Abstract

This research aims to gain a vivid and comprehensive portrait of legal aspects in the digitalization of cultural heritage in Greater Malang in Indonesia from the perspective of ecotourism and the state’s role in terms of policies and involvement of the members of the public in cultural conservation. The involvement of e-tourism and e-government in managing and developing the tourism potential in developed areas is inevitable. Cultural heritage-based tourism promoting the utilization of advanced information and communication technology has attracted the attention of tourists. Empirically, the digitalization of cultural heritage does not stand on its own but is more integrated with other aspects and sectors. The proposed concept in this study reminds us of the urgency in the development and utilization of integrated cultural heritage digitalization from the perspectives of eco-tourism, e-tourism, as well as other sectors such as e-government and spiritual aspect. The process of the development and utilization of digitalization of cultural heritage tourism is intended to ward off any disputes over ulayat rights happening these days. The role of the government and the participation of tribal people are deemed vital in reconstructing the system of social and spiritual values in developing eco-tourism based on the application of an integrated digital information system disseminating local wisdom through the threshold of global civilization.

Abstract

This research highlights the shifting concepts and mechanisms in business licensing in forest areas from environmental licensing to an environmental agreement following the effectuation of Indonesia’s Job Creation Law. It is important to investigate this change, considering that it may involve environmental damage or deforestation in forest areas, which tends to be pro-businesses. With the normative-juridical method that incorporates statutory, conceptual, and analytical approaches, This research aims to analyze the concept of the integration of an environmental agreement in risk-based business licensing that has changed business licensing into an environmental agreement in forestry. This study also analyzes the concept of an environmental agreement concept regarding the likelihood of deforestation and the shifting functionality of forest areas. The last important point is that it is paramount to set an ideal legal construction in the environmental agreement in risk-based business licensing in forestry businesses by employing a restorative justice approach and public participation. The research results recommend an ideal legal concept in the integration of an environmental agreement into risk-based business licensing by taking into account public participation, as outlined in Environmental Protection and Management Law, implying citizens to have both public and private rights, enabling them to participate. Moreover, the public role can adjust to the need and risk levels developed with varied concepts of the development of public participation by considering theories and practices in other countries.

Abstract

This research explores the legal implications of land certificate digitalization under Indonesia's Job Creation Omnibus Law, focusing on the synchronization and harmonization of related regulations. The main question examines how the transition from traditional paper-based certificates to electronic titles (e-titles) can align with Indonesia's legal framework. The study is intended to analyze primary legal challenges and compare the Indonesian experience with Rwanda's successful e-title system. The paper employs a normative-juridical method, examining legal materials, including Electronic Information and Transactions Law and government regulations regarding land registration. The research discusses the synchronization of these laws and their application in ensuring data security, legal certainty, and efficient land governance. The result of the discussion highlights that while digitalizing land certificates can improve service delivery and efficiency, successful implementation is contingent upon the careful alignment of various laws and coordination between the National Land Agency and other government bodies. The comparative analysis with Rwanda’s e-title system offers useful insights into addressing potential legal and administrative challenges in Indonesia's digital transformation of land administration. This research contributes to offering actionable insights for policymakers aiming to modernize land governance in Indonesia. Penelitian ini mengkaji implikasi hukum digitalisasi sertifikat tanah berdasarkan UU Cipta Kerja, dengan fokus pada sinkronisasi dan harmonisasi peraturan perundang-undangan terkait. Fokus utama penelitian ini adalah untuk menganalisis tentang bagaimana transisi sertifikat tanah dalam bentuk kertas menjadi sertifikat tanah elektronik (e-title) dapat diselaraskan dengan kerangka hukum Indonesia yang ada. Penelitian ini diposisikan untuk menganalisis tantangan hukum utama dan membandingkan pengalaman Indonesa dengan sistem e-title di Rwanda yang dianggap berhasil. Paper ini akan mengkaji isu hukum ini dengan menggunakan metode yuridis normatif, yakni menganalisis berbagai bahan hukum peraturan perundangan-undangan, antara lain Undang-Undang Informasi dan Transaksi Elektronik, dan Peraturan Pemerintah yang terkait dengan pendaftaran tanah. Penelitian ini membahas sinkronisasi beberapa peraturan dan penerapannya dalam memastikan keamanan data, kepastian hukum, dan tata kelola pertanahan yang efisien. Hasil utama dari diskusi pada paper ini menyoroti bahwa meskipun digitalisasi sertifikat tanah dapat meningkatkan penyediaan layanan dan efisiensi, implementasi yang sukses bergantung pada penyelarasan berbagai undang-undang dan koordinasi yang cermat antara Badan Pertanahan Nasional dan badan pemerintah lainnya. Analisis komparatif dengan sistem e-title Rwanda menawarkan wawasan yang berguna untuk mengatasi potensi tantangan hukum dan administratif dalam transformasi digital administrasi pertanahan Indonesia. Penelitian ini memberikan kontribusi wawasan praktis bagi pembuat kebijakan yang bertujuan memodernisasi tata kelola pertanahan di Indonesia.

Abstract

Slum areas in Indonesia present a significant challenge, with government programs such as the National Slum Upgrading Program (NSUP) aiming to address urban poverty and improve living conditions. Despite the implementation of formal policies, the interplay between legal frameworks and local practices often determines the success of such initiatives. Drawing on Keebet von Benda-Beckmann’s theory of legal pluralism, this research examines the transformation of slums into productive and sustainable zones, focusing on Kampung Jodipan, Kampung Heritage Kajoetangan, and Kampung Kreatif Dago Pojok. These case studies reveal how formal legal systems interact with informal norms and community-driven practices in achieving urban revitalization. Using an ethnographic approach, the study employed in-depth interviews, participant observation, and analysis of legal documents to explore the dynamic collaboration between government, private stakeholders, and local communities. The findings indicate that while government-led initiatives like the NSUP provide vital resources and frameworks, the integration of informal community norms and active local participation plays a pivotal role in the success of slum transformation projects.This research concludes that sustainable urban development requires a balance between formal policies and grassroots efforts. The coexistence of multiple legal systems, as framed by Keebet von Benda-Beckmann’s legal pluralism, offers a critical lens to understand how collaborative governance can address urban poverty. The study emphasizes the importance of culturally embedded, adaptive approaches that bridge formal and informal systems to create inclusive and sustainable urban spaces.

Abstract

Pada era digital ini, terdapat tren ekspansi bisnis internasional dengan melakukan aksi korporasi, salah satunya akuisisi, yang menyebabkan beralihnya data pribadi baik secara domestik maupun secara lintas negara akibat adanya integrasi pasca akuisisi. Sedangkan di dalam Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi, hanya terdapat ketentuan terpisah pada Pasal 48 dan Pasal 56 mengenai aksi korporasi dan transfer data pribadi lintas negara, tanpa mengatur keterkaitan antara dua ketentuan ini. Hal ini berpotensi menyebabkan beralihnya data pribadi ke luar yurisdiksi Indonesia secara otomatis sebagai dampak dari integrasi pasca akuisisi. Penulisan ini bertujuan untuk menganalisis urgensi dari dibentuknya pengaturan pengalihan data pribadi lintas negara pasca akuisisi dan membentuk formulasi peraturan yang ideal untuk mengatasi isu hukum ini. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan, komparatif, konseptual, dan kasus, dengan teknik pengumpulan bahan hukum dengan studi kepustakaan dan studi situs web, serta dianalisis menggunakan interpretasi sistematis, gramatikal, dan komparatif. Dari hasil penelitian ini, penulis menemukan bahwa terdapat ketidaklengkapan norma di dalam undang-undang ini. Oleh karena itu, pemerintah Indonesia dapat mengadopsi ketentuan-ketentuan di dalam European Union The General Data Protection Regulation 2016/679 dalam merumuskan ketentuan yang ideal mengenai pengalihan data pribadi lintas negara akibat akuisisi.
