Abstract

The concept of law is the idea of the law which is used as the basis of a legal state to mobilize its laws. The concept of law is important because almost all countries use the law as a basis for mobilizing, bring order and prosperity of the country. There are two legal concepts, namely the concept of legal positivism and materialism. Both the concept of this law provides a very significant effect in most countries in the world. The concept of legal positivism emphasizes that the law should be freed from all the elements so that the law is an autonomous authority. The concept of law of materialism agitates that the law must be present in the upper structure and the basic structure. The law is present in the upper structure because the law emerges from ideology. The law is present in the basic structure because the law functions to regulate and simplify the production processes.

Abstract

In this discussion, the author tries to illustrate the complexity of the problems or weakrtesses Indonesian involvement in trade liberalization, both in terms of aspects of political, legal and cultural aspects related to the position of Indonesia as a developing country. Based on all the above explanation, then that should be a basic question in this paper, namely: What factors the complexity of the weakrtess of Indonesia in trade liberalization. There are some problems or weakrtesses is the basis why it failed to achieve the interests and economic benefits expected Indonesian government, namely (1) The weakrtess of economic diplomacy. Negotiators consisting of diplomats and officials of the technical departments have weaknesses. Diplomats may dominate in terms of language but not in terms of substance, while officials from the technical department to master the substance but did not master the language. This weakness is compounded because of the very few institutions both have members who master the skills to design a legal sentence. (2) Lack of awareness and attitude of the national industry to utilize the legal instruments of trade remedies. (3) The weakness of the latter which will be discussed in this paper is related to the bargaining position of developing countries when dealing with the industrialized countries.

Abstract

This article focuses on the study of Flight Information Region (FIR) management in the Riau and Natuna Islands, which since 1946 is still controlled by Singapore. Although various attempts to take over the control have been carried out by the Indonesian government, it is yet  to produce any meaningful results. The limitation of the problem in this study is first, the implications that arise from the management of FIR by Singapore on the Riau Islands and Natuna airspace. Second, the efforts that have been made by the Indonesian government to take over the management of FIR by Singapore over the Riau Islands and Natuna airspace. This research uses a normative legal research by analysing the legal issues through international treaties, legal regulations and other literature related to FIR management. The results of the study concluded first, the management of FIR by Singapore over the Riau Islands and Natuna influenced the enforcement of Indonesia's airspace sovereignty and national defence. Secondly, Indonesia's efforts and readiness to take over aviation navigation services include the formation of a special team from several ministries and other relevant institutions to prepare technical and operational steps as well as diplomatic steps in the framework of restructuring the FIR.

Abstract

AbstractThis study examines the comparison of legal norms on trade safeguards measures between Indonesia and the United States. The purpose of this study is to analyze the comparison of legal norms on trade safeguards measures between Indonesia and the United States. This study uses a type of normative legal research (legal reseach) with the approach to the legislation and comparative approach. The results of this study explain that there are two components that provide a clear picture of the differences in Safeguards provisions in Indonesia and those in America, namely: (1) Form and Content of Safeguards legislation. (2). Head of State's involvement in implementing Safeguards. IntisariPenelitian ini mengkaji tentang perbandingan norma hukum Tindakan Pengamanan Perdagangan (Safeguards) antara Indonesia dan Amerika Serikat. Tujuan penelitian ini untuk menganalisa perbandingan norma hukum safeguards antara Indonesia dan Amerika Serikat. Penelitian ini menggunakan jenis penelitian hukum normatif (legal research) dengan pendekatan pendekatan perundang-undangan serta pendekatan komparatif. Hasil penelitian ini menejelaskan bahwa bahwa terdapat dua komponen yang memberikan gambaran jelas tentang perbedaan ketentuan safeguards yang terdapat di Indonesia dengan ketentuan yang terdapat di Amerika, yaitu: (1) Bentuk dan Isi perundang-undangan safeguards. (2). Keterlibatan Kepala Negera dalam safeguards.

Abstract

Penelitian ini mengkaji tentang praktik ijab-kabul (akad) dalam transaksi jual beli oleh Masyarakat Adat Banjar ditinjau dari prespektif Hukum Ekonomi Islam. Penelitian ini bertujuan untuk menganalisa praktik tradisi pengucapan akad pada transaksi jual beli oleh Masyarakat Adat Banjar ditinjau dari prespektif Hukum Ekonomi Islam. Penelitian ini merupakan jenis penelitian Hukum Normatif. Hasil penelitian menjelaskan bahwa praktik tradisi pengucapan akad pada transaksi jual beli oleh Masyarakat adat jika ditinjau dari prespektif hukum ekonomi Islam merupakan sesuatu praktik yang tidak bertentangan dengan syariat Islam, meskipun terdapat perbedaan pandangan ulama dan imam Mazahab. Hal tersebut karena jika dilihat dari aspek sejarah lahirnya tradisi masyarakat Banjar yang mengucapkan akad secara jelas dalam praktik transaksi jual beli berlandaskan pada sebuah kitab Fiqh karya ulama Banjar terkemuka, yaitu Syekh Muhammad Arsyad al-Banjari dalam kitabnya Sabilal Muhtadin yang mengajarkan bahwa setiap praktik dalam transaksi jual beli haruslah berdasarkan pada syariat Islam. Formulasi ijab kabul dalam suatu transaksi atau kontrak dalam jual beli tidak harus selalu diucapkan dengan jelas secara lisan, tapi juga dapat laksanakan melalui ulisan atau isyarat bagi mereka yang tidak mampu berbicara atau menulis bahkan dapat dilaksanakan dengan perbuatan yang menunjukkan kerelaan kedua belah pihak untuk. Selain itu ijab kabul juga dapat dilaksanakan menurut kebiasaan (Urf) sepanjang tidak bertentangan dengan syara.

Abstract

Periodisasi dan masa jabatan suatu kepala pemerintahan dalam hal ini Kepala Desa semestinya ditentukan berdasarkan kajian – kajian ilmiah dan akademis guna merumuskan lamanya suatu jabatan serta periodisasinya didalam perundang-undangan dan selain itu perlu diketahui pengaruh penentuan masa jabatan Kepala Desa terhadap kinerja suatu Pemerintahan Desa. Melalui gabungan kedua jenis penelitian hukum yakni penelitian hukum normatif dan penelitian hukum empiris, menggunakan data sekunder yang diperoleh melalui studi kepustakaan dan data primer yaitu fakta-fakta empiris dari pengamatan langsung dan hasil wawancara dipergunakan mengingat bahwa obyek penelitian adalah benturan teori hukum dengan norma hukum peraturan perundang-undangan dan sekaligus pengaruh penerapannya. Dengan mengacu pada teori pembatasan kekuasaan serta berdasarkan prinsip konstitusional bahwa kedudukan Undang – Undang Dasar Negara Republik Indonesia Tahun 1945 merupakan supreme law hukum tertinggi di Indonesia, serta prinsip hirarki norma hukum dapat dirumuskan mengenai periodisasi dan masa jabatan kepala pemerintahan, oleh karena itu periodisasi dan masa jabatan dalam ruang lingkup pemerintahan desa dalam hal ini jabatan Kepala Desa didalam Pasal 39 Undang-Undang Nomor 6 Tahun 2014 tentang Desa harus diselaraskan dan diharmonisasikan guna kepatuhan hierarki norma hukum terhadap Pasal 7 Undang – Undang Dasar Negara Republik Indonesia Tahun 1945. Selanjutnya pengaruh periodisasi dan masa jabatan terhadap kinerja Kepala Desa Bendo dan Kepala Desa Semen di pemerintahan desa dapat ditinjau menggunakan indikator pembangunan desa salah satunya dapat dilihat dari faktor kapasitas aparatur dan jangkauan pelayanan publik.

Abstract

This study examines the Implementation of Professional Zakat for State Civil Servants Based on Law Number 23 of 2011 concerning Management of Zakat at the BAZNAS Office of Tulungagung Regency. The aims of this study are 1) to analyze the implementation of professional zakat by Tulungagung Regency BAZNAS towards the State Civil Apparatus based on Law Number 23 of 2011 concerning the management of zakat, 2) To analyze the inhibiting factors in the management of professional zakat for the State Civil Apparatus at BAZNAS Tulungagung Regency.The research method used in this research is empirical juridical research with a qualitative descriptive analytical approach. Data collection techniques were carried out by interviews, observation and documentation. The analysis technique used in this study is the syllogism method and interpretation using deductive thinking patterns. The research results show 1) the implementation of professional zakat by BAZNAS of Tulungagung Regency towards the State Civil Apparatus based on Law Number 23 of 2011 concerning the management of zakat is carried out by deducting employee salaries which are carried out every month by the treasurer.The employee salary deduction is only applied by employees of the State Civil Apparatus who earn above 3 million rupiah and are deducted from their gross monthly salary. Salary deducted by 2.5%, professional zakat from salary deductions entirely paid to BAZNAS Tulungagung Regency distributes it to 8 ashnaf. 2) The inhibiting factors in the management of professional zakat for the State Civil Apparatus at BAZNAS Tulungagung Regency include 1) The need for increased support from the government in the form of policies, 2) Lack of awareness of zakat through institutions, public awareness for zakat currently continues to increase, this is occursdue to a lack of trust in zakat institutions. 3) The need for increased funds for socialization.

Abstract

This research examines the legal protections available to Indonesian citizens who are victims of human trafficking in Myanmar, focusing on the alignment of Indonesia's domestic laws with international standards. Specifically, it scrutinizes the harmonization of legal protection for witnesses and victims of human trafficking under Act Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons with the protocols established by United Nations Convention against Transnational Organized Crime, particularly its supplement, the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women, and Children. The study adopts a legal research methodology using a comparative law approach to analyze domestic and international legal frameworks. It investigates how well Act Number 21 of 2007 integrates the provisions of the UNTOC, noting areas of strong alignment and aspects that require further enhancement. The research finds that while Act Number 21 of 2007 is largely in sync with the UNTOC, it falls short in incorporating specific provisions for the special needs of trafficking victims, such as psychological support, housing, and rehabilitation services. The findings highlight significant steps taken by the Indonesian government to protect its citizens from human trafficking but also underscore the need for a more comprehensive approach that includes provisions for the unique needs of victims. The study advocates for amendments to the national legislation to fill these gaps and suggests a more robust framework for international cooperation to combat human trafficking in the region effectively.

Abstract

Isntitusi perkawinan merupakan sraan aynag syah bagi manusia untuk memenuhi fitrah nya baikitu terkait dengan pemenuhan kebutuhan biologis menrussakan keturunan maupun mmperoleh statusdalam pranata sosial hal ini semakin meneguhkan bahwa manusia sebagi makhluq paling mulia danberadap ,oleh karena itu dalam hukum islam terdapat bergabagai ketentuan perkawinan sebagai refleksidan tujuanya.Pernikahan wanita hamil karena zina yang terjadi secara repetitif menunjukan persoalan hukumdan persoalan sosial tersendiri yang dsapat mengan cam tujuan dan keluhuran pernikahan ,pesroalan inimerefleksikan gejala pergeseran nilai yang kontradiktif terhadap pembinaan hukum,pada ratikel ini penulisakan membahas persepsi m asyrakat mojoroto terhadap persoalan wanita hamil karena zina menurutkompilasi hukum islam serta upaya penanggulangan kasus,penusil disini menggunakan methode deskriptifkialitatif,penulisan artikel ini bertujuan untuk mengkaji secara konkrit terhadap pandangan hukum,dampakdan upaya penanggulangan kasus perkawinan wanita hamil karena zina dikecamatn mojoroto.
