Abstract

Contextually, surung sintak law is not stated in the fiqh books. However, contextually, scholars have different opinion on surung sintak law; there are some scholars who allow and some are not. This different opinion happens because there is difference among the scholars in defining tasks and functions of amyl. Those who do not allow the implementation of surung sintak law at the same time at the implementation of zakat fitrah conducted by amyls in the mosques in Samarinda by preparing the rice to be traded and be repeated with the same rice hold that an amyl’s duty is merely to collect and distribute zakat fitrah. On the other hand, the scholars who allow surung sintak view that an amyl is the representation of the people who tithe. Therefore, an amyl not only collects and distributes zakat fitrah to the right people, but also can trade the rice. An amyl has a freedom to use the rice that has been given by the muzakki.

Abstract

To anticipate the legal dispute about syariah economyin society, syariah banks or non-banks as well as the other users, they should realize that they could not depend on the courts if syariah principles wants to be existed. It is because the basic principles of the cases are really different. The changing of UU Nomor 7 Tahun 1989 about Religious Court (UUPA)  becomes UU No. 3 Tahun 2006 and No. 50 Tahun 2009 is a legislacy product which firmly gives the religious courts competency to bring the lawsuits of syariah econonmy to the courts. Then, UU Nomor 21 Tahun 2008 about Syariah banking (UUPS) was coused to be effective to strengthen the religious courts competency to handlethe lawsuits of syariah economy, particularly syariah banking. Based on the UUPA and UUPS, the religious courts should have an absolute competency to bring the lawsuits of syariah econonmy. In fact, the justification of the religious courts competency is still debatable.

Abstract

Since the amendment of Law No. 7 of 1989 to Law No. 3 of 2006 concerning the Religious Courts, the Religious Courts increasingly expand its jurisdiction not only over disputes about the Islamic family law, but also to resolve disputes on Syari`ah economy including Syari`ah banking. The jurisdiction of the Courts to resolve the Syariah economy disputes, however, is reduced with the enactment of Law No. 21 of 2008 concerning Sharia Banking. The explanation of Article 55 paragraph (2) authorizes the District Court (Pengadilan Negeri) to resolve the Syari'ah economy disputes. This provision would cause dualism of authority and, thus, legal uncertainty as the litigants may settle their Syariah economy disputes either to the Religious Courts or the District Court.
