Abstract

Abstract This paper focuses on the criminal law formulation policy related to criminal Law No. 22 of 2009 concerning Traffic and transportation. The policy formulation certainly need to be tied in every stage of the making, the implementation and accomplishment in order to create a sustain system.  The formulation policy or the stage of making the law is a fundamental policy in criminal law policy because formulation policy is determinant of to whether a law could be applied in society. The issues discussed in this paper are: (1) How the formulation policy of criminal law in Law Number 22 Year 2009 regarding Traffic and transportation? (2) How the formulation policy of criminal law in the Law of Traffic and Transportation in the future? Firstly, the formulation policy of Law Number 22 Year 2009 regarding Traffic and Transportation will be discussed with three main discussion of criminal law which are criminal offense, criminal liability, and crime. Secondly, for the formulation policy of criminal law in the Law concerning traffic and transportation in the future the writer employs the concept of Penal Code 2012 as consideration to attain a formulation that could improve the current formulation. Such formulations are as followed:(a) qualifying offense should be retained but must be consistent with the legislators in the inclusion of criminal penalty so legal result will be clear. (b) In the arrangement of criminal penalty the criminal objective and guideline is needed. Keywords: policy formulation, criminal law, and Traffic

Abstract

Recognition of living law in society or customary law / unwriten law, marking a pluralistic spiritual life that have law. Lawmakers (legislative or judge) must accommodate those values in their legal products. Moreover, judges as formers of practical law are obliged to explore and understand the values that live in society, which is the soul of the nations personality (volkgeist), which is reflected through its Verdicts, so that the verdict can have transcendental values / spiritual values. The enactment of customary law as the basis of the Verdict of the judge or in other words the formation of the law by the judge through the Verdicts based on customary law, has existed before the Indonesian constitution is amended, namely in Article 5 paragraph (3) sub b Act No. 1/1951 About Measures - Temporary Measures for Conducting the Union of Suspended Power and Events of the Civil Courts.

Abstract

The first objective of this study is to determine the extent to which the government has made efforts to prevent and eradicate corruption, the second is to determine the effectiveness of the imposition of the death penalty for corruption perpetrators as a solution for handling corruption during the Covid-19 pandemic. This study uses a juridical-normative approach where the main data source is secondary data in the form of written materials about the law which are then analyzed quantitatively with the aim of producing descriptive analytical data. From this research, it is found that efforts to prevent and eradicate the criminal act of corruption in Indonesia are carried out through prevention and prosecution efforts. Indonesia has entered the state level in a state of danger as regulated in the explanation of Article 2 subsection (2) of the Law on criminal act of corruption regarding certain circumstances due to various kinds of policies issued by the government regarding the Covid-19 pandemic, so that the implementation of the death penalty for corruption perpetrators, especially in the Covid-19 pandemic situation, has a preventive effect on public officials who will commit corruption.

Abstract

All forms of violence against women and children in the household are violations of human rights and crimes against human dignity as well as forms of discrimination that must be abolished. However, the psychological violence that occurs in the community, which as of this writing is in Grobogan Regency, is still difficult to find the exact number and is hampered in the process of proving it. The method used in this research is sociological juridical. This paper aims to determine the regulation of psychological violence itself that has been applied in Indonesia and then to describe the legal culture of the community against the occurrence of psychological violence. Basically, the concept of psychological violence is commonly found in the law on the elimination of domestic violence and the law on child protection. It is society habits if there is a psychic occurrence are still in doubt and consider the problem to be a private family problem, even if it is considered a light and embarrassing thing to be disclosed as a form of violence.[]Segala bentuk dari kekerasan terhadap perempuan dan anak dalam rumah tangga merupakan pelanggaran hak asasi manusia, kejahatan terhadap martabat kemanusiaan serta bentuk diskriminasi yang seharusnya dihapuskan. Namun kekerasan psikis yang terjadi di masyarakat yang pada tulisan ini di Kabupaten Grobogan, masih sulit ditemukan jumlah pastinya serta terganjal pada proses pembuktiannya. Metode yang digunakan dalam penelitian ini adalah yuridis sosiologis. Maka tulisan ini bertujuan untuk mengetahui pengaturan dari kekerasan psikis itu sendiri yang telah berlaku di Indonesia kemudian  mendiskripsikan budaya hokum masyarakat terhadap terjadinya kekerasan psikis. Pada dasarnya konsepsi kekerasan psikis bias ditemukan didalam undang-undang tentang penghapusan kekerasan dalam rumah tangga dan undang-undang perlindungan anak. Kebiasaan masyarakat jika terjadinya   psikis masih ragu dan menganggap masalah tersebut masih merupakan masalah privat keluarga bahkan dianggap hal yang ringan dan memalukan untuk diungkap sebagai bentuk kekerasan.

Abstract

Pledoi adalah suatu tahap pembelaan yang dilakukan terdakwa untuk dapat melakukan sanggahannya mengenai tuntutan yang dituntutkan oleh penuntut umum. Di dalam undang-undang telah mengatur mengenai pledoi didalam pemeriksaa sidang pengadilan, yakni pada pasal 182 ayat 1 KUHAP. Walaupun tidak secara menyeluruh pembahasannya, namun cukup jelas untuk dapat dimengerti. Pledoi ini dilakukan secara tertulis dan dibacakan di muka persidangan. Tujuan pledoi sendiri adalah untuk meminta putusan bebas atau lepas dari segala tuntutan hukum. Namun, dalam pakteknya masih dapat ditemui kesalahpahaman dalam melakukan pledoi ini, seperti isi dari pledoi itu sendiri hanya meminta keringanan hukuman saja dan juga masih terdapat pledoi yang dilakukan secara lisan dalam persidangan. Kegiatan pengabdian kepada masyarakat ini membantu memberi pemahaman kepada peserta mengenai hak terdakwa dan memberikan pemahaman mengenai pembuatan pledoi. Sosialisai ini bertujuan untuk memberikan pelatihan bagi Terdakwa di Rumah Tahanan Kelas IIB Boyolali agar para Terdakwa mengetahui dan sadar betapa pentingnya Pembelaan/Pledoi atas tuntutan Jaksa Penuntut Umum. Bahkan jika Terdakwa tidak didampingi oleh penasehat hukum pun mereka mampu memperjuangkan haknya untuk melakukan Pembelaan atas tuntutan Jaksa Penuntut Umum.  Pemenuhan hak Terdakwa akan memberikan rasa keadilan dalam persidangan.AbstrackPlea is a stage of defense conducted by a defendant in order to be able to argue against the rebuttal by the public prosecutor. The law regulates plea in court, namely in article 182 paragraph 1 of the Criminal Procedure Code. Although not thoroughly discussed, it is clear enough to be understood. The plea was done in written and read out on the court. The purpose of the plea itself is to ask for an acquittal or release from all lawsuits. However, in practice there can still be misunderstandings in carrying out this plea, such as the contents of the plea itself only demanding for leniency and also there are plea that still carried out orally in the trial.Key Word : Law, Plea, Devendant

Abstract

Legal aid is legal services provided by legal aid providers free of charge to legal aid recipients. Based on the basic constitution of the Indonesian nation which aims to guarantee the constitutional rights of everyone to get recognition, guarantee, protection, and legal certainty that is just and equal treatment before the law as a means of protecting human rights, where this is one form of protecting community rights and the form of the state in being responsible for providing legal aid for the poor as a manifestation of access to justice. The purpose of the legal counseling activity is to provide skills as well as an understanding of legal aid and how to obtain it for the community in Mojogedang Village, Mojogedang District, Karanganyar Regency. The method used in this activity is socialization which is then followed by legal assistance for the community in Mojogedang Village, Mojogedang District, Karanganyar Regency.

Abstract

Purpose: This study aims to determine the criminal law policy on sexual exploitation in Indonesia and discover the current legal policy from the perspective of victimology.Methodology: This study is based on doctrinal legal research or normative juridical procedures with a legal perspective in the traditional sense of “law in the book”. Normative legal research is essentially a legal research library in which the author studies the legal principles beginning with specific sectors of the legal system and the identification of legislatively enacted legal norms.Results: The findings revealed that the criminal law policy on sexual exploitation in Indonesia and the current legal policy from a victimology view, comprising the legal protection from Law Number 21 of 2007 concerning the Crime of Trafficking in Persons, Law Number 23 of 2002 concerning Protection Children, and Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, have attempted to fulfill the rights of victims, although a detailed explanation of legal protection efforts has been more based on the child protection law. Moreover, according to victimology, focusing on victims, criminal law policies addressing incidents of human trafficking or, more specifically, commercial sexual exploitation of children have prioritized victims’ interests.Benefits: This study was designed to serve as a reference for the government and parties concerned with Indonesia’s criminal law policy on sexual exploitation and its current legal policy from a victimology viewpoint. It is intended to result in law enforcement being more equitable and capable of combating sexual exploitation in the digital age.Novelty/Originality: Regarding responsibility for certain sorts of child sexual exploitation, the child protection legislation is more onerous than the trafficking statute in terms of penalties and threats. The two laws have endeavored to uphold victims’ rights in legal protection. However, the child protection statute includes a more extensive description of the legal protection measures. According to victimology, focusing on victims, criminal law policies addressing incidents of human trafficking or, more specifically, commercial sexual exploitation of children have emphasized victims’ interests
