Abstract

Tujuan penelitian menganalisis menganalisis Upaya penegak hukum terhadap korban melalui aplikasi pinjaman online ilegal yang terjadi di Masyarakat. Tipe penelitian ini adalah empiris, data yang diperoleh penulis dari studi dokumen maupun wawancara dengan pihak yang berkepentingan dalam hal ini penyidik di Polda Sulsel dan Otoritas Jasa Keuangan Kantor Regional 6. Hasil Penelitian penulis mendapatkan bahwa: 1) Upaya penegakan hukum terhadap pinjaman online ilegal belum efektif, adapun upaya yang dilakukan oleh Penegak Hukum di Polda Sul-Sel dan Ojk yaitu :Upaya pre-emptif berupa pembinaan kegiatan-kegiatan positif bagi masyarakat, sedangkan upaya Preventif berupa pengendalian dan pengawasan. Upaya represif berupa penindaklanjutan dan penegakan hukum guna membuat pelaku menjadi jera dan tidak mengulangi perbuatannya. 2) Faktor- Faktor Yang Mempengaruhi Penegakan Hukum Terhadap korban Tindak Pidana Melalui Aplikasi Pinjaman Online Illegal yang terjadi di masyarakat adalah Faktor hukumnya sendiri, Faktor penegak hukum, Faktor Sarana atau Fasilitas , dan faktor masyarakat serta faktor kebudayaan. The research objective is to analyze the law enforcement efforts against victims through illegal online loan applications that occur in society. This type of research is empirical, with data obtained by the author from document studies and interviews with interested parties, in this case, investigators at the South Sulawesi Regional Police and the Financial Services Authority Regional Office 6. The results of the author's research found that: 1) Law enforcement efforts against illegal online loans have not yet been implemented. effective, the efforts made by Law Enforcement at the South Sulawesi Regional Police and the OJK are Pre-emptive efforts in the form of fostering positive activities for the community, while preventive efforts take the form of control and supervision. Repressive efforts take the form of follow-up and law enforcement to deter perpetrators and not repeat their actions. 2) Factors that influence law enforcement against victims of criminal acts through illegal online loan applications that occur in society are the legal factors themselves, law enforcement factors, facilities or facilities factors, community factors and cultural factors.
