Abstract

This study aims to analyze the application of diversion to children who commit criminal acts of defamation through social media. The normative juridical method is carried out through analysis obtained from library materials such as books, dictates, and others related to statutory regulations and the concept of jurists as the basis of their research. This study uses a legal concept analysis approach, statutory analysis, and a case approach related to the application of criminal sanctions in cases of defamation. The results of the study concluded that the provisions for criminal defamation through social media are regulated in Article 27 paragraph (3) of Law Number 11 of 2008 concerning Information and Electronic Transactions and cannot be separated from the main legal norms in Article 310 and Article 311 of the Criminal Code as a genus of delict which requires a complaint (klacht) to be prosecuted.

Abstract

This paper is motivated by the implementation of an incident where nurses and midwives who received the delegation of authority could not read the writing from the Doctor which should be read on the Integrated Patient Progress Notes (CPPT) sheet but were read on the operation report sheet and the writing from the doctor was difficult to read. The purpose of this study is to analyze and find the negligence of Medical Personnel in granting delegation of authority to nursing staff and to analyze and find legal protection for Nursing personnel who carry out the delegation of authority from the negligence of medical personnel. Normative legal research, applying normative case mapping involving the results of legal actions, as well as analysis of government regulations. This study applies a qualitative approach. The results of this study have many implications for providing information on the following matters, namely; (1). Nursing personnel can be subject to criminal sanctions in carrying out the delegation of authority due to medical negligence (2) legal protection for nursing personnel who receive the delegation of authority from medical negligence. So, it is concluded that Nursing personnel can be subject to sanctions because the authority given to nursing personnel is not in accordance with their main duties and is not carried out in writing by the person giving the authority.

Abstract

This study explores the implementation of health services for prisoners with disabilities in Surabaya Class I Penitentiary. The background of this study is rooted in the need to understand how the health care system functions for prisoners with disabilities, who often face unique challenges in the correctional environment. The purpose of this study was to evaluate the effectiveness of health services provided, identify existing barriers, and provide recommendations for improvement. The research method used was a qualitative approach with in-depth interviews with health workers, prisoners with disabilities, and direct observation of health facilities and services in the prison. The results of the study indicate that although there have been significant efforts to meet the health needs of prisoners with disabilities, there are still a number of obstacles such as limited accessibility of facilities, lack of training for health workers on special needs, and lack of coordination between related parties. The conclusion of this study is that, although health services have improved, further adjustments are needed in terms of accessibility and training to improve the quality of services for prisoners with disabilities. Additional support and increased coordination between agencies will be essential to ensure better fulfillment of health rights in Surabaya Class I Penitentiary.

Abstract

Penelitian ini bertujuan untuk menganalisis dasar penolakan keputusan medis pasien dewasa kompeten. Melalui penelitian yuridis normatif, penelitian ini mengkaji penerapan norma–norma atau kaidah–kaidah dalam hukum positif. Hasil Penelitian penolakan tindakan medis adalah hak yang dimiliki oleh pasien berdasarkan Undang-Undang Praktik kedokteran No. 29 Tahun 2004 pada Pasal 52 poin (d) yang berisi tentang hak menolak tindakan medis dan Undang-Undang Kesehatan No. 36 Tahun 2009 Pasal 56 poin (a) juga mengatur hak pasien yaitu pasien berhak menolak tindakan medis. Namun, hak tersebut tidak berlaku pada penderita penyakit menular kedalam masyarakat yang luas, keadaan seorang yang tidak sadarkan diri dan gangguan mental berat. Apabila pasien mempergunakan haknya dalam memberikan penolakan terhadap suatu tindakan medis dan pasien telah mendapatkan informasi yang cukup maka segala konsekuensi atas penolakan tersebut menjadi tanggung jawab pasien itu sendiri. Apabila pasien menggunakan haknya dalam menolak suatu tindakan medis maka pasien telah melepaskan hak hukumnya terhadap dokter. Sedangkan akibat hukum penolakan tindakan medis terhadap dokter apabila dokter telah menjalankan kewajibannya maka dokter terlepas dari segala akibat hukum yang timbul setelah penolakan tersebut baik pada aspek hukum perdata maupun aspek hukum pidana.

Abstract

his study was conducted because there were several doubts about the security of patient personal data in the implementation of electronic medical records; leaks that were worried included, first, insurance applications requiring the transmission of patient data using electronic communication, second, patient data leakage through human resources at health facilities who deliberately photographed or provided patient data to other parties, and third, the occurrence of system leaks, one of which was due to a virus. This research aims to resolve disputes over patient data protection in health facilities by law Number 27 of 2022 Article 4 paragraph 2 concerning personal data protection. The research method used in this study is an empirical law approach. Based on the results of the study, it can be concluded that the protection of patient privacy data in the process of applying for insurance/guarantee at Health Service Facilities has been protected by law, and this is legally done in the process made well with a sophisticated system, even recently there has been a special electronic message for health facilities called to restore.
