Abstract

The use of amicus curiae has been common in Indonesia, especially in criminal courts. Although there is no clear regulation on amicus curiae, in practice, it has been submitted more than 24 times to the courts. Even there are some judges who consider amicus curiae in making their decisions. This paper aims to determine and examine the legal standing and the strength of amicus curiae under the Indonesian law of evidence. This normative legal research relies on the secondary data in the form of legal material. It is found that the opinion of an amicus curiae, which is usually submitted to the court in written form, could be used as a documentary evidence as intended in Article 187 of the Criminal Procedure Code. However, it has no binding force. Therefore, the judges are free whether or not to consider the opinion submitted by the amicus curiae.

Abstract

Beberapa pihak menilai bahwa penyelesaian perkara tindak pidana melalui sistem peradilan pidana dinilai kurang maksimal, maka dari itu melalui konsep mediasi penal dapat dioptimalisasikan menjadi alternatif dalam menyelesaikan perkara tindak pidana di luar pengadilan. Konsep mediasi penal diambil dari “restorative justice yang berusaha memeberikan keadilan dengan adanya keseimbangan antara korban dan pelaku tindak pidana”. Permasalahan yang akan dibahas pada penelitian ini adalah bagaiaman upaya optimalisasi mediasi penal sebagai alternatif perkara tindak pidana di luar pengadilan, bagaimana kebijakan mediasi penal sebagai alternatif penyelesaian tindak pidana di masa mendatang. Permasalahan tersebut akan dianalisis dengan metode penelitian penelitian yuridis normatif, dengan pendekatan perundang-undangan, analisis. Berdasarkan hasil penelitian diketahui bahwa penyelesaian mediasi penal dilakukan di luar proses peradilan pidana melalui mekanisme perundingan/musyawarah selanjutnya dimintakan perdamaian guna menyelesaikan konflik. Kebijakan mediasi penal dalam pembaharuan hukum pidana bisa dilakukan melalui dua cara yaitu mediasi penal di luar proses peradilan pidana dan mediasi penal sebagai bagian dari proses sistem peradilan pidana.

Abstract

Positive law in Indonesia stipulates that business actors are not allowed to produce and trade all products, including baby clothes that do not meet the Indonesian National Standard (SNI). However, in reality, baby clothing business actors still find violations, for example, in the city of Banda Aceh. Departing from these problems, this study aims to explain the role of the government in protecting consumers. These factors cause the sale and purchase of baby clothes that do not have SNI and legal measures that consumers can take as a form of responsibility for sellers of baby clothes who do not have SNI. This research is legal research that is juridical and empirical that seeks newness based on field research concerning legitimate science. Field research was conducted to obtain primary data through interviews and provide questionnaires with respondents and informants. Based on the results of the study, it is known that the role of the government in protecting consumers has carried out supervision, established several regulations and conducted socialization regarding mandatory SNI for baby clothes that are not SNI but not yet fully effective.

Abstract

Pemeriksaan suatu perkara pidana menjadi bagian yang tidak terpisahkan didalam suatu proses peradilan yang bertujuan untuk mencari kebenaran materiil (materiile waarheid) salah satu usaha yakni dengan menggunakan ilmu bantu kedokteran forensik, Namun sayangnya dilapangan banyak sekali Aparat Penegak Hukum Termasuk Hakim yang tidak memanfaatkan semaksimal mungkin metode yang diperbolehkan oleh Hukum Acara Indonesia untuk menghadirkan kebenaran dan keadilan dalam suatu perkara Pidana Khususnya Pembunuhan. Artikel ini memberikan kejelasan kedudukan dan pengaruh Alat Bukti Kedokteran Forensik terhadap Pertimbangan Hakim. Penelitian ini merupakan Penelitian Normatif. Bahwa Kedudukan keterangan ahli forensik berdiri pada sifat dualisme alat bukti keterangan ahli, Pada suatu sisi alat bukti keterangan ahli yang berbentuk laporan atau Visum et Repertum tetap dapat dinilai sebagai alat bukti keterangan ahli pada sisi yang lain alat bukti keterangan ahli yang berbentuk laporan juga menyentuh alat bukti surat, namun pengambilan keputusan akan sifat dualisme alat bukti keterangan ahli Forensik terletak pada keyakinan hakim dalam membuat putusan. Ilmu kedokteran forensik berperan dalam hal menentukan hubungan kausalitas antara sesuatu perbuatan dengan akibat yang akan menimbulkan akibat luka pada tubuh atau yang menimbulkan gangguan kesehatan atau yang menimbulkan matinya seseorang (causal verbend).

Abstract

Kepolisian sebagai garda terdepan harus mempunya strategi sebagai upaya khusus dalam penanggulangan kejahatan di mas pandemik. Akar dari masalah atau faktor kriminogen perlu diberantas selain kegiatan preventif lain dengan giat patroli, penjagaan dan pengawalan serta penegakan hukum kepada pelakunya. Strategi menjaga kebutuhan ekonomi masyarakat dengan turut membantu penyaluran bantuan sosial kepada masyarakat di seluruh polda hingga polres. Analisis bahan hukum yang digunakan penulis adalah Yuridis Normatif. Hasil dari penelitian ini adalah Pandemi virus COVID-19 telah menimbulkan banyak korban yang tersebar di seluruh Indonesia oleh karena itu butuh sebuah tindakan pencegahan khusus yang berpotensi menimbulkan faktor kriminogen. Potensi kejahatan yang naik dalam masa pandemic adalah kejahatan yang disebabkan faktor kriminogen kebutuhan ekonomi, kebutuhan transportasi, belum bisa berubah menyesuaikan dengan lingkungan masyarakat sekitar (untuk residivis), dan pemanfaatan keadaan kebutuhan barang tertentu yang menimbulkan kejahatan ekonomi Strategi kepolisian dalam penanggulangan tindak kejahatan dalam masa pandemi COVID-19 harus lebih difokuskan dalam penanganan faktor kriminogen dan penyadaran masyarakat akan pentingnya mematuhi protokol kesehatan dalam masa pandemi.

Abstract

This article examines the problem of information security crimes in the conditions of technological progress with the globalization of international life, including relations between countries, taking into account the high level of development of technological and information resources. The importance of ensuring information security as an object of legal protection protected by written international and national law. This research method is normative with a statutory, historical and philosophical approach. efforts to improve international and national legal policies to modernize the national legal system for the prevention and eradication of cybercrime. An effective legal regulatory mechanism for objects to be legally protected is essential to ensure information security. Abstract

This research aims to analyze how the regulation of corporate criminal liability in Indonesia and the opportunity of restorative justice as an alternative to corporate crime prevention in Indonesia. By using a normative approach this research uses a case approach, statutory approach, philosophical approach and comparative approach, this research explores the regulation of corporate criminal liability in Indonesia and how the challenges of alternative corporate crime resolution through restorative justice as a means of crime prevention. The results of this study The legal framework in Indonesia has not been able to fully address the complexity of corporate criminal liability, both in terms of material and procedural aspects.The retributive approach has proven to not touch the root of the problem. This is where restorative justice offers an alternative with a focus on restoring relations between perpetrators, victims, and the community. However, its application in the corporate context is still limited and not supported by integrated regulations.Meanwhile, countries such as France and Germany have adopted the Victim Offender Mediation (VOM) mechanism as part of their criminal justice system. In France, VOM has a strong legal basis, including the 1993 amendment to the Criminal Procedure Code and institutional support from INAVEM. VOM is implemented at the pre prosecution stage, with the condition that the perpetrator admits guilt and the victim's consent. Judges and prosecutors are given the discretion to drop the case if mediation is successful.VOM there is not only a forum for compromise, but also a tool for restoring participatory and humane justice. With a clear mechanism and the active role of mediation institutions, this system opens up opportunities for renewal in handling corporate crimes in Indonesia.

Abstract

Neurolaw offers an innovative interdisciplinary framework that bridges the gap between neuroscience and legal theory and providing new insights into how human brain influences behavior, intention, and moral decision-making. This study examines the intersection of neurolaw and Islamic law, emphasizing the importance of integrating neuroscience findings, such as brain function, decision-making processes, and mental disorders, into Islamic law’s understanding of criminal responsibility, intention (niyyah), and reasoning (ʿaql). This study demonstrates the potential of neurolaw to strengthen empathy, justice, and an evidence-based legal approach in Islamic law using normative legal research methods through legislative, conceptual, comparative, and futuristic approaches. Furthermore, this study explores how Islamic law’s values of justice, objectivity, and responsibility can serve as ethical guidelines for the responsible use of neuroscience in legal reasoning. Ultimately, this study encourages a careful and principled integration of brain science and Islamic law that maintains fundamental Islamic values while embracing scientific advancements to create a more holistic and humane justice system.
