Abstract

In principle, laws and regulations have regulated the working relationship between doctors and hospitals in the implementation of health services, but in the field it is often found that there are many models of legal relations between doctors in hospitals which, when examined more deeply, are found to be incompatible with existing legislation. In addition, the doctor's relationship with the hospital which is not stated in a clear agreement and legal relationship, often creates disagreements between hospital management and doctors, especially when there are demands for compensation or other responsibilities demanded by third parties for the services of doctors at home. sick. This study raises issues that are also the purpose of writing, namely the legal basis for the occurrence of work agreements and the implementation of legal relationships that occur between doctors and hospitals as well as patterns of effective legal responsibility for doctors in hospitals. This research includes empirical legal research that is descriptive analytical using primary and secondary data types. The analysis is carried out by connecting relevant theories, namely applicable laws and regulations, hospital legal theories and positive law enforcement practices related to the problems in the research. From the results of the study, it was concluded that the working relationship between doctors and hospitals was bound in a work agreement which contained the legal responsibilities of each party.

Abstract

Deteni adalah penghuni rumah detensi imigrasi (Rudenim) yang sedang menjalani proses pendetensian karena melanggar Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Pelanggaran keimigrasian seperti berada di wilayah Indonesia tanpa memiliki dokumen perjalanan yang sah, ijin tinggal yang sah, atau ijin tinggal mereka yang sudah tidak berlaku lagi. Penelitian ini bertujuan untuk melihat implementasi hak atas pelayanan kesehatan bagi para Deteni di Rumah Detensi Imigrasi Semarang. Metode pendekatan yang digunakan dalam penelitian adalah metode kualitatif dengan spesifikasi penelitian deskriptif analitis. Data yang digunakan adalah data primer dan sekunder. Data primer dikumpulkan dengan melakukan wawancara dengan petugas di Rudenim Semarang. Data sekunder dikumpulkan dengan melakukan studi kepustakaan atau studi literatur dan studi dokumen peraturan perundang- undangan, Hasil penelitian menunjukkan bahwa hak atas kesehatan denteni pada masa pandemic COVID-19 dibatasi geraknya untuk menghindari kontak dengan banyak orang, mengingat beberapa petugas Rudenim justru tertular virus ini dari luar. Rudenim Semarang sudah meningkatkan layanan kesehatan melalui berbagai inovasi, yaitu: Inovasi   Layanan   Rudi   Marang   Go   Green, Inovasi Layanan ACTivity Tenar, Inovasi Layanan Go Doctor,Inovasi Layanan Laras Tenar, Inovasi Layanan Joko Tenar dan Inovasi Inovasi Layangan Den Bagus. Inovasi ini mampu mewujudkan layanan kesehatan yang baik untuk para deteni.

Abstract

Detainees are those who are currently undergoing a detention process for violating Law Number 6 of 2011 concerning Immigration. They are in Indonesian territory without valid travel documents or residence permits, or their residence permits are no longer valid. This research aims to determine the fulfillment of communication and information rights services (for Detainee) during the pandemic and post-pandemic COVID-19 and the obstacles in implementing these services. The method used in the research is a qualitative method approach with an analytical descriptive. The data used are primary and secondary. Primary data was collected by conducting interviews with Rudenim Semarang officers. Secondary data was collected by conducting literature studies. The research results show that the right to information and communication for Detainees is provided both during the COVID-19 pandemic and post-COVID-19 Pandemic, which includes the right to information regarding the continuation of cases faced by Detainees given by forwarding information to Detainees regarding the extent to which Rudenim communicated with the Detainee's country of origin to return the Detainee to his country. The right to communication is exercised by providing a teleconference room that Detainees can use to contact colleagues or relatives via the Internet. The obstacle is the complaint from the Detainee about the time limitation during video calls and the extended response from the Detainee's country/government of origin.
