Abstract

This study aimed to identify and recognize the correct method in determining shari prayer times according to Sharia Board of Wahdah Islamiyah. The issues in this study were; First, Islamic jurisprudence and the position of the sun being the main point of reference according to the Sharia in determining the initial time for prayer; Second, the law of employing astronomy in determining the initial time for prayer; Third, the correct method in determining shari prayer times according to Sharia Board of Wahdah Islamiyah. The type used was descriptive qualitative (non-statistical) research, which focused on the study of scripts and texts, employing a normative approach (shari) with field studies in the form of interviews with related figures. The results of the study show that; first, to recognize the Islamic jurisprudence and the position of the sun as the main point of reference in determining the initial time for prayer must be understood based on the propositions in the Koran and sunnah through the interpretation of the scholars who were well-known for their credibility. Second, in determining the prayer time schedule, the main method used is the method of rukyat with the help of astronomy as a means and device, but not as a primary point of reference. In addition, the process of preparing the prayer schedule is necessarily conducted through discussions by experts of Islamic jurisprudence and astronomy, both those affiliated with Wahdah Islamiyah and experts from outside Wahdah Islamiyah who are willing to provide recommendations and suggestions.

Abstract

Perpustakaan perguruan tinggi sebagai salah satu sumber ilmu pengetahuan yang memiliki peran besar bagi kebutuhan penggunanya khususnya mahasiswa untuk menyelesaikan studinya di suatu perguruan tinggi. Oleh karena itu, perpustakaan pada suatu perguruan tinggi mempunyai fungsi sebagai sumber pendidikan yang menyangkut fungsi edukasi, fungsi informasi, fungsi riset, fungsi, fungsi rekreasi, fungsi publikasi, artinya perpustakaan perguruan tinggi merupakan salah satu sarana informasi yang memiliki fungsi sebagai jembatan ilmu bagi seluruh komponen masyarakat perguruan tinggi terutama bagi mahasiswa yang sedang dalam proses menyelesaikan studinya. Sehingga perlu adanya pengoptimalan kegiatan pelayyanan perpustakaan pada UPT Perpustakaan Univeristas Muhammadiyah Mataram. Metode yang digunakan dalam penelitian ini dengan cara terjun lamgsung dalam melakukan pengoptimalan pelayanan perpustakaan di UPT Perpustakaan Universitas Muhammadiah Mataram. Hasil dari pengabdian ini adalah pengoptimalan kegiatan pelayanan dalam bidang teknis agar kemudahan dalam temu Kembali informasi dan pengoptimalan layanan informasi kepada sulurh mahasiswa Univeristas Muhammadiyah Mataram.

Abstract

The aim of this research is to examine how Indonesian positive law and Islamic law view and handle cases of marital rape. The research methodology used is descriptive qualitative with a normative, philosophical and comparative approach. Data was collected through literature review from relevant primary and secondary sources. The research results found are as follows: first, Indonesian positive law will provide a maximum sentence of 12 (twelve) years for perpetrators of marital rape, if the victim reports it to the authorities. Second, according to Islamic law, this problem is divided into 2 parts as follows: it is not permissible, this has been agreed upon by the ulama when a husband forces his wife to have intercourse through the anus, during menstruation, fasting (fardhu), pilgrimage, not having paid kafarat, due to illness. severe, old age which can endanger the wife and when the husband has not fulfilled the muajjala dowry. Yes, the ulama have also agreed that a husband may force his wife to have sex if her condition is capable of serving him. Third, this analysis shows that there is harmony in several aspects between Islamic law and Indonesian positive law in dealing with marital rape. However, in several cases, Indonesian positive law is considered inadequate in protecting the rights of husbands accused of coercion against their wives. Meanwhile, from the perspective of Islamic law, a husband has the right to force his wife as long as the wife's condition allows her to serve her husband. It is hoped that the implications of this research will become a reference for creating more comprehensive legal adjustments and harmonization to ensure justice and balanced protection for all parties involved.

Abstract

This study aims to examine and understand the perspectives of Islamic scholars, particularly those of the Hanafi and Shafi’i schools of thought, regarding the purification of impurities using substances other than water. The research focuses on three main aspects: first, the Hanafi school's perspective on purifying impurities without water; second, the Shafi’i school's perspective on the same issue; and third, a comparative analysis of the differences between these two schools on this matter. This study employs a qualitative descriptive approach using library research methods and adopts both normative and comparative approaches. The findings indicate that, first, according to the Hanafi school, purification is not strictly limited to water but can also be achieved through other means, as exemplified in the practice of istijmar (purification with stones). The Hanafi scholars argue that as long as the impurity’s color, odor, and taste are completely removed, its legal status as an impurity is also nullified. Second, the Shafi’i school mandates the use of water for purification, based on the belief that Allah has bestowed water as a means of purification. Imam Shafi’i asserts that water possesses a unique legal capacity to remove impurities. Third, the fundamental difference between these two schools lies in the necessity of water, where the Hanafi school permits alternative substances, while the Shafi’i school strictly requires water, citing prophetic traditions that exclusively mention purification with water.

Abstract

This research aims to analyze the method of analogy between wiping over socks and wiping over leather footwear (khuf) from the perspective of Islamic jurisprudence (fiqh of worship). This study falls into the category of qualitative research using the library research method, which involves collecting data from books and previous literature or gathering data from other writings and sources, whether from scientific articles, primary data sources, secondary data sources, and other literature related to the method of analogy. The findings of the research are as follows: First, the type of analogy used in determining the ruling of wiping over socks by analogy with the ruling of wiping over leather footwear is 'illah analogy, by equating the effective cause (illat) of the subsidiary ruling with the original ruling, where the determination of the effective cause is done using the istinbat method through munasabah (suitability). Second, the analogy method used to determine the permissibility of wiping over socks in ablution as a substitute for washing the feet, by analogy with the ruling of wiping over leather footwear, is valid because it fulfills the pillars of analogy and also meets the conditions of each pillar.
