Abstract

In interpreting justice, there are various versions of answers and they are often considered unsatisfactory. This gives rise to debate and the meaning of justice becomes a relative formulation. The type of research used in research is library research, which is research related to reading, recording and managing materials used in activities related to research and without using field research. The results of the research show that Plato, Aristotle, and Thomas Aquinas stated that justice is proportional equality, while John Rawls stated that the values ​​of justice included in legal philosophy will be answered by legal philosophy itself. Justice in life is an important need for humans so that everyone can balance demanding their rights and carrying out their obligations in an effort to achieve truth. Thus, truth and obligation must be harmonious and balanced in life.

Abstract

Dispute resolution is an integral part of the legal system which functions to maintain peace and justice in society. One alternative approach that is gaining increasing attention is Alternative Dispute Resolution (ADR). This article aims to present an Alternative Dispute Resolution (APS) based on the Al-Qur’an. The research method used is a literature study, by reviewing the text of the Al-Qur'an and literature related to Alternative Dispute Resolution (APS) and Islamic law. The research results show that Al-Qur'an-based dispute resolution can be a valuable alternative in the modern context, not only because of its conformity with Islamic values, but also because of its ability to offer effective and sustainable solutions to resolve disputes in society fairly.   Abstrak Penyelesaian sengketa adalah bagian integral dari sistem hukum yang berfungsi untuk menjaga kedamaian dan keadilan dalam masyarakat. Salah satu pendekatan alternatif yang semakin mendapatkan perhatian adalah Alternatif Penyelesaian Sengketa (Alternative Dispute Resolution - ADR). Artikel ini bertujuan untuk menyajikan Alternatif Penyelesaian Sengketa (APS) berbasis Al-Qur'an. Metode penelitian yang digunakan adalah kajian literatur, dengan meninjau teks Al-Qur'an dan literatur terkait Alternatif Penyelesaian Sengketa (APS) serta hukum Islam. Hasil penelitian menunjukkan bahwa penyelesaian sengketa berbasis Al-Qur'an dapat menjadi alternatif yang berharga dalam konteks modern, tidak hanya karena kesesuaiannya dengan nilai-nilai Islam, tetapi juga karena kemampuannya untuk menawarkan solusi yang efektif dan berkelanjutan untuk menyelesaikan sengketa dalam masyarakat dengan adil.

Abstract

This research examines the application of the ultra petita partium principle in the Religious Courts from the perspective of Islamic law, namely a principle that prohibits judges from deciding cases beyond what is demanded by the parties to the case. This principle is one of the important principles held in religious justice. This research is based on legal research with the category of library research. The approach used in this research is a normative juridical approach. The results of the research show that basically the principles of justice, equality and non-burdensomeness in Islamic law are closely related to the application of the principle of ultra petitum partium. By ensuring that every individual is treated equally and that no decision exceeds the demands submitted, the Religious Courts can maintain fairness and integrity in every decision they make. However, there are exceptions where judges are deemed not to have violated the principle of ultra petitum partium when proceeding in the Religious Courts, especially in divorce cases regarding determining the maintenance of the wife and children who must be borne by the husband during the divorce lawsuit as stated in the provisional decision. Even without a provisional decision from the wife, the judge can issue a provisional decision.
