Abstract

A child who didn’t get affection they tend to be juvenile and consequence may be able to carry out deviate action which collide with regulation. These child must execute criminal process that will ended to a behavior treatment that will take place in The Juvenile Correction. One of the treatment that exist in The Juvenile Correction is the treatment that actually based to child. Those kind of treatment called the individual treatment model. This paper background by issues, firstly how individual treatment model implementation in The Juvenile Correction; second what kind of constraints which found in the individual treatment model in The Juvenile Correction. Research methods used were 1) juridical empirical method;2) socio legal approach;3)case study in The Juvenile Correction in Kutoarjo. Analysis concerning are explained, first individual treatment model was already known. There were the type of individual treatment model were both religiousness and counseling treatment. But, for implementation that model could not implement properly.

Abstract

Restorative justice is a way to resolve criminal cases involving the community, victims, and perpetrators of crime to achieve justice for all parties so that it is expected to create the same conditions as before the crime and prevent further crime. However, implementation is often overlooked in children who commit crimes. The research method used in this study is the normative legal research method with the legislation approach and conceptual approach. This research shows the case of children before the law (ABH) brought in the judicial process must always prioritize the principle of the best interests of children, and the process of punishment is a last resort. Cases can be resolved through informal mechanisms based on standard guidelines. This form of informal handling can be done by diversion through a mediation process facilitated by law enforcement at every level to achieve restorative justice through diversion. Thus, the core of restorative justice is healing, moral learning, community participation and attention, dialogue, forgiveness, responsibility and making changes, all of which are guidelines for the recovery process in the perspective of restorative justice.

Abstract

Penelitian ini bertujuan untuk mengetahui pembinaan anak pidana di Lembaga Pembinaan Khusus Anak Pria Tangerang; kedua, mengetahui pembaharuan pembinaan anak pidana dalam perspektif restorative justice di Lembaga Pembinaan Khusus Anak di  masa datang. Penelitian ini menggunakan metode penelitian yuridis empiris. Pendekatan yang digunakan adalah pendekatan socio legal. Penelitian dilakukan di Lembaga Pembinaan Khusus Anak Pria Tangerang, Banten. Hasil penelitian menunjukkan bahwa program pembinaan anak pidana di Lembaga Pembinaan Anak Pria Tangerang diselenggarakan melalui pendidikan, pelatihan, konseling dan keagamaan Pada pelaksanaannya, pembinaan tersebut masih menemukan kendala khususnya kurangnya partisipasi dari pihak lain dalam rangka memenuhi kepentingan terbaik anak. Upaya pembaharuan pembinaan anak pidana di Lembaga Pembinaan Khusus Anak harus dilakukan, yaitu berlandaskan pada Pancasila sebagai landasan filosofis dan menerapkan konsep restorative justice yang melibatkan pihak terkait sehingga dapat menghilangkan stigma pada diri anak dan memulihkan kembali  kondisi yang terjadi di dalam masyarakat.   Kata kunci :  Pembinaan  anak pidana, Lembaga Pembinaan Khusus Anak, Restorative Justice
