<![CDATA[Penelitian ini bertujuan untuk mengetahui faktor apakah yang menjadi penyebab terjadinya tindak pidana pengambilan paksa jenazah Covid-19 dan sikap masyarakat terhadap terjadinya tindak pidana pengambilan paksa jenazah Covid-19. Metode penelitian yang digunakan adalah deskriptif analisis dengan metode pendekatan empiris. Teknik pengumpulan data dilakukan dengan cara studi kepustakaan. Hasil penelitian ini menunjukkan faktor penyebab terjadinya tindak pidana pengambilan paksa jenazah pasien Covid-19 yakni faktor individu, faktor keluarga, faktor layanan kesehatan, faktor sosial, budaya dan agama. Sikap masyarakat terhadap terjadinya tindak pidana pengambilan paksa jenazah pasien Covid-19 yakni kondisi psikologis yang tidak terkendali dari keluarga jenazah dan nilai budaya yang telah mengakar di masyarakat memicu penolakan pemulasaraan jenazah dengan prosedur Covid-19 yang diperparah dengan praktik di Indonesia dilakukan dengan mandiri dalam masyarakat yang beragam dan dipengaruhi oleh persepsi dan sumber informasi yang kurang tepat. Banyaknya fenomena keluarga pasien Corona Virus Disease 2019 (Covid-19) yang mengambil paksa jenazah korban tanpa mematuhi protokol kesehatan yang ada di beberapa daerah di Indonesia. Seperti halnya di Kota Makassar terkait kasus pengambilan paksa jenazah pasien Covid-19 telah dilakukan penyidikan dan terdapat beberapa orang yang telah ditetapkan sebagai tersangka dalam putusan pengadilan Negeri Makassar Nomor: 42/Pid.S/2020/PN.Mks. Hal ini tentunya akan menyebabkan terciptanya pengurangan jaminan juga kepastian hukum, jika para oknum pelaku tidak diproses secara tegas. Penelitian ini bertujuan untuk mengetahui dan menganalisis faktor yang menjadi penyebab terjadinya tindak pidana pengambilan paksa jenazah pasien Covid-19 di Kota Makassar dan sikap masyarakat terhadap terjadinya tindak pidana pengambilan paksa jenazah pasien Covid-19. This study aims to find out what factors are the cause of the crime of forcibly taking the bodies of Covid-19 and the attitude of the community towards the crime of forcing the removal of the bodies of Covid-19 The research method used is descriptive analysis with an empirical approach. The data collection technique was carried out by means of a literature study. The results of this study indicate that the factors causing the crime of forcibly taking the bodies of Covid-19 patients are individual factors, family factors, health service factors, social, cultural and religious factors. The public's attitude towards the crime of forcibly taking the bodies of Covid-19 patients, namely the uncontrolled psychological condition of the deceased's family and cultural values that have taken root in society, triggers the rejection of returning the bodies with the Covid-19 procedure which is exacerbated by the practice in Indonesia carried out independently in society diverse and influenced by perceptions and sources of information that are not quite right There are many phenomena of families of Corona Virus Disease 2019 (Covid-19) patients who forcibly take the bodies of victims without complying with existing health protocols in several regions in Indonesia. As is the case in Makassar City, an investigation has been carried out regarding the forced removal of the bodies of Covid-19 patients and several people have been named suspects in the Makassar District Court decision Number: 42/Pid.S/2020/PN.Mks. This of course will lead to the creation of a reduction in guarantees as well as legal certainty, if the unscrupulous perpetrators are not processed strictly.
