Jurnal Nukhbatul 'Ulum merupakan jurnal akademik yang diterbitkan dua kali dalam setahun (Juni dan Desember) yang diterbitkan oleh Pusat Penelitian dan Pengabdian Masyarakat (P3M) Sekolah Tinggi Ilmu Islam dan Bahasa Arab (STIBA) Makassar. Jurnal Nukhbatul 'Ulum menerima tulisan ilmiah hasil pemikiran konseptual dan hasil penelitian yang belum pernah dipublikasikan, terutama yang berhubungan dengan bidang Kajian Islami (Dirasah Islamiyah). Penyunting (editor) berhak melakukan revisi untuk keragaman format, istilah, dan catatan kaki tanpa mengurangi dan mengubah isi dan maksud tulisan. Tulisan diterbitkan dalam bahasa Indonesia, Ingrris, dan Arab.

Abstract

As the divine revelation, al-Qur’ān is not a tught product and Mohammad’s creation. So that, those who say that al-Qur’ān is a thought product and Mohammad’s creation, are not right and irresponsibility. If we look at historically and the revelation process of al-Qur’ān, it was not revealed by accident, but it was revealed periodically, little by litte and verse by verse. The use of its revealation depends on the place and social matters. From this aspect, some of the Qur’anic verses are the answers for the social matters occures among the human beings. The knowledge of al-Qur’ān includes the meaning, characteristic, names, descent time of al-Qur’ān, Makkiyyah and Madaniyyah verses, Asbāb al-Nuzūl, and so on.

Abstract

Dissimalarity opinion among the ulema, specially fuqaha, is a treasure in Islamic Study of Laws. The ability of Islamic laws in responds the challenges on every period is related to the existence of the basic ikhtilaf among the ulema. So that, discussions to bring back the dissimaliriy opinions among moslem on the right path must be followed by serious discussion on the ikhtilaf principles as practiced by the early generation of Islamic ummah. Abstract

The Fatwa Commision and the National Sharia Council are two institutions under the central of Indonesian Ulema Council (MUI). Its primary function is to issue fatwa (a binding ruling in religious matters) related with the fnance activities or product and sharia fnance service. The mechanism in making fatwa decision in both institutions under the Indonesian Ulame Council have a similarity in the collective Ijtihād (jama’i) by using the Ijtihād methodology such as bayani, ta’lili (qiyasi, istihsani, ilhaqi) and istihlasi. This method is used specially for contemporery matters or the matters are not discussed yet in detail among the mazhab ulame (school of thought concerning muslim law).Keyword : Ijtihād, Fatwa

Abstract

Al-Qur’ān explains about justice principles of life comprehensively. The justice criterion is all originating in God set, the principles and application form, that Allah swt is very fair and cannot be cruel to his servant creation. The justice application in Islam is not the relative problems because the escort is very clear. It can be found application form or rule forms also so that justice upholders just do and follow it. Islam has been decided the justice of men and women differences in worship and social interaction concepts, thus the differences between devoting and infidel people have been decided by justice realization on themselves, so that the intervention of human’s mind to the decision such as justice rule is Limited. The justice is to give someone according to its right. It is also means objective attitude to view and behave something, or to act proportionately. The justice can also mean al-hikmah, that is to put something in a certain place and not pass over the limitation. The justice also means someone’s characteristic keeping himself to do sin as its belief demand. The justice in al-Qur’ān has been developer by some principles, such as equality, honesty, and sincerity. Keyword : Keadilan, Al-Qur’ān.

Abstract

Al-Risālah is a frst book concerns in ushul fkh. This book is written by Imam al-Syāf’ī rh. and contains explainations on rules of islamic argumentation (istidlāl) from al-Qur’ān. Al-Risālah book has gotten the great credit of moslem schoolars up to nowdays, as it is not only a frst book in ushul fkh but it also contains various knowledges in many felds. Imam Syāf’ī ‘s view on ijtihād and its methodology are explained in this book. Imam Syāf’ī’s methods explained in this book are : Making all cases reference to al-Qur’ān, Ḥad Ḥ īṡ, Ijmā’, and the ṣah Ḥ ābah’s sayings and qiyās, determining a law by considering a substantial argumet, determining a law by considering the illat and reducing the arguments to the visible matters, and the truth is reverted to Allah.
