Abstract

Sea is a important region for the integrity and unifying, a means of defense and security and foremost as a means of prosperity and welfare of a country due to the potential of the marine resources. Geographically, Indonesia can be termed as a maritime nation. Indonesia has the largest sea area in the world where two-thirds of its territory is waters. Indonesian Exclusive Economic Zone (EEZ) is a maritime area that has the greatest wealth potential. To Regulate, protect and enforce the law in the EEZ, the Indonesian government enacted Law No. 5 of 1983 on the Indonesian Exclusive Economic Zone. In that regulation, there is a provision on the sovereign rights as contained in the provisions of UNCLOS (United Nations Convention on the Law of the Sea). Such right is a privilege rights to carry out the exploration, exploitation and conservation of marine resources. To that end, these rights should be used optimally in order to utilize and protect marine resources from illegal fishing by foreign vessels that have been so frequent that it can be utilized for the welfare and prosperity of society.

Abstract

Arbitration and other alternative dispute resolution (ADR) can be used as an option for parties who conduct commercial transactions. This research is crucial to analyse what is the best dispute method  for parties to be able to resolve their commercial business disputes. It is argued that the most important of ADR is the efficiency and effectivines in relation to the enforcement of a judgement on the commercial dispute especially foreign arbitral award.This research also seeks to analyse strengths and weaknesses of each ADR method because it is very important to know in resolving disputes in the field of trade and also related to the implementation of decisions, especially in foreign arbitral award and how to improve decisions and applied in Indonesia in relation to commercial dispute. The research method used in this research is normative juridical consisting of primary, secondary and tertiary legal materials, which were collected by conducting a literature review and interview technique and then processed qualitatively according to the problems and the theoretical framework logically and systematically to achieve the objective of this research, namely finding the best alternative dispute resolution in commercial dispute resolution in business transactions.This paper argued that while each of ADR method has their own strengths and weaknesses, business actors mostly prefer too have arbitration method as their ADR method in solving their disputes. However,the applying mechanism of foreign arbitration awards need further attention from Indonesian government.

Abstract

The presence of Regulation the President No. 112 of 2007 is expected to realize the presence of a modern store that can compete in a healthy and fair with traditional markets. Although it has been mentioned that the establishment of modern stores have to pay attention spatial plan district, does not detract from the fact zoning violations on the establishment of a modern store. The study was based on indepth interviews with informants, traditional markets, modern store merchants, officials in the region Bangkalan, Sampang, Pamekasan, Sumenep.The results of this study can be concluded that the competition between the traditional market with modern stores after the enactment of Regulation the Presidential No.112 of 2007 increasingly stringent, as evidenced by the increasing proliferation of modern stores, especially the mini-sale systems and types of merchandise similar to the traditional markets. The factors that became the driving and inhibiting competition is no regulation and management matters. Efforts are being made in overcoming the constraints of competition through improved physical infrastructure, but have not touched on the professionalism of the management of traditional markets. Key words    : competition, traditional market, modern store after the enactment Regulation the President No. 112 of 2007

Abstract

International Court Of Justice / Mahkamah Internasional adalah lembaga kehakiman Perserikatan Bangsa-Bangsa yang berkedudukan di Den Haag Belanda. Lembaga peradilan ini didirikan pada tahun 1945 berdasarkan Piagam Perserikatan Bangsa-Bangsa. Didirikannya International Court Of Justice adalah untuk menyelesaikan kasus-kasus persengketaan dengan cara damai dan dilarang menggunakan cara kekerasan, sehingga Negara-negara yang sedang bersengketa tidak perlu menyelesaikan sengketa dengan cara kekerasan. Tugas utama dari International Court Of Justice adalah untuk menyelesaikan sengketa-sengketa internasional mencakup bukan saja sengketa-sengketa antar Negara saja, melainkan juga kasus-kasus lain yang berada dalam lingkup pengaturan internasional, Dalam menyelesaikan sengketa antar Negara, Internasional Court of Justice mempunyai  kewena- ngan / yuridiksi yang meliputi kewenangan untuk memutuskan perkara-per- kara  para  pihak  yang  bersengketa dan  kewenangan  untuk  memberikan Opini-opini / Nasihat kepada Negara-negara yang meminta, selain itu Inter- national Court Of Justice juga dapat memberikan opini / nasihat yang diminta oleh Majelis Umum dan Dewan Keamanan PBB, serta badan-badan lain dari PBB selama diijinkan oleh Majelis Umum. Dan berkaitan dengan putusan dari International Court Of Justice, putusan hanya mempunyai kekuatan mengikat terhadap pihak-pihak dan hanya berhubungan dengan perkara khusus dari para pihak tersebut. Putusan International Court Of Justice wajib dilaksanakan oleh pihak-pihak yang bersengketa, jika ada negara tidak mematuhi keputusan, maka ada beberapa sanksi yang diterapkan untuk memaksa negara tersebut mematuhinya.Kata Kunci : Internasional Court Of Justice, Kewenangan dan yurisdik- si, Statuta  Mahkamah Internasional, Piagam  Perserika- tan Bangsa-Bangsa

Abstract

Madurese community prefer to settle civil disputes outside the court by generating peace between the parties in the form of undertable bond, while the mediation results outside the court, the legality is weak. In this regard, this study would like to produce model of non-litigation civil dispute settlement that guarantees binding force of settlement so have binding strength as well as dispute settlement through mediators in court. This research is normative-qualitative research, so the method is combination of legal research methods and sociological research methods. The study results indicate that the mechanism to settle civil disputes in Madura is carried out peacefully through consensus meetings with the mediators help. The mediation has the binding power of customary law because it is based on the voluntary willingness of the parties, carried out through deliberation. This is in line with the local wisdom values such as the value of maintaining "shame" and the value of respect for parents, ulama (Keyae), and leader. Institutionalization of civil disputes settlement in Madurese community through conducted certification to mediator’s village, legitimized by regional regulation, and accommodates the law in society because the law applies in accordance with the sense of justice of the community
