Abstract

This paper intended to examine the position of the juristic conventions in ijtihad and its relevance to the Kompilasi Hukum Islam (KHI) book I on mar- riage. This research is motivated by the fact that al-Qur’an and Hadith are sources in establishing Islamic law, both of which are called mashdar, other le- gal propositions are Ijmâ ‘, Qiyâs, Istihsân, Mashlahah Mursalah,’ Urf, Syar’u man Qablanâ, Qawl al-Shahâbî, Istishâb and Sad al-Dzarî’ah. But in fact the rule of fiqh is also used as a theorem in establishing the law, whereas earlier scholars did not mention the rule of jurisprudence as one of the theorems in establishing Islamic law. So the question of this research is (1) what is the essence of the jurisprudence, (2) how the jurisprudence principle in ijtihad according to the scholars, and (3) how the relevance of the jurisprudence prin- ciple with the Compilation of Islamic Law (KHI) in book 1 on marriage. This research comes to conclusions, namely: (1) the essence of fiqh rule is the words of the ulama (qaul al-mujtahid). (2) The majority of scholars agree to make the jurisprudence as a complementary proposition in the establishment of a law. The juristic jurisprudence can only be used as a complementary argument. (3) There is a strong relevance between the jurisprudence principles that have been formulated by the previous scholars with the Compilation of Islamic Law es- pecially the book 1 on marriage, with the discovery of several articles that are relevant and relevant to the juristic principles

Abstract

This research is motivated by the application of e-Court at the Painan Religious Court. The aim is to modernize the administration of cases and trials to overcome obstacles in the process of judicial administration and to provide convenience for the public to litigate cases in court. However, the facts on the ground are that the people with litigation have not felt the ease of implementing the e-Court because there are so many obstacles that have occurred, so that the litigants find it difficult to proceed in an e-Court case. The formulation of the problem in this study, namely; How is the application of e-Court in the settlement of cases at the Painan Religious Court, what are the factors that cause problems in the application of e-Court in solving cases at the Painan Religious Court and what are the efforts made by the Painan Religious Court to overcome obstacles in the application of eCourt in case resolution. This research is a field research (field research) using qualitative descriptive research methods. The data sources of this research are primary data and secondary data. The technique of collecting data in this research is by making observations, interviews and documentation. This research was conducted at the Painan Religious Court with sources as the Head of the Painan Religious Court, the clerk of the Painan Religious Court, e-Court officers and the public with litigation at the Painan Religious Court. The results of the study concluded that; 1) The application of e-Court in case resolution has been enforced at the Painan Religious Court but has not been effective. 2) Factors causing obstacles to the application of e-Court in solving cases at the Painan Religious Court can be categorized as; internal factors, namely no direct face-to-face socialization to the community, inadequate facilities and infrastructure, unpreparedness of human resources, incomplete application menus and external factors in the form of technology failure, no internet access in most areas of South Coastal District, no email, do not have an android mobile phone and do not have a personal account.

Abstract

This research aims to analyze the decision to sue for divorce because the husband is impotent from the perspective of maslahat theory. The main condition for building a harmonious family is the existence of mutual trust and understanding between husband and wife. However, in living a married life, problems sometimes arise, such as the husband suffering from impotence, which can disrupt the relationship between husband and wife. This type of research is normative legal research, the data source is secondary data in the form of the decision of the Andoolo Religious Court, Southeast Sulawesi, Number 0225/Pdt.G/2019/PA.Adl regarding divorce due to husband suffering from impotence. This research found that the judge's consideration in deciding case Number 0225/Pdt.G/2019/PA.Adl was that the judge granted the divorce suit on the grounds that there had been continuous disputes and quarrels between husband and wife, the factor causing the disputes and quarrels was that the defendant was unable to produce children. The defendant suffered from impotence which the plaintiff only discovered after marrying the defendant. The judge's considerations were in accordance with the provisions of Article 19 letter (f) Government Regulation Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974 concerning Marriage jo. Article 116 letter (f) KHI, so that the Plaintiff's divorce claim is granted. The judge's considerations in granting the divorce suit are also in accordance with the benefit theory, including benefits for the wife, benefits for the husband and benefits for society.

Abstract

Young marriages have been massively practiced by young people in Indonesia. The rise of young marriage is a phenomenon in contemporary marital issues in Indonesia. The interest of young people to get married is a discussion that involves many new instruments to build a sakinah family in the household. This research will discuss young marriages conducted by men and women in the age range of 19-24 years when they get married. The data collection method uses a research questionnaire of 36 respondents (18 men and 18 women) collected randomly (random sampling). To test the respondents’ understanding in this study, the questionnaires were analyzed using a Guttman scale approach to interpret the extent of respondents’ understanding of the concept of a sakinah family. This study argues that the impetus for young marriage is due to the respondents’ religion and social arena. It can be explained that the consideration to marry at a young age is determined by these 2 instruments and is in line with the regulations set by the state. The 36 respondents were also measured for their level of understanding of the concept of a sakinah family. As a result, most of the 36 respondents in young marriages have fulfilled the personal competence, managerial competence, and competence to overcome discrimination as described in the concept of a sakinah family.

Abstract

Islamic Sharia stipulates that marriages must be announced to the public. One method of the announcement is through walīmat al-‘urs, translated differently in different Muslim communities. In the city of Solok, West Sumatra, one of the forms of walīmat al-‘urs is the baarak bako tradition (a wedding parade around the village). Baarak bako's implementation frequently clashes with obligatory prayer times in Islam, causing many participants to leave the prayer. This research aims to examine the background of the baarak bako tradition, the reasons for deciding the time to perform baarak bako, and the effects of baarak bako on prayer services. Using a qualitative method, this article revealed that the origin of baarak bako was the desire of the bako (father's female family) to show their presence by enlivening anak pisang's (the children of a brother) wedding. According to the custom, the best time to announce a marriage is in the afternoon because people are already at home and have finished their activities outside the home; the implementation of baarak bako resulted in some participants failing to perform the obligatory prayers. The neglected prayers are carried out in jama' (merging two prayers). Others, on the other hand, leave the prayer without jama'. The people of Solok City are very rigorous about following customary rules. When religious law and customary law rules conflict, some people prefer customary rules over religious rules and vice versa. These findings show the dynamic relationship between religion and customs in the Minangkabau ethnic group, West Sumatra. These two norms can coexist and adapt to each other in practice. Abstract

ABSTRAKTradisi melempar bere kuni (melempar nasi kuning) pada saat mempelai wanita menuju rumah mempelai pria disebut (manjampuikmalu). Dalam tradisi melempar bere kuni ini, nasi yang kita buang terbuang sia-sia dan terbuang percuma. Nasi adalah makanan pokok, sayang sekali kalau dibuang, apalagi piring kalau kita buang satu butir saja sudah berkah. Penelitian ini bertujuan untuk mengetahui bagaimana pandangan 'urf terhadap tradisi melempar bere kuni dalam pesta pernikahan. Metode yang digunakan adalah: Penelitian ini merupakan pendekatan penelitian kualitatif, termasuk penelitian lapangan. Dimana penelitian dilakukan dengan mewawancarai tokoh masyarakat di Desa Meunafa Kecamatan Salang Kabupaten Simeulue. Serta menganalisis data dan menggunakan metode deskriptif-analitis yaitu mendeskripsikan peristiwa dan fakta yang ada secara akurat dan sistematis serta memahaminya secara cermat dan cermat. Hasil penelitian menunjukkan bahwa dalam melaksanakan tradisi bere kuni diperlukan bahan yaitu nasi, kunyit, piring. Sebelum melempar nasi kuning, salam dan puisi dibacakan dan ditutup dengan doa seperti (Assalamualaikum Datok dan Panghulu, Sarato Wali Kamanakkan). Sedangkan pandangan bahwa 'urf dalam tradisi ini dilakukan menimbulkan kerugian, maka tradisi ini bertentangan dengan syariat Islam, karena termasuk dalam 'urf fasid (buruk), yaitu bertentangan dengan syariah atau menghalalkan apa yang haram dan membatalkan apa yang haram. wajib.Kata Kunci : Tradisi, Bere Kuni, 'Urf ABSTRAKTradisi melempar bere kuni (melempar beras kuning) saat pengantin perempuan menuju rumah pengantin laki-laki atau disebut (manjampuik malu). Beras adalah makanan pokok hal ini menjadi sia-sia jika melemparnya, jangankan satu piring bere kuni kita melempar satu biji saja itu terdat keberkahan. Penelitian ini bertujuan untuk mengetahui bagaimana pandangan 'urf terhadap tradisi pelemparan bere kuni dalam pernikahan tersebut. Adapun metode yang digunakan ialah Penelitian ini merupakan penelitian pendekatan kualitatif termasuk dalam jenis peneltian lapangan ( field study ). Dimana penelitian dilakukan dengan cara wawancara dengan tokoh masyarakat Desa Meunafa Kecamatan Salang Kabupaten Simeulue. Serta menganalisi data dan menggunakan metode deskriptif-analitik yaitu menggambarkan sesuatu yang pristiwa serta fakta apa yang ada secara tepat dan sistematis serta memahami secara cermat dan cermat. Hasil penelitian ini bahwa dalam pelaksanaan tradisi bere kuni ialah dibutuhkan bahan-bahan yaitu beras, kunyit, piring. Sebelum melempar beras kuning tersebut dibacakan salam dan syair-syair dan ditutup dengan do'a seperti (Assallamualaikum Datok dan Panghulu, Sarato Wali Kamanakkan). Sedangkan pandangan 'urf dalam tradisi tersebut dilaksanakan menimbulkan mudarat, maka tradisi ini bertentang dengan syariat Islam, karena termasuk dalam 'urf fasid (buruk) yaitu bertentangan danga syara atau menghalalkan yang haram dan membatalkan yang wajib.Kata Kunci: Tradisi, Bere Kuni, 'Urf

Abstract

This article is based on a critical review of the verdict of 916/Pdt.P/2022/PN.Sby, which recognizes the validity of interfaith marriages in Indonesia. This decision is different from the provisions of the marriage law in force in Indonesia. Indonesia has regulated that marriages can be carried out according to their respective religions. This article aims to critically analyze the verdict of 916/Pdt.P/2022/PN.Sby. This research is a normative juridical study with a case approach. The main data sources are obtained from court decisions and marriage laws. This article also uses several important articles and research resulting from empirical studies. Based on the data findings and analysis that have been carried out, this paper argues that: Firstly, interfaith marriages are prohibited in Islamic law because they contain more harm than good; this prohibition merely closes the opportunity for bad impacts to occur after the marriage; and second, the decision issued by the Surabaya District Court Judge was inappropriate because it conflicted with positive law and Islamic law. Legally, the judge may refuse to grant permission based on Article 2 paragraph (1) of the Law on Marriage and the Compilation of Islamic Law (KHI). In this decision, the judge has a different interpretation of the marriage regulations that apply in Indonesia.

Abstract

Islam has taught married couples to get along well (mu'asyarah bil al-ma'ruf) including sexual relations. However, there are several cases of sexual deviation, including cases of sodomy. In the Bogor religious court, there was a case of sodomy as a reason for divorce. This research aims to analyze Maqashid al-Shariah's review of sodomy behavior as a reason for divorce. This type of research is normative qualitative using the statue appoarch or statutory approach and library study data collection techniques. The results of this research show that the judge's decision in decision number 222/Pdt.G/2019/PA.Bgr which granted the petition for divorce was in accordance with the concept of maqashid al-syari'ah because it had saved the wife from harm due to deviant behavior committed by her husband and the judge. assess that domestic happiness will not be realized if the marital relationship is maintained. In addition, sodomy behavior is contrary to the concept of maqashid al-syari'ah because it threatens the existence of religion (Hifzh al-Din), soul (Hifzh an-Nafs), and offspring (Hifzh an-Nasl).

Abstract

Perkawinan Misyār adalah perkawinan dimana pihak perempuan merelakan beberapa haknya dan tidak tinggal bersama pasangannya. Para ulama mempunyai pandangan berbeda mengenai perkawinan Misyār. Sebagian ulama yang melarang dan sebagian lagi menghalalkannya, Yusuf Qardhawi adalah satu diantara yang menghalalkan. Tujuan artikel ini adalah menganalisis metode istinbath Yusuf Qardhawi dalam fatwanya tersebut dan relevansinya dengan hak asasi manusia (HAM). Jenis penelitian ini merupakan penelitian kepustakaan (library research). Data yang digunakan dalam tulisan ini yaitu merujuk kepada buku, jurnal, maupun hasil dari penelitian-penelitian terdahulu. hasil dari kajian ini adalah Yusuf Qardhawi membolehkan kawin Misyār dengan ketentuan syarat dan rukunnya telah terlaksana seperti perkawinan pada umumnya. Begitu juga ditinjau dari Hak Asasi Manusia di Indonesia juga memperbolehkan dengan tetap memerhatikan peraturan yang berlaku di Indonesia. Adapun metode istinbath hukum yang digunakan Yusuf Qardhawi dalam hal ini adalah merujuk pada Al-Qur`an dan Sunnah sebagai sumber hukum utama, qiyas, dan maslahah mursalah.

Abstract

The main question of this study is how divine constitution perspective on the reactualization of Allah's law. The background of the problem is the inequality between the law at the ideal and factual levels. Ideally, the degree of law is within the corridors and the degree of Allah's law, but the facts show that the nuances of the law are more oriented towards the product of man alone. The research position is very interesting with the variety of legal concepts. Questions are discussed with normative legal studies with qualitatively analyzed. The main result is the position of Allah’s law is the single best law and has the highest degree for a sure person. Allah’s law is a system of laws that contains the maslahat of the world and the hereafter. Allah’s law is fixed and some is changing whose content material is comprehensive and accordance with the needs of the times, places, circumstances, intentions and traditions. Allah commissioned the apostles, bringing down the books and the suhuf-suhuf as the basic benchmark and the main reference of the law. The last treatise was received by the Muhammad SAW with the guidance of the Qur'an and the sunnah.. Allah's law must be obeyed, and the disobedient are obeyed. Taqwa is the noblest level in the application of the law of Allah. Allah guarantees a successful life and goes to heaven for people who obey Allah's laws.
