Abstract

Grants, wills, endowments, and inheritance are legal instruments that are often used by someone to transfer their assets or wealth to others. But in practice, these four things become legal issues in society, especially for Muslim residents. Legal settlement of. This case was settled by the Religious Court. Based on case data that entered the Depok City Religious Court for the past five years until 2019, there were 24 grant cases approved, 20 wills, 8 endorsed cases, and 48 s allocation for inheritance. Some of the things behind this case and the most crucial is due to the ignorance of the community against the provisions of Indonesian law regarding grants, wills, endowments, and inheritance. On that basis, a Lecturer in the Faculty of Law of the University of Bhayangkara, Greater Jakarta, conducted socialization and legal counseling on grants, wills, endowments, and inheritance on Compilation of Islamic Law for the people in the Cinere District area. The will, endowments, and inheritance in the Compilation of Islamic Law is still very minimal. After the socialization and discussion of the law, the community's knowledge and awareness will require the implementation and legalization of grants, wills, endowments, and inheritance to improve legal problems up to the increasingly increasing religious court. The output resulting from this activity is planned to be made a waqf pocketbook as an additional reference about the legal grants, wills, endowments, and inheritance according to the Compilation of Islamic Law. Besides, the results of the activities are published in the form of implementation reports and published in scientific journals to provide comprehensive and academic-wide benefits and practical levels.

Abstract

Dilatarbelakangi dengan suatu keprihatinan tentang teori-teori, pendapat-pendapat, dan konsepsi pemikiran hukum di Indonesia yang lahir dari para pakar dan ahli hukum. Kendatipun Indonesia telah Merdeka 76 Tahun, masih saja terbelenggu dan mengagungkan teori dan konsep pemikiran yang bersumber dari para ilmuawan Barat. Padahal ilmu hukum berbeda dengan ilmu sosial lainnya, apalagi dengan ilmu eksakta. Hukum itu bukanlah ilmu yang bersifat universal, tapi dia punya batas yuridiksi dan teritorial, dan hukum itu harus digali dan diambil dari nilai-nilai yang hidup dari masyarakatnya sendiri. Di Indonesia adalah hukum adat yang lahir dan tumbuh dan ditaati oleh masyarakat itu sendiri. Dengan melakukan penelitian kepustakaan dan mengamati fenomena yang ada di dunia akademis maupun dikalangan praktisi hukum kiranya saatnya kita mencari teori hukum yang bercirikan Keindonesiaan berdasarkan aliran Sociological Jurisprudence, halmana hukum sebagai pencerminan dan kongkretisasi nilai-nilai yang hidup dalam massyarakat (living law), selanjutnya hukum positif hanya akan efketif apabila selaras dengan hukum ynag hidup dalam masyarakat yang merupan cerminan nilai-nilai yang hidup di dalamnya. Dalam penulisan ini penlis mengambil contoh yang diambil dari falsafah Adat Jawa, Bali dan Minangkabau.

Abstract

The Job Creation Law which has been approved and ratified becomes Law Number 11 of 2020, cannot be separated from the taxation cluster. As it is known that taxes have a budgetary function as state revenue and regulating function as a reflection of the country's economic policy. This study aims to examine the priority of the regularend function of taxes in the taxation cluster in Law Number 11 of 2020 concerning Job Creation. The results of the study indicate that the regularend function of taxes accommodated in the Job Creation Law and Perppu Number  1 year 2020 Jo. Law Number 2 of 2020 as well as Law Number 7 of 2021 concerning Tax Harmonization can work in several ways, namely: in the context of funding investment in Indonesia, tax incentives on dividends from within the country are intended to reduce the tax burden that must be borne by taxpayers, differences in interpretation in determining the status of tax subjects affect the country or jurisdiction that has the right to impose, relaxation of provisions for crediting Input Tax, which is deemed unfair for business actors, Arrangements on the amount of administrative sanctions of interest and interest compensation which are applied by taking into account market interest rates; and Taxation of digital transactions carried out by foreign sellers or marketplaces.

Abstract

It is undeniable that the emergence of the Covid-19 pandemic is unavoidable and has an impact on all lines of life, including the economic sector, as a result, it not only has an impact on the decline in the level of the economy but also has an impact on termination of employment. This article aims to examine the policies taken by the State, in this case the Government and what the government should do in order to protect the rights of Indonesian workers duringithe Covid-19ipandemic. The researchimethod used isinormative juridical by reviewing the applicable laws and regulations. The results of the study indicate that in terms of protection of workers, steps or policies taken by the government are to issue several regulations as firm steps regarding legal protection efforts for workers and their implementation for workers. In addition to regulations and technical rules that are regulated for workersiduring the Covid-19ipandemic, the Government has also issued several policiesito cope withtthe impact of Covid-19, namely in the form of social policies that are expected to be felt directly for the workforce.

Abstract

Antidumping provisions have been listed since the agreement of GATT in 1947, and provisions regarding anti-dumping agencies are regulated in Article VI GATT. The provision also recommends that each member state implements the provisions of GATT in their respective national legal systems. As a form of implementation of these provisions in the national legal system, Indonesia has issued regulations governing Antidumping. However, there is a dilemma in terms of dumping practices and the implementation of anti-dumping laws in Indonesia, because in this case it must be seen from two sides of interest, not only in terms of the interests of Entrepreneurs as domestic producers but also the interests of the community as consumers. Because both are elements of the nation that need to receive equal and balanced treatment by the state.

Abstract

The protection of the resilience of the domestic industry today is haunted by the practice of dumping by exporting countries of goods and services. Dumping is a competition practice between countries where the selling price of imported goods is below the normal price of good/services in the country. The practice of dumping is carried out by the exporting country by determining the price below or lower than the nominal value or the actual unit cost or can also be said to sell at a lower price in the importing country than in the producer country itself This is certainly detrimental to local businessmen and laborers in the country so that regulations from importing recipient countries are needed for the resilience of the domestic industry in order to sustain the national economy. Some exporting countries often practice dumping to increase the economic benefits of the country itself but can harm the importing country. To avoid this dumping practice, Indonesia’s anti-dumping laws has an important role in the concept of domestic industry resilience.
