Abstract

The Penghulu in Indonesia has always been identified and held by men instead of women. The legal opportunity in Ministry of Religious Affairs Regulation No. 20/2019 on Marriage Registration has been annulled by Compilation of Islamic Law (KHI), which requires men as guardians, where the existence of marriage guardians is one of the duties of the head of the family, which inhibits women from serving as head of the family. Although fiqh as the main source of KHI has given legality to women as marriage guardians, KHI does not adopt arguments in favour of women becoming marriage guardians. Whereas the duties of the penghulu are not only limited to wali hakim, there are many duties of benefit in marriage such as providing legal certainty through marriage registration. This article aims to find out the existence of female headmen in Indonesia in the perspective of maqashid sharia. The research employs a literature content analysis. The results showed that based on the study of the six features of maqashid sharia proposed by Jasser Auda, the existence of female headmen is basically something that should be commonplace in Indonesia. The value of maslahah behind the administrative duties and legal certainty of marriage is an objective reason for women to serve as penghulu. This is because realising benefit is the obligation and responsibility of every human being, regardless of gender. This is supported by the existence of cognitive features, wholeness, openness, interrelationship between levels, multi-dimensionality, and meaningfulness of women's headship which has fulfilled the elements of maslahat and the objectives of Islamic law. Therefore, through this research, the reconstruction of guardianship law in KHI should be carried out immediately so that it can pave the way for women to access the position of penghulu.

Abstract

This study aims to analyze the use of spiral contraception in families by career women, with a review of Islamic law and contemporary social dynamics. The focus of this study is to explore the extent to which the use of spiral contraception can be justified in Islamic law, as well as how it is applied in the current developing social and cultural context, especially in facing the challenges of gender equality and the dual roles of career women. This study adopts a qualitative approach through literature studies and normative analysis of Islamic legal texts related to contraception and the role of women in society. The results of the study indicate that in the context of career women, the use of spiral contraception is seen as a legitimate choice in Islam, provided that it does not permanently inhibit pregnancy and is in line with the principle of maslahat (benefit). This study also emphasizes the importance of a deeper understanding of the developing social and gender dynamics, which play an important role in determining family policies. In addition, the results of this study confirm that Islamic law can offer relevant and adaptive solutions to contemporary challenges faced by career women in their lives.

Abstract

This study examines the phenomenon of online matchmaking agencies in finding life partners in the modern era, analyzed through the lens of darurah principles and sociological perspectives. It highlights changes in social dynamics that demand adjustments in legal and cultural frameworks. The study focuses on the role of online matchmaking as a supplementary tool in partner-seeking processes and its acceptance within social and religious contexts. Adopting a qualitative approach with purposive sampling, the research involved interviews with individuals aged 24-35 who are single. Data analysis incorporated interdisciplinary perspectives, including religious, social, and cultural views, alongside a historical approach to systematically reconstruct the evolution of online matchmaking agencies. The findings reveal that these platforms are not perceived as primary methods for partner searching but as complementary tools facilitating opportunities for meaningful relationships. While individual preferences for traditional matchmaking remain dominant, online agencies provide additional benefits by expanding social networks. This study offers insights into modern matchmaking practices by integrating darurah principles with contemporary social realities.

Abstract

The Appasili wedding tradition in Takalar Regency, South Sulawesi, has its uniqueness that is rarely found in other places. Appasili involves a series of distinctive rituals, such as marriage proposals, offerings, and joint celebrations, which show the importance of customs and rituals in the lives of the Takalar people. Each element in this tradition has a deep symbolic meaning, reflecting the cultural, spiritual, and social values upheld in local society. The Appasili wedding process also highlights the important role of the extended family and community, showing solidarity and strong social integration in the celebration. This research aims to describe community perceptions and Islamic legal perspectives on this tradition. This research uses a qualitative approach and is field research with data collection techniques in the form of in-depth interviews with religious figures and traditional practitioners, as well as related documentation. The research results show that people view the Appasili tradition as a hereditary custom that is believed to perfect and cleanse a marriage. However, the impact is not uniform; Some traditional leaders believe that not carrying out Appasili will have a negative impact, while some people see it as a habit with no significant impact. From the perspective of Islamic law, the Appasili tradition is considered permissible (permissible) because it does not contain harm and is following the principle of "al-urf muhakkam" and includes ‘urf Shohih', namely habits that do not conflict with Sharia law'. This research recommends preserving traditions by the next generation and the need for attention from government agencies in providing an understanding of the importance of preserving these traditions.

Abstract

Purpose – This study examines the dynamics of al-Qur'an memorizing couples in Roudlatul Qur'an Islamic Boarding School in Metro City in building a sakinah family. This study aims to fill the gap in the literature regarding the influence of the practice of memorizing the Qur'an on family relationships and daily life in the context of contemporary Islamic family law. This study argues that the spiritual practice of memorizing the Qur'an can be a significant strategy in improving family harmony and emotional well-being, making it relevant to be used as a reference in a strategic approach to building a sakinah family in the modern era. Methods – This research utilized a phenomenological study to gain in-depth insight into the informants' experiences. Data were collected through semi-structured interviews with three couples who memorize the Qur'an and work as teachers at Roudlatul Qur'an Islamic Boarding School. The interviews were analyzed using thematic analysis to identify key themes and patterns relating to the impact of Qur'ānic memorization on contemporary family dynamics. Findings – This study reveals that the activity of memorizing the Qur'an contributes significantly to controlling emotions, creating inner calm, and increasing wisdom in family decision-making. Couples who engaged in this activity reported increased self-awareness as well as the ability to handle conflicts more calmly and wisely. These results support the view that listening to and memorizing the Qur'an not only reduces stress levels, but also promotes inner peace through mechanisms involving the release of natural endorphins and delta wave stimulation. These findings are relevant in the context of building a sakinah family in the environment of Pesantren Roudlatul Qur'an Metro City, particularly within the framework of contemporary Islamic family law. Research limitations – Some limitations of this study include the small sample size and focus on one particular location, which may affect the generalizability of the findings. Further research with a larger sample and various locations is needed to strengthen the conclusions. Originality – This study makes an important contribution to the literature on the role of spirituality in contemporary family dynamics. The results of this study show that Qur'an memorization not only has an impact on spiritual aspects, but also on emotional and psychological aspects, thus providing a strong foundation for achieving a sakinah family. This research also opens up opportunities for further research on how religious practices can be used to improve the quality of family life.

Abstract

The debates on the application of Islamic criminal law in various Muslim-majority countries are still ongoing. This is because these countries still adhere to a positive legal system. This phenomenon has spread to many things including implementing the punishment of cutting off the hands of corruptors as is the punishment for thieves in the provisions of Islamic criminal law. One of the obstacles, in this case, is due to differences of opinion on the use of the term "thief" to be applied to "corruptor". This article aims to analyze the punishment provisions for thieves as regulated in Surah al-Maidah verse 38 to be applied to perpetrators of corruption. This article is the result of qualitative research with a linguistic approach. The primary data source in this study is the Qur'an, whereas, the secondary data sources are articles, books, and other relevant documents. Data were collected through a literature study method which was then processed, analyzed, and concluded. This study found that the crime of corruption, seen from a linguistic perspective, has the same meaning as thievery; the perpetrator, therefore, can be sentenced to the same punishment (cutting off the hand). The punishment here is the most severe type that can be imposed on perpetrators of corruption, considering that the impact it causes is heavier and wider than the impact that arises in the crime of thievery. Certainly, this punishment is applied if it has met all the elements and legal requirements and is applied in a very strict manner.
