Abstract

The enforcement of court decisions regarding custody (hadanah) and alimony (nafkah) for children and ex-wives post-divorce is frequently inadequate, with many husbands failing to comply. Although decisions based on legal provisions (rechtsspraack naar wetboeken) should be effective according to the principle of the Effectiveness of Law, numerous children and women in Indonesia suffer from the ineffective execution of judges' rulings in alimony and custody cases. Ensuring the rights of children and women after divorce can be improved through proper implementation of laws in a preventive, curative, and supportive manner. In Indonesia, the E-Mosi Caper application has been developed in Bengkulu Province, in collaboration with the PTA Bengkulu and local government, to enhance the effectiveness of laws concerning custody and alimony. This application could serve as a model for other regions. In contrast, Malaysia has established a Family Support Division (BSK) tasked with overseeing maintenance payments to support children and ex-wives after divorce. This study employs a comparative legal method to examine the frameworks for ensuring the rights of children and women post-divorce in both countries. The findings aim to highlight the effectiveness of the existing systems and after recommendations for improving law enforcement and protecting post-divorce rights.

Abstract

This study investigates the vital role of zakat in Malaysia's economic development within the context of its legal and public policy frameworks. Zakat, an obligatory form of almsgiving in Islam, serves as a critical instrument for wealth redistribution and social welfare. The background of this study highlights zakat's potential to alleviate poverty, promote social justice, and drive economic empowerment in Muslim-majority countries. The primary objective is to examine how Malaysia's legal provisions, regulatory mechanisms, and public policy initiatives enhance the effectiveness of zakat in achieving these socio-economic goals. The methodology involves a comprehensive review of statutory instruments, state enactments, and administrative practices governing zakat, supported by case study analysis and statistical data on its economic impact. This mixed-methods approach enables a nuanced understanding of the intersection between zakat governance, legal structures, and economic outcomes. The study’s findings reveal that Malaysia's structured legal framework and progressive public policies have significantly improved zakat management, leading to effective poverty alleviation, economic empowerment, community development, and crisis response. Importantly, this research contributes to the fields of law and public policy by illustrating how legal reforms, institutional strengthening, and policy integration can maximize the socio-economic benefits of religious fiscal instruments like zakat, thereby fostering a more equitable and resilient national economy.Penelitian ini mengkaji peranan penting zakat dalam pembangunan ekonomi Malaysia dalam konteks kerangka hukum dan kebijakan publik. Zakat, sebagai kewajiban dalam Islam, berfungsi sebagai instrumen utama dalam redistribusi kekayaan dan kesejahteraan sosial. Latar belakang penelitian ini menyoroti potensi zakat dalam mengentaskan kemiskinan, mempromosikan keadilan sosial, dan mendorong pemberdayaan ekonomi di negara-negara dengan mayoritas Muslim. Tujuan utama penelitian ini adalah untuk menganalisis bagaimana ketentuan hukum, mekanisme regulasi, dan inisiatif kebijakan publik di Malaysia memperkuat efektivitas zakat dalam mencapai tujuan sosial ekonomi tersebut. Metodologi yang digunakan melibatkan tinjauan komprehensif terhadap instrumen hukum, enakmen negara bagian, serta praktik administratif yang mengatur zakat, yang didukung oleh analisis studi kasus dan data statistik terkait dampak ekonomi zakat. Pendekatan metode campuran ini memungkinkan pemahaman yang mendalam mengenai keterkaitan antara tata kelola zakat, struktur hukum, dan hasil-hasil ekonomi. Hasil penelitian menunjukkan bahwa kerangka hukum yang terstruktur dan kebijakan publik yang progresif di Malaysia secara signifikan meningkatkan pengelolaan zakat, sehingga efektif dalam pengentasan kemiskinan, pemberdayaan ekonomi, pembangunan komunitas, serta penanganan krisis. Secara khusus, penelitian ini memberikan kontribusi pada bidang hukum dan kebijakan publik dengan menunjukkan bagaimana reformasi hukum, penguatan kelembagaan, dan integrasi kebijakan dapat memaksimalkan manfaat sosial ekonomi dari instrumen fiskal keagamaan seperti zakat, guna mewujudkan perekonomian nasional yang lebih adil dan tangguh.

Abstract

While polygamous marriages in Southeast Asia have been studied through various lenses, significant research gaps persist in understanding these practices within the Malaysian and Indonesian contexts. This study comparatively investigates the interpretation of ‘ḍarar shar’ī’, a requirement to contract a polygamous marriage in Malaysia and Indonesia. The study utilized doctrinal study on relevant legislation and case law accompanied by semi-structured interviews. The findings from the doctrinal study are supported by information acquired through semi-structured interviews with Sharia court judges in Malaysia that were selected using a purposive approach. The secondary data were assembled using the library research approach and later analyzed using the thematic and content analysis approach. This study discovers that Malaysia and Indonesia have minor differences in deliberating the concept of harm attached to polygamy application. This is attributed to the different conditions for allowing polygamy in both jurisdictions. The study also discovers that, unlike the other conditions of polygamy, the Syariah court has no specific guidelines in deliberating on the possibility of ḍarar shar’ī before it can grant permission to allow for polygamous marriage. Abstrak:Meskipun perkawinan poligami di Asia Tenggara telah dikaji melalui berbagai sudut pandang, masih terdapat kesenjangan penelitian yang signifikan dalam memahami praktik-praktik ini dalam konteks Malaysia dan Indonesia. Artikel ini mengkaji secara komparatif tentang penafsiran ‘ḍarar shar’ī’ sebagai salah satu syarat untuk memasuki pernikahan poligami di Malaysia dan Indonesia dengan tujuan untuk membuat pedoman tentang penafsiran hukum atas konsep ‘ḍarar shar’ī’. Penelitian ini mengadopsi metode kualitatif yang memanfaatkan studi doktrinal dan wawancara semi terstruktur. Temuan dari studi doktrinal didukung oleh informasi yang diperoleh melalui wawancara semi-terstruktur dengan hakim pengadilan Syariah di Malaysia yang dipilih dengan menggunakan pendekatan purposif. Data sekunder dikumpulkan dengan menggunakan pendekatan penelitian kepustakaan dan kemudian dianalisis dengan menggunakan pendekatan analisis tematik dan isi. Studi ini menemukan bahwa Malaysia dan Indonesia memiliki sedikit perbedaan dalam mempertimbangkan konsep kerugian yang melekat pada penerapan poligami. Hal ini disebabkan oleh kondisi yang berbeda untuk membolehkan poligami di kedua yurisdiksi. Studi ini juga menemukan bahwa tidak seperti kondisi poligami lainnya, pengadilan syariah gagal dalam mempertimbangkan kemungkinan ‘ḍarar shar’ī’ sebelum dapat memberikan izin untuk mengizinkan pernikahan poligami.

Abstract

A new phenomenon happening in Singapore among Muslims is currently on interfaith marriage. This phenomenon has become a trend among Muslims as there is a written law in Singapore, expressly the Women's Charter, that allows marriage between Muslims and non-Muslims, which is not in line with Islamic law. Similarly, no provision in the Administration of Muslim Law Act 1966 (AMLA) specifically prohibits Muslims in Singapore from registering their marriage under Civil law with a non- Muslim spouse. This article is written to look into the factors contributing to the increase in this type of marriage, and highlight the role of the Muslim law in Singapore in relation to such marriages. The research adopts a qualitative method integrating the library and field research. The methods used are descriptive and thematic interview analysis. As a result, the writers conclude that the leading cause of the increase in interfaith marriage is the absence of Muslim law prohibiting interfaith marriage and the minimal adverse impact of such marriage. Realistically, there are contextual challenges to establish and execute a new Syariah law that prohibits the interfaith marriage among Muslims in Singapore. Therefore, this study discusses the factors contributing to the increase in Civil marriage among Muslims in Singapore and the reasons behind the absence of Muslim law prohibiting the marriage. Keywords: Singapore Syariah Law, Singapore Muslim Law, Interfaith Marriage, Interreligious Marriage.

Abstract

This study investigates the practice of harta sepencarian (joint matrimonial property) within the Malay community in Malaysia, focusing on the interaction between Islamic law, local customs, particularly Adat Perpatih and Adat Temenggung, and cultural values. Using a normative legal approach supported by content analysis, the research examines whether current legal frameworks and social practices align with the principles of justice, gender equity, and the objectives of Islamic law (maqāṣid al-shari’ah), especially the protection of wealth (ḥifẓ al-māl), well-being (ḥifẓ al-nafs), and dignity and lineage (ḥifẓ al-ʿirḍ wa al-nasab). The findings reveal that harta sepencarian represents a hybrid legal model, integrating statutory Islamic family law with indigenous Malay traditions. The increasing acknowledgement of women’s domestic and economic roles significantly influences decisions regarding asset division. While there appears to be a general harmony between religious and customary principles, the study highlights key challenges, such as the lack of legal clarity regarding indirect contributions and inconsistencies in dispute resolution processes. To bridge these gaps, the research advocates for the formalisation of equitable legal standards that incorporate both Islamic jurisprudence and customary wisdom. By doing so, harta sepencarian can evolve into a more just and culturally resonant framework for managing marital property within the Malay Muslim community.
