, indicators such as cultural inclusivity and the recognition of latent forms of discrimination are frequently underrepresented. Furthermore, references to diverse Islamic legal traditions and local wisdom remain limited. This study contributes to understanding the dynamics of Islamic discourse in media and highlights the strategic role of fatwas in advancing religious moderation. It also offers critical insight for policymakers and media practitioners seeking to strengthen inclusive and context-sensitive religious communication.

Abstract

This study examines the role and position of religion in the Rencong Telang customary conflict in Kerinci Regency, Jambi, which has led to the dualism of customary institutions and the commodification of religious symbols. The research highlights two key concerns: first, the crisis of acculturation between Islam and local traditions; and second, the instrumentalization of religion as a commodity in power contestations. Employing a qualitative approach, this study collects data through in-depth interviews, participant observations, and document analysis, which are subsequently analyzed using an interpretive-descriptive method. The findings reveal that the customary conflict in Rencong Telang emerged as a consequence of the declining authority of religious institutions, rendering them incapable of functioning as mediators in resolving social disputes. This crisis threatens the long-established integration of Islam and adat, embodied in the philosophy of adat bersendi syara’, syara’ bersendi Kitabullah. Moreover, in the absence of religious authority, Islamic values are increasingly commodified as a tool for gaining influence and legitimacy in customary disputes. This research contributes to the academic discourse on religious acculturation by offering a critical perspective on the vulnerability of religious institutions in conflict situations. Future studies should explore the broader socio-political implications of religious commodification and its impact on indigenous cultural resilience.

Abstract

The Mulao Cucu Ayae Tradition is a significant ceremony in Sungai Liuk Village, Kerinci, performed after the marriage contract. This study explores the symbolic meaning of the tradition and its role in fostering social and religious values. Using a qualitative descriptive approach, data were gathered through interviews and observations with local traditional leaders. The findings reveal that Mulao Cucu Ayae serves as both a religious ritual and a moral guide, instilling discipline and cleanliness in the prospective couple's household. Key symbols, such as "banana dandan kelapa," play a role in enhancing personal growth and community identity. Additionally, the tradition strengthens cultural ties and interpersonal relationships within the local community. This research underscores the importance of preserving such ceremonies and contributes to a broader understanding of Indonesia's rich and diverse religious traditions.

Abstract

This study examines the judicial considerations in granting marriage dispensation at the Sungai Penuh Religious Court, particularly focusing on cases where applicants cited dating as a primary reason. The research aims to analyze the factors influencing judicial decisions beyond legal certainty, emphasizing the role of social and religious considerations. A qualitative case study approach was employed to provide an in-depth understanding of judicial decision-making. Data collection involved interviews with court clerks and an analysis of court decision documents to identify the key determinants shaping judges' rulings. The findings reveal that judges' decisions are not solely based on legal certainty but are influenced by multiple factors, including the physical and mental readiness of the prospective spouses, the duration of their relationship, and the urgency of the social context. The application of fiqh principles and maqāṣid sharī‘ah played a crucial role in ensuring that rulings prioritized the protection of children's lineage (nasab) and the prevention of adultery. This study offers a unique perspective on marriage dispensation by highlighting the intersection of legal, social, and religious considerations in judicial decision-making. It contributes to the broader discourse on Islamic family law in Indonesia and the evolving role of judges in applying fiqh-based principles to contemporary issues. The findings provide valuable insights for legal practitioners, policymakers, and scholars in understanding the dynamics of marriage dispensation cases. This research can serve as a reference for future studies on judicial discretion and the implementation of Islamic legal principles in Indonesia's religious courts.

Abstract

Artikel ini dimaksudkan untuk menjelaskan bagaimana pelaksanaan Undang-Undang Perkawinan bernegosiasi dengan aturan-aturan adat dalam suatu komunitas masyarakat. Lazim dipahami bahwa pelaksanaan suatu hukum positif tidak serta merta terlaksana tanpa berdinamika dengan konteks sosial-kultural di mana ia berada, terlebih jika objek yang diatur tersebut sudah diatur terlebih dahulu dengan norma adat yang lebih lokalitstik. Artikel ini bertujuan untuk mengisi celah kekosongan penelitian dalam menjelaskan bagaimana hukum positif memberikan pengaruh terhadap praktik perkawinan yang sudah lama dipraktikkan masyarakat, serta bagaimana norma-norma adat mempengaruhi pelaksanaan norma hukum positif. Studi ini menggunakan pendekatan grounded theory dengan mengandalkan data yang diperoleh melalui wawancara, observasi, dan studi dokumen, sedangkan lokasi penelitian adalah salah satu kecamatan di wilayah Kota Sungai Penuh, Jambi. Artikel ini menunjukkan bahwa masyarakat Kota Sungai Penuh tidak merasa keberatan dengan ditambahkan syarat dalam prosedur registrasi nikah di Kantor Urusan Agama, yaitu harus mendapat persetujuan tertulis dari tokoh adat yang disebut tengganai walaupun syarat itu tidak tertera secara formal dalam dokumen Undang-Undang Perkawinan dan peraturan turunannya. Justru masyarakat menerima tambahan aturan ini sebagai bentuk sinergi yang baik antara aturan negara, aturan agama, dan aturan adat.This article aims to elucidate how the implementation of the Marriage Law negotiates with customary rules within a community. It is commonly understood that the implementation of positive law does not occur in isolation but dynamically interacts with the socio-cultural context in which it operates, especially when the subject matter is already regulated by more localized customary norms. This article seeks to fill a research gap in explaining how positive law influences long-standing marriage practices within a community and how customary norms impact the implementation of positive legal norms. The study employs a grounded theory approach, relying on data obtained through interviews, observations, and document analysis, conducted in one of the sub-districts in the city of Sungai Penuh, Jambi. The article demonstrates that the community in Sungai Penuh does not object to additional requirements in the marriage registration procedure at the Office of Religious Affairs, namely obtaining written approval from a customary figure known as tengganai, even though this requirement is not formally stipulated in the Marriage Law and its derivative regulations. Instead, the community perceives this additional rule as a form of synergistic collaboration between state, religious, and customary regulations.

Abstract

The Bapanteh tradition is a pre-wedding ritual practiced by the Hiang Village community in Sitinjau Laut District, Kerinci Regency. This tradition is not merely ceremonial, but reflects deep cultural values such as kinship, solidarity, and cultural preservation. This study seeks to investigate the symbolic meanings embedded in the Bapanteh tradition, explore the actual practices involved, and understand the reasons behind its preservation amidst modernization. Utilizing a qualitative research approach with Victor Turner’s symbolic analysis as the theoretical lens, data were collected through in-depth interviews with local elders, community members, and traditional leaders, as well as through participatory observation. Findings reveal that Bapanteh serves as a social mechanism to reinforce communal ties and express collective identity. It involves community cooperation in borrowing long batik cloths as symbolic offerings, which are then used to decorate the bride’s home, symbolizing interconnectedness among families. Although contemporary influences have led to adaptations such as reduced collective participation and the use of modern decorations, the symbolic essence of Bapanteh remains resilient. This study highlights the importance of preserving such traditions as they carry profound cultural meaning and serve as a unifying force in society. The findings contribute to a deeper understanding of the function of ritual and symbolism in maintaining cultural identity in an era of rapid social change.

Abstract

This study explores the tradition of beras kafarat (expiation rice) in Tebing Tinggi Village, Kerinci, as a local Islamic practice conducted by families of the deceased as a substitute for unfulfilled prayers. Using a descriptive qualitative method with a case study approach, data were collected through observations and interviews with five key informants directly involved in the tradition. Findings show that although the term kafarat in classical Islamic jurisprudence refers to specific legal penalties such as for oaths or fasting violations, the Tebing Tinggi community uses it symbolically to represent charitable acts intended to support the deceased spiritually. The practice reflects deep-rooted social solidarity and spiritual responsibility, where the act of sharing rice after Friday prayers becomes a meaningful ritual of religious and communal unity. Despite challenges from modernization and generational shifts, the tradition persists through adaptive strategies, value-based education, and community engagement. This study contributes to the discourse on Islamic law by contextualizing local cultural practices within the broader framework of sharia, highlighting the importance of preserving meaningful traditions that align with core Islamic values.
