Abstract

Tujuan penulisan ini untuk menganalisis konsekuensi yuridis dari ketentuan penarikan akta cerai yang diwajibkan oleh Kantor Urusan Agama sebagai persyaratan bagi pihak yang pernah bercerai untuk melangsungkan lagi perkawinan, ditinjau dari pembuktian status kepemilikan harta bawaan. Jenis penelitian bersifat normatif yang dilakukan dengan cara meneliti bahan-bahan hukum. Kewenangan KUA dalam memberlakukan persyaratan penarikan akta cerai berikut putusannya bagi pasangan yang pernah bercerai untuk melangsungkan kembali suatu perkawinan telah menyebabkan sulitnya dilakukan pembuktian atas status perkawinan seseorang sebagai duda/janda pada saat diperolehnya harta benda/harta kekayaan. Hal tersebut berdampak pada tidak adanya kepastian apakah harta benda tersebut masuk ke dalam klasifikasi harta bawaan yang diperoleh setelah terjadinya perceraiaan dan sebelum dilangsungkanya perkawinan yang kedua/lebih, atau memang harta benda tersebut merupakan harta gono gini yang diperoleh dari perkawinannya terdahulu yang belum terbagi setelah terjadinya perceraiaan. Putusan Pengadilan Negeri Surakarta Nomor 20/pdt.G/2013/PN.Ska adalah contoh dari timbulnya konsekuensi berupa konflik hukum oleh karena ketiadaan akta perceraiaan maupun putusannya, sebagai alat bukti yang menjadi dasar petunjuk mengenai status kepemilikan harta benda yang dimiliki seseorang, terutama dalam hal menentukan pihak-pihak yang memiliki keterkaitan hak dengan harta benda tersebut dan wajib untuk dimintai persetujuannya, ketika harta benda tersebut akan dibebani suatu perbuatan hukum tertentu, baik dialihkan dengan cara dijual, dijaminkan ataupun sebatas disewakan.

Abstract

Since 2005 the rule of Bank Indonesia is already issued a policy about consumer credit facilities in order to get a place or a home for foreign people who live in Indonesia, but it is not enough to make all the bank that took place in Indonesia give that facilities. One of the reasons discrepancy of a number banks to give that credit facilities to foreign people is because the risk in case there is a failure or the person is not fulfilling the obligation. Considering the debtor is a foreigner, while the object of the guarantee is a land with a right of use that has a limited period, and until now there is still no regulations from both the Indonesian government and from Bank Indonesia that specifically provide protection against banks on consumer credit facilities for foreigners. In this paper, the writer will discuss the effort of legal protection that can be done by the Bank are preventive effort and repressive effort. Preventive legal protection efforts undertaken by banks is with credit agreements. Repressive legal protection effort, if the foreign debtors can not fulfill the obligation one of them is to stop the consumer credit agreement.

Abstract

Introduction: Article 45 paragraph 1 letter e creates legal uncertainty regarding the rights of the auction winner in terms of transfer of rights and control of the auction object due to a blockade from the debtor or other party.Purposes of the Research: The purpose of this research is to examine the legal certainty of Article 45 Paragraph 1 Letter e of Government Regulation No. 24 of 1997 concerning Land Registration against blocking of auction objects and legal protection for auction winners executing mortgage rights in the event of blocking of auction objects.Methods of the Research: The research method used is normative legal research.Results of the Research: The results of the study show that the form of legal protection for the auction winner is preventive legal protection, in which the name transfer process by the auction winner should still be carried out by understanding the meaning of Article 45 paragraph 1 lettere, namely the material claim or dispute referred to is limited to ownership disputes, not debts. Furthermore, legal protection is repressive, i.e. the auction winner can request assistance from the District Court to empty the object. The auction winner can hold the seller accountable in the form of compensation, and the auction winner can file a lawsuit against the unlawful act against the blockade applicant and the Land Office as the institution authorized to carry out block records.

Abstract

Introduction: In Indonesia, regulations have been issued that guarantee certainty over land in Indonesia, one of which is Law Number 5 of 1960 concerning Basic Agrarian Law, which was subsequently derived using Government Regulation Number 10 of 1961 concerning Land Registration and replaced by Government Regulation Number 24 of 1997 concerning Land Registration, Foreign nationals who have an interest in investing in Indonesia do not have a few lease agreements to lease land, especially in Bali, lease agreements in general regulations are regulated in Article 1548 of the Civil Code but because the lease period in Indonesia is not specifically regulated, So there is often a legal smuggling where a lease agreement has a long term, even indicating a lease for life. Therefore, the importance of legal certainty regarding the lease period is regulated in a law and regulation, so that in determining the period in the lease agreement still has a propriety and fairness in its implementation. Purposes of the Research: namely regarding the time limit for leasing for foreigners on land in Indonesia which needs a special regulation that is clearer and more detailed.Methods of the Research: The research method in this writing uses normative juridical legal research with a statutory approach, legal concept approach and case approach. In this thesis, the author discusses two legal issues related to legal certainty of lease time limits on freehold land in Indonesia for Foreign Nationals and legal consequences arising from the blurring of legal norms regarding arrangements related to lease time limits for freehold land in Indonesia.Results of the Research: The results showed that in terms of determining legal certainty related to the lease period for now, we can look for determining indicators regarding time limits. The consequences that arise when a lease agreement has a time limit that indicates a live well lease is a Non-Existent legal act.

Abstract

Smart contracts in blockchain systems are widely used as automated agreements that can expedite the execution of a contract. Based on the characteristics of smart contracts analyzed through agreements in the Indonesian Civil Code (BW), it can be concluded that smart contracts can be legally used in contractual legal activities in Indonesia. This is because smart contracts meet the requirements outlined in the BW as guidelines for contract formation, particularly concerning the validity of contracts. Using a normative method, which employs literature as legal material for this writing, the result shows that the validity of smart contracts in blockchain, based on Indonesian contract law, aligns with the contract law that fulfills the requirements of Article 1320 BW. Smart contracts can also be classified as standard agreements where the parties agree based on an existing and mutually agreed-upon contract. Until now, there are no specific regulations regarding smart contracts in Indonesia, even though smart contracts are already widely used in the country.

Abstract

In an international trade contract, the parties are bound by different legal provisions, different languages and also different customs and cultures. This condition creates a big risk in implementing the substance of the contract. To anticipate this risk, there are several steps that can be taken by the parties in terms of arranging and creating the contents of their contracts. This article will discuss the part of the contract that is often regulated in international trade contracts, called the boiler plate clause. This article is the result of normative research, both related to national legal norms, namely the Civil Code, Uniform law and examples of international trade contracts. A contract is a mechanism for expressing all the wishes of the parties agreed to by other parties. In current developments, contract clauses are no longer just the essentials of the agreement. There are other clauses which have the function of further clarifying how the contract must be interpreted and as an effort to cover all opportunities for contract failure, including what are called boilerplate clauses. In the practice of making international trade contracts, there are several substances that need to be regulated in boilerplate clauses, including choice of law provisions, choice of forum provisions, language provisions, severability provisions, integration provisions, notices provisions, force majeure provisions, duration of contract provisions, obligation after termination provision.

Abstract

This article analyzes the readiness of Indonesian competition law regarding the utilization of big data and reinforcement learning as tools to improve retailers' pricing strategies, ultimately leading to increased profitability and higher customer engagement and loyalty. It conducts a comprehensive review of scholarly literature pertaining to adaptive algorithmic pricing, with a specific focus on analyzing trends and the impacts of algorithmic pricing strategies. The literature review spans the years 2018 to 2022 and adheres to PRISMA criteria, with academic journals from Scopus serving as the primary source of research papers. The findings of this review indicate that it is evident that the most frequently utilized type of algorithm is RL, that shares a resemblance to human learning processes. Competition law enforcement should consider the possibility of illicit agreements between these artificial agents of colluding companies. In light of the capacity of EAs to facilitate the coordination of illicit agreement, it is imperative to consider the reformulation of Article 5 of Law Number 5 of 1999 and Regulation of KPPU Number 4 of 2011, particularly regarding the classification of price-fixing, to be adjusted to the latest developments, particularly regarding "EAs". ITE Law also should not be limited to EAs merely acting as “tools”. Instead, it should acknowledge their capacity to function as “AI Agents” capable of autonomous action.

Abstract

This study aimed to adjust the statute for foundations established before the enactment of Law Number 28 of 2004 and analyze the legal consequences for foundations established before the enactment of Law Number 28 of 2004 that did not make adjustments to the articles of association. This study used a normative juridical method with a statutory and case approach. The results showed that the purpose of adjusting the articles of association for foundations that were established before the enactment of Law Number 28 of 2004 was to obtain recognition as a foundation, either technically or administratively. The legal consequences for foundations that were established before the enactment of Law Number 28 of 2004 that did not make adjustments to the statute were in the form of losses due to loss of previous history and wealth in the form of assets that had been obtained by the foundation so that the foundation became like a new foundation.

Abstract

the purpose of writing this article is to discuss the urgency of arranging a written Umrah departure agreement. The study uses a normative juridical method with a statutory approach and an analytical approach. Law Number 18 of 2019 concerning the Implementation of the Hajj and Umrah Pilgrimage does not require written agreements so that problems often arise that are detrimental to the congregation. Collaboration between the bureau and the umrah congregation can run smoothly if the agreement is implemented in writing. This is to reduce the risk of fraud or other things that could harm one or both parties. A written agreement provides more legal certainty and protection to the parties which is used as a guide for the bureau and the congregation to act in accordance with what was promised

Abstract

This study aims to analyze the criteria for the dismissal of Land Deed Officials (PPAT) based on health conditions from a justice perspective. The method used is normative legal research with a statutory and conceptual approach, analyzed using a perspective analysis through grammatical and systematic interpretation methods. The results of the study show that the rules for dismissing PPATs due to health reasons refer to Article 10 paragraph (2) letter b of Government Regulation Number 24 of 2016. This regulation does not provide a health recovery period for PPATs, unlike the provisions in the Notary Position Law which grants a three-year recovery period. In conclusion, this regulation creates the potential for injustice for PPATs due to the absence of an opportunity to recover before being dismissed. Regulatory changes are needed to create a balance between public interest and the protection of individual rights.
