Abstract

Tulisan ini membahas tentang konsep dan kriteria kecakapan bertindak bagi penyandang disabilitas autisme menurut persefektif hukum perdata Indonesia. Permasalahan yang dibahas dalam penelitian ini terkait tentang konsep dan kriteria kecakapan bertindak yang berlaku bagi penyandang disabilitas autisme pasca di undangkannya Undang-Undang No. 8 tahun 2016 tentang Penyandang Disabilitas sebagai pengganti Undang-Undang No. 4 tahun 1997 tentang Penyandang Cacat. Di dalam Pasal 4 ayat 1 huruf (c) UU Penyandang Disabilitas, disabilitas autisme masuk kedalam kategori disabilitas mental, padahal Autisme adalah disabilitas perkembangan dan berbeda dengan disabilitas mental sebagaimana skizofrenia, bipolar, depresi, anxietas, dan gangguan kepribadian. Dengan menempatkan disabilitas autisme ke dalam disabilitas mental akan menimbulkan persepsi bahwa seorang dengan disabilitas autisme adalah seorang yang harus ditaruh dibawah pengampuan karena dianggap tidak cakap. Penulisan ini disusun dengan normatif legal research method dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukan bahwa penyandang disabilitas autisme adalah subyek hukum yang cakap jika memenuhi kriteria kecakapan sebagaimana yang ditentukan dalam 1330 KUHPerdata dan selama tidak dinyatakan tidak cakap berdasarkan penetapan pengadilan (penjelasan Pasal 32 UU Penyandang Disabilitas).

Abstract

Tulisan ini bertujuan untuk menganalisis kedudukan harta warisan anak yang di bawah umur yang memiliki kewarganegaraan ganda dari orang tuanya yang melakukan perkawinan campuran. Metode yang digunakan adalah penelitian”yuridis normatif, yang dilakukan untuk mengkaji kaidah-kaidah atau norma-norma dalam hukum” positif.  Pendekatan” yang digunakan adalah pendekatan perundang-undangan dan pendekatan konseptual. Pendekatan undang-undang dilakukan dengan menelaah semua undang-undang dan regulasi yang berkaitan dengan masalah hukum yang sedang ditangani. Pendekatan konseptual”beranjak dari pandangan-pandangan dan doktrin-doktrin yang berkembang di dalam ilmu hukum untuk menemukan ide-ide yang melahirkan pengertian-pengertian hukum, konsep-konsep hukum, dan asas-asas hukum relevan dengan isu”yang dihadapi. Pemahaman akan pandangan-pandangan dan doktrin-doktrin tersebut merupakan landasan untuk membangun suatu argumentasi hukum dalam memecahkan isu yang dihadapi.  Anak di bawah umur yang memiliki kewarganegaraan  ganda dapat menerima warisan dari orang tuanya yang melakukan perkawinan campuran, apabila: (a) perkawinan orang tuanya adalah sah dan tercatat; (b) anak belum genap berusia 18 tahun atau menikah; (c) setelah genap 18 tahun atau menikah, yang bersangkutan mengajukan menjadi warga negara Indonesia paling lambat 3 tahun.

Abstract

Basic considerations of the Constitutional Court made ultra petita verdict  was:(a)  philosophical reasons in order to enforce substantive justice and constitutional justice as embodied in the Constitution NRI 1945, (b) theoretical grounds related to the authority of the judge to explore, discover and follow the legal values that live  in the community, if the law does not exist or insufficient legal anymore (outdated), and (c) juridical reasons relating to the provision of Article 24 paragraph (1) NRI 1945 Constitution and Article 45 paragraph (1) of Law no. 24 year 2003 on the Constitutional Court, that Court as organizers aim to enforce the judicial justice according to law and the evidence and the judge's conviction. The verdict the Constitutional Court which is ultra petita  basically acceptable, all associated  to  the subject of the request and based on considerations which can be accounted for philosophical (ie, contains the values of justice, morality, ethics, religion, principle, doctrine). The authority to make ultra petita verdict for the Constitutional Court can only be given if there is vagueness of legal norms (vague normen) through the method of interpretation of the law, or if a legal vacuum (rechts-vacuum) through the creation of legal methods (rechtschepping). But considering the legal interpretation and legal formation are highly subjective, hence in order to prevent abuse of power, the Constitutional Court issued a verdict ultra petita, should be limited by the principles of a democratic state of law,  the principles of fair trial and impartial, and general principles of good governance.

Abstract

Tax dispute resolution in Indonesia has not yet met the principles of quick, simple, and economical. Taxpayers have to wait more than 3 years for the lawful certainty. This paper elaborates the potential strategy in resolving the tax dispute in Indonesia through administrative law. OECD has suggested taxpayers and revenue body to build positive connection through the changing of confrontation to the collaborative relationship. Mediation is a solution to encourage this positive bond in solving the dispute. It is successfully implemented in Australia. The similar way is strongly recommended for the Indonesian Government to develop a good relationship between taxpayers and revenue body. One of the chances for mediating in an attempt to minimize tax dispute is in the auditing process. This process cannot be easily done because it needs political will and high desired improvement from the Government to make a change. Mediation is an attempt to achieve a win-win solution and is in line with the principles of Pancasila, that is a deliberation for reaching an agreement. If it is done, then mediation will be a courteous way in tax dispute resolution and will be able to improve a good post-dispute relationship in Indonesia.

Abstract

The problem of finite mineral and coal natural resources has been reopened by the growing demand for development and mining resources, which impacts the global arena. Environmental issues are just one of the issues caused by mining activities, which are another. In mining sites, there has to be an ongoing planning process based on the environment. This study addresses the existing mining regulatory framework and the problem of harmonization between spatial plans for mining regions based on environmental sustainability, with a particular emphasis on spatial planning for mining sites in Indonesia. Under the provisions of spatial planning, this article outlines the fundamental concepts of strategic environmental sustainability as a roadmap for sustainable growth in the mining industry. This study concludes that the idea of creating a mining business permit area is predicted to function as a tool for prevention against the emergence of significant environmental pollution and damage due to mining activities with the existence of an integrated concept of environmental licensing and spatial planning. Because this authority can be determined based on the size of "geographical-ecological", "economical", or "administrative" conditions, recommendations made with the existence of legal criteria relating to the determination of mining areas to become the authority of the Minister of Environment and Spatial Planning, Governors, and Regents/Mayors will result in the principle of environmental sustainability.

Abstract

The policy of terminating access to Private Scope Electronic System Operators, to several internet platforms including: Paypal, Yahoo, Epic Games, Steam, Dota, Counter Strike, Xandr.com, and Origin, which occurred on July 30, 2022. The government's policy in terminating access to unregistered private scope electronic system operators has resulted in material and immaterial losses to citizens who use the platform of unregistered private scope electronic system operators. This research uses normative legal research method, that using a statutory, conceptual, and cases approach to analyze issues related to the termination of access to unregistered Private Scope PSEs. This research concludes that the government's policy of terminating access to unregistered private electronic system operators is contrary to human rights regulation. These rights include the right to access, communicate and obtain information and the right to an economy for citizens who are harmed by the termination of access to unregistered private scope electronic system operators.

Abstract

This study aimed to describe the procedure for resolving land disputes, the application of the General Principles of Good Government (AUPB) in land dispute resolution, and the supporting and inhibiting factors for the application of AUPB in resolving land disputes. This study used a sociological juridical approach, with the type of empirical juridical research. The procedure for resolving land disputes was through two types of applications, namely letters of public complaints and implementation of court decisions. The application of AUPB in land dispute resolution started from the application, data collection and analysis, field assessment and inspection, case exposure, case settlement reports, settlement, and implementation of settlement decisions. Supporting factors for the implementation of AUPB were the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 11 of 2016, Section for Handling Land Problems and Control, as well as facilities and infrastructure for mediation, case titles, and transportation. The obstacle of the AUPB implementation included the inkracht decision to issue replacement certificates that had not been explicitly regulated, resulting in land registration services being blocked by the system and uncooperative parties.

Abstract

This study aimed to analyze the regulation on Absentee land ownership, the purpose of Absentee land ownership regulation, and the urgency and relevance of the regulation on Absentee land ownership in agrarian reform. The type of research used in this study was normative juridical with a positivist legalistic approach. The regulation on the prohibition of absentee land ownership was regulated in additional rules contained in Articles 3A to 3E of Government Regulation Number 41 of 1964 and further reaffirmed by Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of BPN Number 18 of 2016 concerning Control of Agricultural Land Control. The purpose of the regulation on the prohibition of absentee land ownership was so that the local community could enjoy the results obtained from land management. The urgency and relevance of the regulation on the prohibition of absentee land ownership at the time of agrarian reform could not be carried out effectively because there was no specific regulation governing Absentee land. Thus, it was necessary to review and even eliminate some regulations no longer by current and future developments.

Abstract

This study aimed to analyze the release of the responsibility of the Head of the Land Office in the electronic mortgage registration process and the enactment and reformulation of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 5 of 2020. This study used a normative juridical method with a statutory and conceptual approach. The Head of the Land Office was declared free from responsibility in the event of cancellation of the application for registration of mortgage rights due to force majeure or an emergency. The enforcement of Article 25 paragraph (1) of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 5 of 2020 created disharmony with Article 15 paragraph (3) of Law Number 19 of 2016, Article 13 paragraph (4) of Law Number 4 of 1996, and Article 6 paragraph (1) letter g and the letter i of Law Number 12 of 2011. Reformulation could be carried out by adding the phrase "can be proven" in Article 25 paragraph (1), the phrase "holiday" in Article 16 paragraph (2), and expanding the meaning of the phrase "holidays" in Article 1 of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 5 of 2020.

Abstract

This study aimed to analyze the legal validity of the DMO policy which was based on the Minister of Energy and Mineral Resources Letter 2783/32/MEM.B/2018 dated April 19, 2018, and the legal implications of the DMO quota transfer policy on mining companies. This research was a normative study using a statute approach. The results showed the coal DMO quota transfer policy was a policy that recognized its existence and had binding legal force. The DMO quota transfer policy had implications for fulfilling quotas for mining companies that contract with State Electricity Enterprise and mining companies that did not contract with State Electricity Enterprise. Mining companies that contract with State Electricity Enterprise could buy and sell coal which was more than the 25% coal DMO obligation with State Electricity Enterprise. Quota transfers made by mining companies that did not contract with State Electricity Enterprise had an uncertain price.
