Abstract

Tujuan dilaksanakan pengabdian masyarakat ini adalah untuk memberikan pemahaman, mengevaluasi masalah didalam masyarakat serta mengupayakan memberikan solusi terhadap masalah yang ada di masyarakat terutama mengenai peranan pendidikan tinggi dalam mempengaruhi perekonomian masyarakat. Kebanyakan masyarakat menganggap bahwa pendidikan perguruan tinggi hanya bagi kalangan masyarakat yang mampu saja serta tidak terlalu berguna bagi masyarakat karena telah mengetahuinya melalui teknologi saat ini maupun dari sosial media serta orang ke orang saat ini. Dengan adanya pengabdian masyarakat ini dapat memberikan solusi dan penyegaran beberapa materi ilmu dasar pendidikan yang didapat di perguruan tinggi yang tidak diketahui masyarakat luas dan pemahaman Pendidikan perguruan tinggi mempengaruhi perekonomian masyarakat tersebut. Sehingga pelaksanaan pengabdian ini yang dilakukan di masyarakat memiliki penyelesaian.

Abstract

Dilaksanakan pengabdian masyarakat ini adalah untuk memberikan pemahaman dan keilmuan yang dapat digunakan dan diterapkan didalam bermasyarakat, mengevaluasi masalah-masalah yang terjadi didalam masyarakat mengenai terutama dikalangan mahasiswa di Pematangsiantar serta mengupayakan memberikan solusi terhadap masalah yang berbenturan dengan pemahaman pendidikan karakter baik dalam implementasi di lingkungan perguruan tinggi maupun bermasyarakat. Dengan adanya pengabdian masyarakat ini dapat memberikan solusi dan pendalaman ilmu tentang pendidikan karakter di lingkungan perguruan tinggi dan di masyarakat pemahamannya didalam Pendidikan perguruan tinggi. Pendalaman materi tidak hanya tentang pendidikan karakter, juga beberapa materi tambahan keilmuan yang ada dipelajari di perguruan tinggi yang dapat diterapkan dimasyarakat juga. Selain itu pelaksanaan pengabdian ini juga melatih mahasiswa untuk bersosialisasi dengan masyarakat dan melakukan kegiatan kebersihan di lokasi wisata. Pelaksanaan pengabdian ini yang dilakukan memiliki penyelesaian dan berguna bagi mahasiswa di lingkungan perguruan tinggi dan di masyarakat.

Abstract

Dilaksanakan pengabdian masyarakat ini adalah untuk memberikan pemahaman dan keilmuan yang dapat digunakan dan diterapkan didalam bermasyarakat, serta mengevaluasi masalah-masalah yang terjadi didalam masyarakat mengenai penyebab rendahnya kesadaran Pemuda dalam membangun desa melalui gotong royong di Nagori Buntu Turunan dan upaya menumbuhkan kesadaran Pemuda terhadap pentingnya Pembangunan melalui Gotong Royong di Nagori Buntu Turunan Dengan adanya pengabdian masyarakat ini dapat memberikan solusi dan pendalaman ilmu tentang membangun desa melalui gotong royong di Nagori Buntu Turunan. Selain itu pelaksanaan pengabdian ini juga melatih mahasiswa untuk bersosialisasi dengan masyarakat dan melakukan kegiatan nyata untuk meningkatkan semangat pemuda. Pelaksanaan pengabdian ini yang dilakukan memiliki penyelesaian dan berguna bagi mahasiswa di lingkungan perguruan tinggi dan di masyarakat.

Abstract

The role of law enforcers is at the forefront of the legal world in Indonesia at this time the number of cases and resolutions of legal problems that are applied by prioritizing a sense of justice not only prioritizing legal certainty, legal protection for children can be done as an effort to protect the law against various freedoms and human rights of children. This protection of children also includes interests related to child welfare. The protection of children in conflict with the law is a shared responsibility of law enforcement officials. One form of restorative justice is dialogue between Indonesian people, better known as musyawarah for consensus. So that diversion, especially through restorative justice, becomes a reference for very important considerations in solving legal cases concerning children as perpetrators of crimes.

Abstract

Dalam suatu peristiwa pidana, seseorang yang mendengar, melihat atau mengalami sendiri dengan menyebutkan alasan dari pengetahuannya itu disebut dengan saksi. Selanjutnya seorang saksi akan memberikan keterangannya di sidang pengadilan dan selanjutnya disebut dengan keterangan saksi. Menurut KUHAP, hakim ketua sidang tidak hanya wajib mendengar keterangan saksi yang tercantum dalam surat pelimpahan berkara tetapi juga wajib mendengarkan keterangan saksi yang diajukan baik oleh penuntut umum maupun terdakwa selama berlangsungnya pemeriksaan sidang pengadilan atau sebelum putusan dijatuhkan. Dari pembahasan yang dilakukan dapat disimpulkan sebagai berikut: (i) Pemanggilan terhadap saksi tambahan (yang tidak tercantum dalam surat pelimpahan perkara) baik yang diajukan oleh penuntut umum dan atau terdakwa selama sidang berlangsung atau sebelum putusan dijatuhkan dilaksanakan sesuai dengan ketentuan yang telah diatur dalam Pasal 146 ayat (2) KUHAP, yaitu dilakukan oleh penuntut umum dengan menyampaikan surat panggilan kepada saksi yang memuat tanggal, hari, serta jam sidang dan memuat keterangan untuk perkara apa ia dipanggil yang harus diterima oleh yang bersangkutan selambat-lambatnya tiga hari sebelum sidang dimulai; (ii) Tujuan penuntut umum untuk mengajukan saksi tambahan adalah untuk membuktikan kebenaran dari tindak pidana yang telah ia dakwakan kepada terdakwa (saksi de charge), sedangka tujuan terdakwa/penasihat hukumnya mengajukan saksi a decharge adalah untuk melemahkan keterangan saksi-saksi yang memberatkan terdakwa; dan (iii) Kewenangan menilai keterangan saksi baik yang diajukan penuntut umum ataupun terdakwa (saksi tambahan) ada pada pengumpul fakta (judex facti ) yaitu hakim, dan hakim memiliki kebebasan untuk menerima ataupun menolak kebenaran dari keterangan saksi baik yang memberatkan maupun meringankan terdakwa.

Abstract

Property rights can be transferred to other parties because there is a legal event. The occurrence of a legal event is that with the death of the right holder, the property right passes from the right holder to his heirs, so that the heirs are obliged to register the transfer of rights due to land inheritance. Property rights can also be transferred due to legal actions, such as buying and selling, exchanging, grants to other parties.  This research analyzes data qualitatively with a normative approach method which will examine the object based on legislation. Source of data used is secondary data. Data collection tools used with documentation studies. The location of the research implementation in Toba Regency. Regarding problems that have been bought and sold but not transferred by the next owner until the land has inherited status, when registering the land or changing the name of the land certificate, you need to ask for evidence of the history of the land, which can be letters of compensation, sale and purchase or other documents. others that are related as evidence and will later become an important part when the land will be passed on to descendants in the event of death

Abstract

In social life, humans are always faced with various legal norms that are obeyed and obeyed, because the legal norms contain a rule that becomes a reference or life guide for each individual. One of the objectives of legal norms is to establish safety and order in society. These legal norms are sometimes born in the form of orders to be carried out and sometimes born in the form of prohibitions to be avoided or not done. One of the legal norms born in the form of prohibition is the crime of murder which is regulated in criminal law. Law enforcement in Indonesia, guidance and direction, need to be done so that the law is able to meet the needs in accordance with the level of progress of Indonesian society. Law enforcement is the responsibility of all levels of society and especially those who have an interest in the law because everyone is considered to know and at least feel what is called the law.

Abstract

Legal protection for children who are exploited by adults involved in acts of terrorism is subject to the provisions of Law Number 11 of 2012 concerning the Juvenile Justice System which regulates that children as perpetrators of criminal acts can be subject to diversion as an effort of restorative justice. In the provisions of Article 6 of Law Number 11 of 2012, it states that diversion aims to achieve peace between victims and children as a manifestation of efforts to resolve children's cases outside the judicial process. The purpose of the diversion mechanism is to prevent children from deprivation of liberty and encourage the community to participate and instill a sense of responsibility in children and as a form of protection for the future of children who are exploited by adults to commit acts of terrorism in particular. As regulated in Article 7 of Law Number 11 of 2012 which states that cases of children who commit criminal acts that can be diverted are criminal acts with a prison sentence of less than 7 years and not a repetition of the crime. Article 9 of Law Number 11 of 2012 emphasizes that the lower the criminal threat, the higher the priority for diversion. Children who are perpetrators of terrorism crimes are victims of crimes and not perpetrators of crimes because they are victims who are exploited by adults who should receive protection, so children who are involved in terrorism crimes should receive rehabilitation

Abstract

ABSTRACTOnline prostitution of minors is an act that aims to obtain and can also be offered a child's sexual services by someone or to another person and is accompanied by a payment in the form of money. Online prostitution is an exchange of sexual relations with a reward that is usually in the form of money as a trade or prostitution transaction carried out through the internet or cyberspace as a connecting medium. The media used such as, whatsapp, messenger, facebook, line, and so on. The purpose of this study is to explain the legal protection of minors as victims of online prostitution, the form of legal protection for minors as victims of online prostitution, and efforts to prevent and handle online prostitution. To obtain the data needed in this study, normative legal research was conducted. Normative legal research produces primary data, namely legal materials consisting of laws and regulations, such as Law Number 35 of 2014 Amendment to Law Number 23 of 2002 Concerning Child Protection. And produces secondary data, namely studying books, theories and scientific papers. The results of the study indicate that how legal protection for minors as victims of online prostitution and efforts to prevent and handle online prostitution. However, the form of legal protection requires firmness from Law Number 35 of 2014 Amendment to Law Number 23 of 2002 Concerning Child Protection. In providing protection, so that with strict regulations, minors can be protected by law. Efforts to prevent and handle online prostitution can be seen in terms of prevention before it occurs and handling after a crime occurs. Abstract

The rapid development of Artificial Intelligence (AI) presents significant challenges for Indonesian criminal law, particularly in determining accountability for actions involving AI, whether as an auxiliary tool or as an indirect perpetrator. This study seeks to examine the current criminal law framework, identify deficiencies in the Criminal Code (KUHP), the Electronic Information and Transactions Law (ITE Law), and related regulations, and assess the applicability of alternative liability models, including vicarious liability and strict liability. Employing a normative juridical approach—through the analysis of statutory provisions, legal doctrine, and international case studies—this research finds that national regulations remain predominantly reactive, fail to adequately anticipate the emergence of autonomous AI, and encounter technical evidentiary challenges arising from the ‘black box’ phenomenon. The findings suggest that alternative liability models are better suited to the distinctive characteristics of AI. The study concludes that a responsive reformulation of criminal law norms is essential to ensure legal certainty, protect victims, and facilitate effective law enforcement in the context of AI.
