Abstract

Upaya penegakan hukum yang tegas merupakan salah satu cara mewujudkan tertib tata ruang sehingga menciptakan ruangnasional yang aman, nyaman, produktif dan berkelanjutan. Instrumen hukum penataan ruang dibuat untuk ditegakan danmencegah terjadinya pelanggaran pemanfaatan ruang. Meskipun telah ada instrumen hukum yang mengatur terkait penataanruang, pada pelaksanaannya pengaturan tersebut sulit diaplikasikan dalam kondisi faktual di lapangan bilamana terjadipelanggaran pemanfaatan ruang sehingga berpengaruh terhadap efektivitas penegakan hukum penataan ruang. Melaluimetode penelitian normatif yang bersifat deskriptif analitis, penelitian ini mencoba menjawab: (1) apakah faktor-faktor yangmempengaruhi efektivitas penegakan hukum penataan ruang, (2) apakah penegakan hukum penataan ruang yang sudahberjalan dapat dinilai efektif, (3) bagaimana solusi untuk mencapai efektivitas penegakan hukum tersebut. Hasil penelitianmenunjukan bahwa faktor-faktor yang mempengaruhi penegakan hukum penataan ruang adalah faktor hukum, penegakhukum, sarana/fasilitas penunjang, masyarakat dan kebudayaan. Dari kelima faktor tersebut dapat diketahui penegakanhukum penataan ruang belum efektif. Solusi agar penegakan hukum penataan ruang dapat efektif yakni dengan perbaikankualitas perencanaan tata ruang, penerapan asas ultimum remedium, membuat aturan pelaksanaan yang menunjang prosespenegakan hukum dan memperbaiki skema kelembagaan bagi penegak hukum tata ruang.

Abstract

Food Reserves and food security are two concepts that cannot be separated because good and strong food security will have implications for both national and regional food reserves. This study aims to discuss (1) the function and role of regional apparatus organizations in the era of regional autonomy? and (2) What are the problems faced in implementing Regional Food Reserves? The research method is carried out with a normative juridical type through a statute approach. The study results show that (1) The duties and functions of regional organizations in terms of food security and reserves must be integrated with local and village governments. (2) Problems in the Implementation of Regional Food Reserves, namely the Management of food security or food availability at the national and regional levels and the conversion of agricultural land, which has a tremendous impact on food reserves.

Abstract

ABSTRAKPenyelesaian sengketa lingkungan hidup melalui mediasi merupakan hal yang penting dalam upaya penegakan hukum lingkungan hidup, terutama setelah diberlakukannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja (UUCK) yang lebih memperhatikan perlindungan keperdataan masyarakat (Pasal 91 ayat (2) huruf d Undang-Undang Nomor 11 Tahun 2020). Tujuan dari penelitian ini adalah untuk mengevaluasi eksistensi mediasi sebagai bentuk penyelesaian sengketa lingkungan hidup dan kendala yang dihadapi dalam penggunaannya setelah diberlakukannya UUCK. Penelitian ini menggunakan pendekatan yuridis normatif, dengan fokus pada analisis perundang-undangan dan konsep hukum. Dalam penelitian ini, ditemukan bahwa eksistensi mediasi dalam penyelesaian sengketa lingkungan pada prinsipnya telah menjadi budaya masyarakat Indonesia sejak dulu dan eksistensi berkembang dengan hadirnya berbagai peraturan perundang-undangan misalnya SEMA Nomor 1 Tahun 2002 tentang Pemberdayaan Lembaga Perdamaian dan Peraturan Mahkamah Agung (PERMA) Nomor 2 Tahun 2003 tentang Prosedur Mediasi di Pengadilan, Peraturan Mahkamah Agung Nomor 1 Tahun 2008 tentang Prosedur Mediasi di pengadilan dan Peraturan Mahkamah Agung (PERMA) RI Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan serta yang terbaru dalam UUCK. Meskipun mediasi seringkali tidak memuaskan, tetapi masih merupakan salah satu upaya yang penting. Namun, kendala yang dihadapi dalam penggunaan mediasi dalam penyelesaian sengketa lingkungan hidup semakin kompleks setelah putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 menyatakan bahwa UUCK inkonstitusional bersyarat, sehingga tidak mungkin untuk membuat aturan teknis tentang penyelesaian sengketa lingkungan hidup melalui mediasi. Meskipun UUCK sudah dinyatakan tidak berlaku dengan hadirnya Peraturan Pemerintah Pengganti Undang-Undang (PERPU) Nomor 2 Tahun 2022 tentang Cipta Kerja, namun Perpu masih menyisakan perdebatan dan belum menjadi Undang-Undang hingga tulisan ini diterbitkan.Kata kunci: cipta kerja; lingkungan hidup; mediasi; penyelesaian sengketa.ABSTRACTSettlement of environmental disputes through mediation is an important matter in efforts to uphold environmental law, especially after the enactment of Law No. 11 of 2020 concerning Job Creation (UUCK) which pays more attention to the protection of civil society (Article 91 paragraph (2) letter d of the -Law Number 11 of 2020). The purpose of this study is to evaluate the existence of mediation as a form of environmental dispute resolution and the obstacles encountered in its use after the enactment of UUCK. This study uses a normative juridical approach, with a focus on statutory analysis and legal concepts. In this study, it was found that the existence of mediation in resolving environmental disputes in principle has been a culture of Indonesian society for a long time and its existence has developed with the presence of various laws and regulations, for example SEMA Number 1 of 2002 concerning Empowerment of Peace Institutions and Supreme Court Regulation (PERMA) Number 2 of 2003 concerning Mediation Procedures in Courts, Supreme Court Regulation Number 1 of 2008 regarding Mediation Procedures in Courts and RI Supreme Court Regulation (PERMA) Number 1 of 2016 concerning Mediation Procedures in Courts and the latest in UUCK. Although mediation is often unsatisfactory, it is still an important endeavor. However, the obstacles encountered in using mediation in resolving environmental disputes are increasingly complex after the Constitutional Court decision Number 91/PUU-XVIII/2020 stated that UUCK is unconstitutional conditional, making it impossible to make technical rules regarding environmental dispute resolution through mediation. Even though the UUCK has been declared null and void with the presence of Government Regulation in Lieu of Law (PERPU) Number 2 of 2022 concerning Job Creation, the Perpu still remains up for debate and has not yet become a law as of the time this article was published.Keywords: job creation; environment; mediation; dispute resolution.

Abstract

Based on experts' observations, in Indonesia, there are many phenomena of structural disputes in the use of space, namely disputes caused by policies and or decisions of public officials, both at the central and regional levels, which cause many victims in society and impact a very wide area. Before the birth of the Job Creation Law, Law Number 26 of 2007 concerning Spatial Planning regulated spatial disputes and their resolution. Still, the arrangements were unclear and often led to confusion with the mechanism for resolving spatial use violations through administrative/criminal sanctions. This study examines the Legal Construction of Spatial Planning Dispute Resolution After the Job Creation Law was enacted. The research is normative legal research with a statutory approach taken from secondary and tertiary data, which is then analyzed  . And will be analyzed by descriptive-analytical methods. The results of the study show that at the time the Job Creation Law was issued, legal reconstruction was carried out by clarifying the rules regarding spatial planning disputes, which consisted of (1) Categorizing spatial planning disputes as one of the instruments for controlling spatial use, (2) clarifying the identification of spatial planning disputes, (3) clarifies the subject and object of spatial planning disputes, (4) clarifies the mechanism for resolving spatial planning disputes and (5) clarifies the authority of each Central and Regional government.

Abstract

The management of BUMDesa is not yet optimal because many BUMDesa administrators still need to understand BUMDesa regulations and institutions. Seeing these problems, there needs to be capacity building preceded by legal reasons as a guideline for regulating BUMDesa management signs. Increasing the capacity of Village-Owned Enterprises (BUMDesa) as an organ driving the village economy can be carried out through the Job Creation Era, which has become a momentum for structuring BUMDesa regulations and institutions. The era of work creation referred to is the birth of Law Number 11 of 2020 concerning Job Creation which is now declared invalid with the presence of Government Regulation  (Perpu) Number 2 of 2022 concerning Job Creation. This study uses normative legal research methods(normative legal research). The author uses this legal research because the focus is on studying literature and laws and regulations related to the object of research. The results of the research show that the Job Creation Perpu needs to be pushed into law so that it can become a legal umbrella for the establishment and management of BUMDesa institutions because, in fact, the spirit that is carried out in the Job Creation Era, namely improving the investment ecosystem and business activities, one of them through the institutional arrangement of BUM Desa.

Abstract

Penyelesaian sengketa lingkungan hidup melalui mediasi merupakan hal yang penting dalam upaya penegakan hukum lingkungan hidup, terutama setelah diberlakukannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja (UUCK) yang lebih memperhatikan perlindungan keperdataan masyarakat (Pasal 91 ayat (2) huruf d Undang-Undang Nomor 11 Tahun 2020). Abstract

The purpose of this research, which is based on an evaluation of Indonesia's cybercrime legislation, is to examine the difficulties encountered by the Indonesian National Police in carrying out their duties to combat cybercrime and computer crime, and to draw conclusions about how recent technological advancements have contributed to an increase in both the frequency and severity of these crimes. This study employs a philosophical and analytical approach to normative law as its research methodology. It examines applicable statutes and regulations, as well as legal theory and current practices in law enforcement. Cybercrime is on the rise, and the study's findings suggest that this trend is directly tied to the expansion of information technology, which in turn allows cybercriminals to employ more complex strategies. Not having clear legislative restrictions pertaining to cybercrime, insufficient preparation on the part of law enforcement, subpar system security, and an uninformed public are the primary challenges. Some of the proposals include creating communication platforms amongst law enforcement agencies to boost collaboration in the fight against cybercrime, educating the public and conducting targeted investigations using cutting-edge technical methods, and expanding outreach and education efforts to the general population.

Abstract

This study seeks to analyse the constitutional provisions on political neutrality within the framework of Indonesia's democratic process, particularly as it pertains to the establishment and upkeep of a democratic society founded on social fairness and the preeminence of legal principles. This study examines applicable laws, legal theories, and police procedures via a normative-philosophical and descriptive analytical lens. Findings highlight the need of political neutrality in state administration and bureaucracy for maintaining a just and fair democracy. Government impartiality and honesty can only be restored by overhauls to political ethics and the inner workings of bureaucratic politics. In light of Pancasila and the Constitution of the Unitary State of the Republic of Indonesia (1945), this conclusion stresses the need of cooperation across different parts of the country in order to establish a national legal system that upholds democracy and social justice.

Abstract

Indigenous societies' social interactions are governed by customary law, which has a major impact on cultural identity. Conflicts between local customs and the standardized elements of positive law make it difficult to integrate customary marriage rules into Indonesia's national legal system. Indonesia acknowledges the importance of customary law, yet there is still inconsistency when it comes to marital customs and other areas where it is included in national laws. The goals of this research are twofold: first, to understand how positive law in Indonesia interacts with customary marital law, and second, to find ways to bring these two systems together in a way that promotes inclusivity, justice, and cultural diversity. This study utilizes a normative juridical method by conducting qualitative and comparative analyses of pertinent literature, legal concepts, and legislation. The article looks at marriage legislation from both a positive and traditional perspective, comparing and contrasting the two. In particular, the results show that there are substantial obstacles to bringing traditional marriage regulations into line with modern legal norms in the areas of marriage registration, gender equality, and the age of consent. The research suggests a mechanism for incorporating Indonesia's traditional marriage rules into the country's formal legal framework, with the goals of protecting cultural values and promoting social justice and human rights. Insights from this study may help academics, legal professionals, and legislators make national law more welcoming and sensitive to other cultures.
