Abstract

Abstract The death penalty is the most severe type of punishment imposed on a defendant. The death penalty regulations in the New Criminal Code are different from the Criminal Code which is currently still in force. This research is normative legal research using a statutory approach and a conceptual approach regarding the Death Penalty and the Purpose of Punishment itself. This research aims to analyze the death penalty regulations in the New Criminal Code which are different from the Criminal Code which is currently still in force.

Abstract

Kegiatan pengabdian masyarakat yang dilaksanakan di Balai Desa Pasinan, Kecamatan Lekok, Kota Pasuruan, ditujukan untuk anak-anak berusia 6-12 tahun guna meningkatkan kesadaran dan pemahaman tentang pentingnya menabung sejak dini. Program ini terdiri dari pemaparan materi, sesi tanya jawab, dan pembelajaran interaktif melalui pembuatan celengan dari kardus bekas, yang dirancang untuk memastikan keterlibatan aktif anak-anak. Tujuan dari program ini adalah untuk mengajarkan pengelolaan keuangan pribadi dan mempersiapkan masa depan yang lebih baik, dengan dukungan dari guru dan orang tua. Hasil kegiatan menunjukkan adanya peningkatan pemahaman anak-anak mengenai menabung serta motivasi untuk hidup hemat, ditunjukkan melalui antusiasme tinggi dalam aktivitas kreatif. Peran orang tua sangat krusial untuk kelanjutan dan pengembangan kebiasaan menabung pada anak usia dini. Selain itu, program ini juga mengajarkan pentingnya daur ulang, memberikan manfaat dalam edukasi keuangan dan meningkatkan kepedulian terhadap lingkungan.

Abstract

This article examines the impact of advanced technologies on enhancing due diligence for Politically Exposed Persons (PEPs) within Indonesia's digital banking sector. With the rapid growth of digital banking, there is a pressing need to address the heightened risks associated with PEPs, including potential corruption and money laundering. The study explores the challenges posed by traditional due diligence methods in the face of evolving financial technologies like artificial intelligence (AI) and machine learning (ML), which offer innovative solutions to improve compliance and risk management. It emphasizes the importance of robust regulatory frameworks designed to safeguard the financial system, while also highlighting the operational realities faced by digital banks in adhering to these regulations. The research employs qualitative analysis to investigate how technology can streamline compliance processes, enhance customer due diligence (CDD), and facilitate the identification and monitoring of high-risk clients. Additionally, it discusses the implications of these technological advancements for both regulatory compliance and overall financial security in Indonesia. By focusing on the intersection of technology, regulation, and compliance challenges, this study underscores the critical role of digital banking in mitigating financial crime risks associated with PEPs in an increasingly complex financial landscape.

Abstract

This study aims to evaluate the appropriateness of using the term “Restorative Justice” (RJ) in the settlement of narcotics cases at the investigation and inquiry stages in Indonesia, as regulated under the Regulation of the Chief of the Indonesian National Police Number 8 of 2021 concerning the Handling of Criminal Offenses Based on Restorative Justice (INPR 8/2021). The background of this research arises from the conceptual tension between RJ’s core principles—namely, victim-offender dialogue and community involvement—and the actual practice in narcotics cases, where the offender is simultaneously the victim and no external harmed party is present. The urgency of this writing lies in the widespread use of RJ terminology in policy documents without adequate alignment to its philosophical foundations, which may create confusion in legal interpretation and practice. Using normative juridical methods, this research employs conceptual and statutory approaches to find that the substance of INPR 8/2021 is more aligned with Rehabilitation Theory (RT), particularly the medical model, which views the offender as a patient in need of treatment rather than as a morally responsible agent. This study provides a novel conceptual clarification by framing INPR 8/2021 within the medical model of rehabilitation rather than traditional RJ. This reinterpretation contributes to more accurate legal discourse and supports the development of coherent and normatively sound drug policy frameworks in Indonesia, ensuring that the use of legal terminology reflects the actual purpose and design of the policy.
