Abstract

Medication errors are commonly found in patient prescriptions. In Article 12 of the Pharmaceutical Law, these cases are only subject to administrative sanctions. It is also stated in the Minister of Health Regulation No. 72/2016 Articles 3 and 12 that the sanctions imposed are only administrative sanctions in accordance with the provisions of laws and regulations. The regulation is quite unclear, and will be clarified in the discussion of this research to identify laws that provide protection for ambulatory patients. The high problem of medication errors in patients indicates that it is required to take real action to prevent these cases to occur which cause detriment to the patient. Therefore, the objective of this research is to determine the factors that cause medication errors in the prescribing and dispensing phases. The research method used in this research is normative research with prospective data collection techniques which both methods can provide an overview and accuracy of data regarding the problem of medication errors on expired medicines. The results indicated that the factors causing medication errors in the prescribing phase and dispensing phase, such as work distractions such as ringing telephones, workload on health workers who are unable to do each job themselves, miscommunication between doctors and pharmacists about the use of drugs for patients, unsupported conditions while working, and education on writing prescriptions that do not comply with the requirements for completeness of prescriptions; the lack of a drug preparation room; and education regarding drug preparation that is not in accordance with prescription requests.

Abstract

The Unitary State of the Republic of Indonesia (NKRI) as a legal state based on the Almighty God has an obligation to protect the rights of its citizens, including press freedom. Press freedom, as the fourth pillar of democracy, is guaranteed by the 1945 Constitution and Law of the Republic of Indonesia Number 40 of 1999 on the Press, which guarantees the right to obtain and disseminate information. However, recent laws such as Law No. 19 of 2016 on Electronic Information and Transactions (ITE Law) and its revision in Law No. 1 of 2024, along with provisions in the Criminal Code, pose potential norm conflicts with press freedom. Articles in the ITE Law are often used to curb press freedom, contrary to the Press Law which provides legal protection for journalistic activities. This research uses a normative legal method to analyze the conflict of norms between the ITE Law, the Criminal Code, and the Press Law. Through this approach, the research examines how legal principles such as Lex Superior Derogat Legi Inferiori and Lex Specialis Derogat Legi Generalis can be applied to resolve conflicts and ensure effective protection of press freedom within the Indonesian legal framework

Abstract

Tujuan korupsi ialah guna menguntungkan diri sendiri atau orang lain, baik perorangan maupun perusahaan, yang bersifat melawan hukum dan dapat mengakibatkan kerugian pada kas pemerintah atau perekonomian negara. Tujuan dari studi ini ialah guna mengkaji perlunya penerapan prinsip malis non expendiat malos esse dalam tindak pidana korupsi di Indonesia dan mengkaji gagasan di balik prinsip itu sendiri. Metode pengumpulan bahan hukum dalam studi ini dimulai dengan studi pustaka dan dokumen, khususnya dengan menyusun bahan-bahan yang berkaitan dengan topik yang diteliti melalui inventarisasi semua bahan hukum yang relevan, baik bahan hukum primer maupun sekunder. Hasil penelitian ini memberikan makna bawa Pada dasarnya implementasi penerapan asas malis non expendiat malos esse pada tipikor di Indonesia telah dijalankan dalam setiap peraturan yang berikatan dengan tipokor sehingga dalam urgensi penerapan ini bukan dirujuk pada ketidak sesuaian aturan yang telah ada, namun pada titik keseimbangan sebuah ketimpangan yang dilakukan oleh tipikor yang telah merugikan negara. Uragensi asas tersebut juga memberikan tingkat keadilan yang seadil adilnya apabila didalam RUU perampasan asset dimuat tentang besaran asset yng akan disita negara sehingga ada titik jera untuk para tipikor. Abstract

This research discusses the lack of effectiveness in the authority of the State Administrative Tribunal (PTUN) in handling disputes arising from positive fictitious decisions, as regulated in Law Number 30 of 2014 on Government Administration. This law emphasizes PTUN's role in providing legal certainty for decisions that are deemed legally granted despite the absence of a response from the relevant authorities. Although PTUN has jurisdiction over such disputes, the overly formalistic procedural approach often leads to lawsuits being dismissed or deemed inadmissible, contradicting the principles of modern administrative justice.This study aims to reconstruct PTUN's authority to enhance its effectiveness in adjudicating cases involving positive fictitious decisions. A normative juridical approach is applied by examining applicable legal provisions, analyzing court rulings, and referring to relevant legal literature. The findings indicate that procedural rigidity and normative ambiguity remain significant obstacles, particularly in determining the object of the dispute and proving the silence of government officials or agencies. This research offers a conceptual reconstruction of PTUN's authority, advocating for a more progressive judicial interpretation and the enforcement of the due process of law principle. Strengthening PTUN’s role is expected to improve administrative accountability, expand public access to justice, and provide better legal certainty in addressing uncertainties arising from government inaction
