Abstract

Dari perspektif gender ahli waris dapat dibedakan kepada dua kelompok, yaitu; ahli waris laki-laki dan ahli waris perempuan. Ahli waris perempuan termasuk dalam kelompok zawil furudh, yaitu hak bagiannya dalam pewarisan sudah ditentukan secara pasti. Sementara hak kewarisan laki-laki, khususnya anak laki-laki dikelompokkan kedalam ‘ashabat, yaitu ahli waris yang bagiannya tidak pasti. Isyarat tentang bagian yang akan diperoleh ashabat hanya terdapat dalam surat al-Baqarah ayat 11 dan dalam hadis Rasulullah riwayat Ibnu Abbas. Akan tetapi, ketika kedua nash tersebut diselaraskan telah menimbulkan diskusi panjang di kalangan ulama sejak masa sahabat dan sampai sekarangpun diskusi itu masih belum selesai.

Abstract

Abstract

Analysis of 'Ashâbah Hadiths in the Context of Islamic Inheritance (A Study of Interpretation and ImplementationThe concept of 'asabah which is based on hadith “give the inheritance to the rightful people” (zāwul furϋd) and give the rest to the more primal of the male relatives” is considered discriminatory by many parties as well as it’s reducing the percentage of women's inheritance rights as heirs of dzawul furûdh which have been determined in absolute terms (qaht'i). This paper aims to analyze the hadith about 'ashabah through the ma'anil hadith approach using the takhrîj method as well as textual, contextual and intertextual interpretations. The results of the study concluded that the hadiths of 'ashabah are categorized as valid (sahih) hadiths and can be used as evidence (hujjah) regarding the legitimacy of the 'ashabah system in Islamic inheritance. The application of the ‘asabah inheritance system does not have discriminatory implications. On the contrary, it actually contains the value of distributive justice, because justice in inheritance is not always measured by the similarity of designation between heirs, but is also determined by proportionality based on the size of the burden of responsibility assigned to each heir, the balance between rights and obligations and the balance between what is obtained with needs and uses. In order to measure the aspect of justice, the 'ashabah inheritance system must be understood integrally by placing the position of inheritance as a sub-system of the overall family law system within the Islamic legal system which is intact and comprehensive.

Abstract

This article aims to explore the characteristics of educators depicted in the Hadith of the Prophet. Educators in this era are faced with various challenges, which require them to have strong qualities in order to guide students according to the provisions of Allah SWT. This research uses a descriptive qualitative approach through the literature study method. The research results show that the ideal characteristics of educators in the hadith involve the presence of deep compassion in the process of educating students, justice, a democratic approach, and dedication to providing motivation and clarity in conveying knowledge to those who need it. Through the application of these characteristics, it is hoped that the goal of education can be achieved, namely developing the potential of students so that they become individuals who are faithful, knowledgeable, creative, independent, and can become democratic and responsible citizens. Abstract

Abstract

For Muslims, hadith is something very important because it contains various traditions and habits that developed during the time of the Prophet (PBUH). Indonesia is known for its various traditions and cultures in various regions where these traditions and cultures are integrated with the social life of the community. One of them is the oral tradition of Basiacuong found in the Malay community in Kampar Regency which has been applied for generations where previously it had been carried out by Kampar community leaders. This research is a field research, by tracing directly to the field of objects in the field to dig up information and obtain various data that appear in the field, by observing social phenomena that exist in the community when the tradition is carried out. The location of this research is Koto Perencaran Village, Kampar Regency, because the community in the village still maintains the oral tradition of Basiacuong and applies it in various traditional ceremonies such as marriage, circumcision, akikah, inauguration of traditional heads and so on. Data collection techniques include observation, interviews, and documentation. The results of this study conclude that the Basiacuong tradition found in the Malay community in Koto Perambahan Village, Kampar Regency is the implementation and interaction of living hadith, because the tradition contains good messages and advice, even though the tradition is carried out in traditional ceremonies.

Abstract

Encouraging more effective governance is needed to accelerate the 2030 SDGs agenda both on a global, national, and local scale. The purpose of writing this article is to analyze and evaluate local governance in accelerating the achievement of SDGs on a local scale at the provincial government level, especially in Riau, Indonesia. The method uses a qualitative approach by analyzing various documents related to SDGs on a global, national, and local scale, especially in Riau province, with in-depth research through interviews and literature studies. The study results show that local governance has not been effective in accelerating the achievement of SDGs in Riau. The Riau provincial government is quite committed to the SDGs agenda, but its capacity and policy initiatives are still minimal and limited. The preparation and implementation of regional action plans for the SDGs have not been optimally integrated and coordinated, especially regarding inclusivity and involvement of non-governmental actors.

Abstract

Penelitian ini membahas konsep khulu’ dalam hukum pernikahan Islam melalui pendekatan Maqashid Syariah, dengan fokus kajian pada Hadits Shahih Bukhari No. 5273. Khulu’ merupakan bentuk perceraian atas permintaan istri dengan memberikan tebusan kepada suami, dan menjadi salah satu mekanisme penyelesaian konflik rumah tangga yang diakui dalam syariat. Penelitian ini bertujuan untuk menganalisis bagaimana khulu’ mencerminkan prinsip-prinsip Maqashid Syariah, khususnya dalam menjaga lima tujuan pokok syariat: hifzh al-din (menjaga agama), hifzh al-nafs (menjaga jiwa), hifzh al-‘aql (menjaga akal), hifzh al-nasl (menjaga keturunan), dan hifzh al-mal (menjaga harta). Metode yang digunakan adalah penelitian kualitatif dengan pendekatan yuridis-normatif, serta analisis terhadap matan dan konteks hadits. Hasil penelitian menunjukkan bahwa khulu’ bukan hanya sekadar solusi hukum, melainkan juga bentuk perlindungan terhadap hak dan martabat perempuan dalam pernikahan. Hadits yang dikaji menunjukkan bahwa Nabi Muhammad SAW memberikan izin kepada istri Tsabit bin Qais untuk berkhulu’, meskipun suaminya tidak memiliki kesalahan secara agama, dengan syarat pengembalian mahar. Hal ini menegaskan bahwa syariat Islam menjunjung tinggi keadilan, kebebasan berkehendak, serta maslahat dalam kehidupan rumah tangga. Oleh karena itu, khulu’ sejalan dengan nilai-nilai Maqashid Syariah sebagai wujud keadilan dan kemanusiaan dalam hukum pernikahan Islam.

Abstract

In the era of digital disruption, digital literacy is not just about technical skills, but also about ethics and media responsibility. The Gen Z generation, which has grown up with technology, needs a strong foundation of values. This study aims to critically analyse the role of Ḥadīth as a source of values and ethics in shaping Gen Z's digital literacy awareness, so that the use of technology is not only smart, but also moral and responsible. The background of this study is the increasing use of social media and digital platforms that are often misused, such as the spread of hoax news, hatred, and other unethical behaviour. Ḥadīth as one of the authentic sources of Islamic teachings can be used as a guide in shaping critical, ethical, and responsible attitudes in the digital space. This research uses a qualitative method with a literature review approach and content analysis. Data were collected from various Ḥadīth texts related to communication manners, social responsibility, and ethics in conveying information. The results showed that Ḥadīth has a significant role in building digital literacy in the Gen Z generation. Values such as honesty, responsibility in conveying information, and the obligation to verify the truth of information (tabayyun) are very relevant in overcoming the challenges of the digital era. By taking Ḥadīth as a guideline, the Gen Z can be wiser in using digital technology, so that they are able to utilise digital media productively and positively.

Abstract

Qi???in the terminology of Islamic law is a retaliation applied in cases of killing (qi??? f? an-nafs) and of uncritical wounding (qi??? f? m? d?n annafs). Is it now relevance or not to exercise qi???in order to prevent such cases? Nowadays, the debate on this issue continues to flourish, which is apparently hard to concur for those who involve in this debate stand on two different grounds, namely religious belief vs humanistic perspective. Be that as it may, one cannot deny the fact that while qi?h??constitutes one of Islamic doctrines that every moslem uphold, the application of qi?h??itself seems to have greater effects on the society with which they can maintain proper human rights.
