Abstract

The growth of democracy in Indonesia from 1999 to 2019 was significantly hampered by Islamic populist forces, conservatives, and politicians who discriminated against women. This article aims to explore the challenges facing Indonesian political democracy after the 2014 and 2019 elections, using qualitative methods and interviews with party officials. The study uses the theories of Islamic populism, conservation, and discrimination against women. The article finds that the most dangerous challenges include the presence of populist and conservative Islamic forces that use religious sentiment in elections, political party elites that use women as men's political friends, and women seen as a threat to male politicians. This article emphasizes the importance of considering factors outside the electoral political process, such as religious beliefs and understanding, especially in the Indonesian context.

Abstract

Adoption of children is regulated in the Deed of Registration of Appointment 1952 (Deed 253) for Muslims and non-Muslims and the Deed of Adoption 1952 (Deed 257) for non-Muslims. Among the cases involving the struggle for custody is the one that occurred at the Pahang Sharia High Court, in which the judge handed over a child to his biological parents while the child had been registered under the Deed of Registration of Appointment 1952 (Deed 253). Then, in the case at the Selangor High Court, the judge handed over custody rights to the adoptive parents while the adoption registration was invalid. There are two formulations of the problem in this thesis. Firstly, what are the considerations of the Pahang Sharia High Court judges in determining child custody between biological parents and adoptive parents? Second, what are the considerations of the judges of the Selangor High Court in determining child custody between biological parents and adoptive parents? This research uses the juridical-normative method and case studies. Data collection is also done with literature and documentation. The results of the study show that first, the consideration of the judges of the Pahang Sharia High Court in determining child custody of their biological parents is because the judge looks at their efforts to get their child back and they have full rights to the child. Second, the consideration of the judge of the Selangor High Court in determining child custody of the adoptive parents is important because the judge stated that the main thing is what is best for the child, and the child's biological parents also have several obstacles to looking after the child. Custody is closely related to the interests of the child and the guardians, if there is an imbalance in custody, then the rights and interests of the child need to take precedence over the interests of the guardians.

Abstract

The aims of this article is to see the Indonesian media framing toward Habib Rizieq after returning to Indonesia, from Saudi Arabia in 2020. Habib Rizieq Shihab has become one of the media's figures since returning from Saudi Arabia in November 2020. Habib Rizieq is one of the foremost religious figures who has fought or delegitimized Joko Widodo's leadership since 2014. Habib Rizieq has fought for the enforcement of Islamic law in Indonesia and against Jokowi's regime, which he sees as less pro-Islam. The theory used in this article is framing theory. This article analyzes the mainstream media's framing in Indonesia, namely Kompas, Tempo, Jakarta Post, and Republika, in reporting on Habib Rizieq Shihab's figure. In this study, we processed data using the Nvivo 12 and VOSviewer application tools to see media sentiment. In this research, we read 317 news from the four mainstream medias in Indonesia from October to December 2020. We use four keywords in the framing analysis: positive, negative, moderately positive, and moderately negative. This study indicates that moderately negative framing is the highest in Indonesia's mainstream media coverage on Habib Rizieq Shihab's figure. It means that Habib Rizieq failed to reconstruct the power of the masses against Joko Widodo’s regime.

Abstract

Child passenger safety has significantly progressed over the last decade, yet motor vehicle collisions remain the primary cause of mortality for children aged four and above. This policy statement presents four evidence-based suggestions for optimal practices in selecting a child restraint system to enhance safety in passenger vehicles for children from infancy to adolescence: (1) Utilize rear-facing car safety seats for as long as feasible; (2) Transition to forward-facing car safety seats once children surpass the limits of rear-facing seats, typically until at least 4 years of age; (3) Employ belt-positioning booster seats after outgrowing forward-facing seats, generally until at least 8 years of age; and (4) Implement lap and shoulder seat belts for all individuals who have exceeded the requirements for booster seats.  Furthermore, a fifth evidence-based recommendation stipulates that all children under 13 should occupy the rear seats of cars. It is crucial to acknowledge that each change entails a reduction in protection, so parents should be motivated to postpone these transitions for the maximum duration. These suggestions are formulated as an algorithm designed to assist pediatricians in implementing them for their patients and families, addressing most scenarios encountered in practice. The American Academy of Pediatrics advocates that all physicians familiarize themselves with and endorse these suggestions as integral components of child passenger safety anticipatory guidance during each health supervision appointment

Abstract

German sociologist Norbert Elias devised a comprehensive sociological analysis of the interconnections between the processes of state formation, institutional dynamics, individual subjectivity, habitus, and the logic of their transformation over time. The historical sociology of the self, violence, crime and punishment, organizations, emotions, sexuality, social control, and sports are just a few of the many areas in which his work has significantly influenced social scientific thinking. His views have only sometimes been applied to other areas of law and social science study, with his influence in legal academia centered on criminology. This review emphasizes the potential future directions in which Elias's process-figurational approach could advance in sociolegal research and scholarship by outlining (a) the core elements of Elias's "process-figurational" sociology and his analysis of processes of civilization and decivilization, (b) Elias's observations on law and state formation; (c) a selection of the sociolegal research related to his sociological approach, in fields such as crime and punishment, evolving modes of regulation, and international relations; and (d) the potential future directions in which Elias's process-configurational approach might move in sociolegal research and scholarship. These encompass the emotive aspects of family law, human rights, and humanitarianism, as well as the interfaces between legal evolution and broader social change, legal pluralism and legal culture, tort law, constitutionalism, and the rule of law
