Abstract

Sungai Nipah Village, which is located in Mempawah Regency, is one of the areas that has problems with unregistered marriages due to unregistered marriages. unregistered marriages can give rise to issues regarding the rights of wives, children, as well as other legal consequences in civil law. The aim of this service activity is to provide understanding to the public about the legal consequences of unregistered marriages, preventing the occurrence of unregistered marriages. not registered, as well as providing solutions to the community to solve legal problems that arise as a result of unregistered marriages. This activity is carried out using methods of socialization activities, interactive discussions, and mentoring. The result of service activities is an increase in legal knowledge by Village Officials and Village residents to be able to help residents with problems regarding the implementation of unregistered marriages in the community, as well as being able to provide direction as well as solutions and legal remedies that can be taken for unregistered marriages.

status, and a person's contribution to society and government. In the Sambas Sultanate, derived names were automatically attached to someone who was a descendant of the Sultanate's family. One of the names known in the Sambas Sultanate and the Malay indigenous community is "Uray". However, this honorary name could later be changed to "Raden" with an appointment from the Palace. This can clearly lead to changes in the social hierarchy and a person's status in society. Through a literature study related to the attachment of honorary names known in the Malay tribal community in the Sambas Sultanate. This paper aims to (i) find out how someone gets the honorary name Uray in the Malay traditional community; (ii) the causal factors that enable a person to change his honorary name from Uray to Raden; and (iii) are there any consequences that the person will receive due to the change of name. The author uses an empirical legal writing method that is descriptive exploratory in nature. The results of the writing are (i) the honorary names Uray and Raden were obtained through lineage relationships; (ii) factors that cause changes in the name of honor that a person has are marital relations and direct appointment from the Palace by the Sultan; and (iii) someone who has changed his honorary name through a traditional ceremony will have new responsibilities that make him someone who plays an important role in society. One of them is being a role model in terms of cultural preservation.

Abstract

Abstract Airplane accidents not only cause physical harm but also profound psychological trauma for surviving passengers. However, the legal framework in Indonesia governing airline liability for passenger psychological trauma remains very weak because existing regulations and jurisprudence tend to focus more on physical losses such as death, disability, or injury, and do not explicitly mention psychological trauma as a form of compensation. This study aims to analyze the legal framework governing airline liability for passenger psychological trauma and identify the limitations of such legal liability. This study uses a normative juridical method with a statutory, case-based, and conceptual approach. The analysis shows that the regulation of liability for passenger psychological trauma in Indonesia is limited by the difficulty in proving a causal relationship between accident incidents and psychological trauma due to its immaterial nature and inability to be precisely measured. In addition, there is no legal basis that regulates the amount of compensation in concrete terms, so that the assessment of compensation is very subjective and depends on the judge's discretion, while there are different legal interpretations between judges, which creates legal uncertainty and allows airlines to escape responsibility. The author recommends that the government create implementing government regulations for Law Number 1 of 2009 concerning aviation to classify the psychological trauma experienced by surviving passengers into passenger losses and must be borne by the carrier along with the criteria for proving causality so that there is legal certainty and is able to provide the best solution for all parties involved. Abstrak Kecelakaan pesawat terbang tidak hanya menimbulkan kerugian fisik, tetapi juga luka psikologis yang mendalam bagi para penumpang yang selamat. Meskipun demikian, kekuatan hukum di Indonesia yang mengatur tanggung jawab maskapai penerbangan terhadap trauma psikologis penumpang masih sangat lemah. Hal ini dikarenakan regulasi dan yurisprudensi yang ada cenderung lebih fokus pada kerugian fisik seperti kematian, cacat tetap, atau luka-luka, dan tidak secara eksplisit menyebutkan trauma psikologis sebagai bentuk kerugian yang dapat dikompensasi. Studi ini bertujuan untuk menganalisis kekuatan hukum yang mengatur tanggung jawab maskapai penerbangan atas trauma psikologis penumpang yang selamat, serta mengidentifikasi batasan-batasan yang ada dalam pertanggungjawaban hukum tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, kasus, dan konseptual. Hasil analisis penulis menunjukkan bahwa regulasi pertanggungjawaban atas trauma psikologis penumpang selamat di Indonesia masih terbatas oleh kesulitan dalam membuktikan hubungan kausalitas antara insiden kecelakaan dan trauma psikologis karena sifatnya yang immateriil dan tidak dapat diukur secara pasti. Selain itu, tidak adanya landasan hukum yang mengatur besaran ganti rugi secara konkret, sehingga penilaian ganti rugi menjadi sangat subjektif dan bergantung pada diskresi hakim sedangkan terdapat interpretasi hukum yang berbeda-beda antar hakim, yang menciptakan ketidakpastian hukum dan memungkinkan maskapai untuk lepas dari tanggung jawab. Untuk itu, penulis merekomendasikan kepada pemerintah untuk membuat peraturan pemerintah pelaksana UU Nomor 1 tahun 2009 tentang penerbangan agar mengklasifikasikan trauma psikologis yang dialami oleh penumpang selamat dalam kerugian penumpang dan harus ditanggung oleh pihak pengangkut beserta kriteria pembuktian kausalitasnya sehingga terdapat kepastian hukum dan mampu memberikan solusi terbaik seluruh pihak yang terlibat.
