Abstract

Orientalists, in their viewpoint, place the eastern-Islamic world as an opponent that must be weakened. One of their efforts is done by portraying the face of Islam and Islamic law according to their own constructed point of view. This descriptive writing describes the orientalist view of Islam and Islamic law based on authoritative references in the theme of this study. The data used comes from library data (library research). The technique of collecting data is done in documentation, while the analysis is done with content analysis techniques. The result of the study in this paper conclude three things. First, Islam is not a religion that originates from God according to the orientalist view, but it is considered a form of religious tradition that continues the Christian and Jewish religious traditions. Second, the orientalists are of the view that Islamic law is a product of thought that was systematically compiled in detail in the era of the Umayyad dynasty and the beginning of the Abbasid era. Third, the emergence of these two orientalist views is due to their limited reading toward Islam as to complement and perfect the previous religious teachings. On the other hand, orientalists have deliberately forgotten the fact that Muslims have two legacies from the Prophet Muhammad peace and blessings of Allah be upon him, namely al-Qur'an and al-Sunnah, as the basis and source in every effort to formulate Islamic law.

Abstract

The books of fiqh discussed the concept of ih}da>d applies only to the wife who was left to die by her husband with the same period `iddah death, i.e. four (4) months in ten (10) days. It is inversely proportional to the concept of ih}da>d that apply in Article 170 paragraph (2) the Compilation of Islamic Law (KHI) which establishes the obligation of mourning for her husband who was left to die by his wife with time according to propriety. Following the truth of the theory in coherence (the truth on the basis of the consistency argument), then in Article 170 paragraph (2) is provision to the same as subsection (1), i.e. ih}da>d both make law had to be done, even though  by the wife and husband. The differences concept ,the researchers eventually focused on two aspects of the problem, namely: (1) What is the reason of shar`iy used in the determination of the ih}da>d for husband in Article 170 paragraph (2) the Compilation of Islamic Law (KHI)?, (2) How perspective maqa>s}id al-shari>’ah to the ih}da>d for husband in the Article 170 paragraph (2) the Compilation of Islamic Law (KHI)?. The researcher of this articel belongs to the normative research. While the views from the data collection which has been examined, the research belongs to library research (study library). Primary and Secondary data were analyzed by using descriptive analytic method, that describes the whole theory about maqa>s}id al-shari>`ah which used to analyze the datas of the husband who has ih}da>d. While the approach in analyzing the data by using a statutory approach (statute approach). There are two research results. The first, shar`iy used to determine of the ih}da>d for husband in Article 170 paragraph (2) the Compilation of Islamic Law (KHI) are the norms of Islamic law, both rule in us}uliyah or the rule of fiqhiyah. The second, ih}da>d for the husband in Article 170 paragraph (2) the Compilation of Islamic Law (KHI) in the perspective of maqa>s}id al-shari>`ah has been in accordance with universal values of shara` is jalb al-mas}a>lih wa dar’ al-mafa>sid (brought good and resist damage). The category of maqa>s}id, the provisions of this article are included in the categories of al-d{aru>riyya>t, especially h{ifz} al-‘ird i.e. the imposition of religious law in order to guarantee and maintain the honor.  Keywords: Ih}da>d, Compilation of Islamic Law (KHI), Maqa>s}id al-Shari>`ah.

Abstract

Abstrak Pemisahan Islam dan sains berakibat pada kemunduran peradaban umat Islam, di satu sisi, dan krisis eksistensial pada sisi yang lain. Integrasi keduanya dapat mengantarkan umat Islam pada prestasi peradaban sekaligus kesempurnaan moral. Upaya Integrasi Islam dan sains telah dimulai oleh para pemikir Muslim baik melalui dewesternisasi ilmu, Islamisasi ilmu, ilmuisasi Islam, dan lain sebagainya. Berbeda dengan tulisan serius para cendekiawan muslim tersebut, tulisan ini hanya akan berupaya mendeskripsikan integrasi bangunan epistemologis Islam dengan sains melalui library research berdasar pada data kepustakaan yang terkait. Fokus tulisan ini dibatasi pada masalah sebab keterpisahan umat Islam dengan sains dan bagaimana pola keselarasan espistemologi Islam dan sains. Tulisan ini menyimpulkan dua hal. Pertama, keterpisahan Islam dengan sains lebih dikarenakan aspek historis, sosiologis, politis dan bukan karena faktor sistem ajaran. Islam sebagai sebuah ajaran yang komprehensif tidak menempatkan “ilmu agama” dan “ilmu umum” dalam posisisi diametral-paradoksial. Kedua, pola keselarasan epistemologi Islam dan sains adalah kulli-juz’i (universal-partikular). Dengan kata lain, sains merupakan salah satu bagian dari ajaran Islam dalam satu keutuhan dan kesatuan sistem yang disebut sebagai way of life (jalan hidup). Kata Kunci: Islam, Sains, Epistemologi Abstract The separation of Islam and science resulted in the decline of Muslim civilization, on the one hand, and an existential crisis on the other. The integration of fatigue can lead Muslims to achievement as well as moral perfection. Efforts to integrate Islam and science have been initiated by Muslim thinkers through the dewesternization of science, the Islamization of science, the science of Islam, and others. In contrast to the serious writings of these Muslim scholars, this paper will only attempt to describe the integration of Islamic epistemological buildings with science through library research based on related library data. The focus of this paper is on the problem of the separation of Muslims from science and how the pattern of harmony between Islamic espistemology and science. This paper concludes two things. First, the separation of Islam and science is based more on historical, sociological, political aspects and not because of the teaching system factor. Islam as a teaching includes not placing "religious knowledge" and "general science" in a diametral-paradoxical position. Second, the pattern of harmony between Islamic and scientific epistemology is kulli-juz'i (universal-particular). In other words, science is a part of Islamic teachings in a whole and unified system known as a way of life. Keywords: Islam, Science, Epistemology

Abstract

Abstract: Sharaf science as a part of Arabic grammar can be said to be compulsory science in Islamic boarding schools, whether salaf, modern, or integrated. This study will examine the book of tashrif entitled Al-Amtsilah Al-Tashrifiyah by Kyai Ma'shum bin Ali by focusing on the epistemological aspect as far as the nature of tashrif is concerned, the systematics and model of preparation, and the sources and validity of tashrif scholarship in it. This qualitative research utilizes library data through documentation techniques. Content analysis and descriptive-analytic techniques were used in this study to analyze the collected data. Meanwhile, in drawing conclusions, Miles and Hubermen's interactive model is used. This research concludes two things. First, the book of Al-Amtsilah Al-Tashrifiyah is basically a book that contains a collection of examples of the interpretation of a word, both terminology and lughawi patterns. The systematics of this book starts with an example of word interpretation in a term tashrif pattern and is followed by a lughawi tashrif. The presentation of the tasfhrifan book uses a combination of two models, namely tables and songs. Second, the compilation of the book Al-Amtsilah Al-Tashrifiyah refers to the formulation of tashrif which is theoretically-coceptual in accordance with the sharaf rules contained in the books of Nadham al-Maqshud, al-Alfiyyah Ibn Malik, Syarh Qathr al-Nada, Awdlah al- Masalik, The Book of Sibawaih. More than that, the order of pentasrifan, especially the terminology, in the book Al-Amtsilah Al-Tashrifiyah is identical to the idea and pattern of pentasrifan developed by Imam Sibawaih.

Abstract

Meaning of jihâd has been more often equated with a form of terrorism and even lead to kriminilisme. Worse, the label with negative image led to the emergence of a negative stigma against the teachings of the religion of Islam in general. As a result, there is excessive negative treatment against Islamic faiths in the discourse of international relations, both in terms of state or individual. Therefore, the mediation of the diverse teachings of jihâd in proportion the original is considered very urgent. However, the most important at this time is redefined jihâd orientation concentrate on winning against ignorance and poverty eradication and is no longer in physical victory.

Abstract

To realize the ideal family, fulfilling sakînah element, mawaddah and rah?mah is a must, the presence of law No. 1 of 1974 about marriage (UUP) has a significant role in the country predominantly Muslim Indonesia. One form UUP rules for applying the principle of mental and physical readiness is the restriction of a certain age to get married. how UUP set age limits marriage? and what philosophical value if observed with the philosophy of Islamic family law? This research analyzes using descriptive-analytic method with the conclusions; the marriage age restriction as part of efforts for the realization of setting the ideals of marriage as set forth in paragraph (1). Restrictions UUP marriage age still embrace opportunities for UUP exceptions as set out in article 7 paragraph (2). While the philosophical value of these restrictions can be reviewed through the aspects ontological, epistemological and axiological. According to the philosophy of family law, marriage age restriction category as philosophy tashrî’ especially those problems maqâs?id al-ah?kâm in the form of compliance benefit and resist damage.

Abstract

Discourse divorce three at once emerged from the hadîth T?awûs history, that Abû al-S?ahbâ. In the hadîth three divorces fell once considered one tune. However, it was found that a history states that ‘Abdullah ibn ‘Abbâs gave the law fell three divorces. This contradiction can be resolved through three approaches; al-jam’u wa al-tawfîq (compromise), naskh (substitution), tarjîh (Selection). From this, it is interesting to study discourse.

Abstract

Not been much found a study evaluating the comparative-integrative among one religion to another religion related regulation of marriage are sourced directly from the scriptures respective religion, in particular Islam and Christianity. This is to give a balanced understanding and response to gender issues, social inequality relation of husband and wife is exhaled by Western scholars-Christians who are quite a lot of cornering the teachings of Islam. Starting from this idea authors conducted research using descriptive-analytic method to then compare giving rise similarities and differences to material for further research. The study concluded that marriage in Islam can be said to have a double dimension; vertical and horizontal dimensions, whereas the more dominant Christian vertical dimension though there is also a horizontal dimension, as well as striking differences more visible on the issue of legal origin of marriage, polygamy, the permanence of marriage and the problem of intermarriage

Abstract

Different from most scholars of Ushul Fiqh, al-T?ûfî tend to put theory mas?lah?ah independence of human reason. For al-T?ûfî vision of a more objective reason in positioning the criteria mas?lah?ah compared to antagonist nas?s? with one another. Therefore, the validity of argument mas?lah?ah should be determinant above the arguments of others, not to mention al-nas?s? al-shar’î though. Pattern of this determination, in analytical with an approach normative-juridical and nature descriptive content analysis. That pattern, departing from the view that to discover the existence of mas?lah?ah not have to wait information and support nas?s?. The mind can independently determine the matters contained therein mas?lah?ah and things are mafsadah. However, in its application, mas?lah?ah must be observed whether related to religious and muqaddarât or related to mu’âmalât and ‘âdat. If related to religious and muqaddarât it must have the support of legality nas?s? and ijmâ’. Unlike the case with regard to issue mu’âmalât and ‘âdat, then mas?lah?ah be the most powerful and independent argument, did not need a legality nas?s? and ijmâ’. In fact, even if turns out mas?lah?ah contrary to nas?s? and ijmâ’, mas?lah?ah must keep favored either with takhs?îs? (specialization) and bayân (explanation) against nas?s? and ijmâ’.

Abstract

The discourse about waqf property in Islamic Law is closely related to the formulation of the concept of property. The discourse revolves around the question of whether the definition of the waqf object refers to its material side in the sense of ‘ainul al-waqf, or does it refer to the substance side in terms of benefits and results. Can immaterial objects such as Intellectual Property Right can be used as endowments. This research is a type of qualitative research. Judging from the data collection type library research. The approach used is juridical-normative. In data analysis, the author uses content analyst methods, descriptive using a deductive mindset. The results of the study concluded that the waqf in the form of Intellectual Property Right as contained in the Indonesian Representative Law in Indonesia is valid according to Islamic Law, because it has been in accordance with the view of one of the schools of fiqh, namely the mâlikîy school, which permits waqf in the form of benefits. This conformity is produced through the method of ilh{âq al-masâ?il bi nad{âirihâ (equating a problem with a comparable one). The point of conformity between the two is equally including objects that are immaterial
