Abstract

Women farm workers in groups are not common in Minangkabau, especially those who earn wages once a year. The wages are used as an alternative income by allocating them as a capital for other ‘business’ in solving economic household problems. Minangkabau implement matrilineal system which respect women called as bundo kanduang. A local proverb for the system is “limpapeh rumah nan gadang, amban puruak pagangan kunci, sumarak dalam nagari”. Discussions about women have not been finished yet.  The highest reward toward women in Minangkabau custom is not well-implemented in the real life. The Minang ‘queens’ are allowed to compete in economic sector without any gender consideration. Buruh tani wanita panggilan di Minangkabau secara umum tidak lazim ada, apalagi mereka yang mendapatkan upah setahun sekali. Yang lebih menarik lagi, upah yang mereka terima kemudian dijadikan sebagai modal usaha untuk mengatasi ekonomi rumah tangga. Di Minangkabau, posisi perempuan mendapatkan tempat yang terhormat, sebagaimana yang diungkapkan dalam pepatah “bundo kanduang limpapeh rumah nan gadang, amban puruak pagangan kunci, sumarak dalam nagari”. Pembicaraan tentang perempuan hingga hari ini tidak kunjung berhenti. Penghargaan tertinggi kepada perempuan di Minangkabau secara adat tidak tercermin dalam kehidupan nyata. “Ratu-ratu” Minang ini dibiarkan berkompetisi secara bebas dalam pertarungan ekonomi yang tidak melihat jenis kelamin.

Abstract

How could if being a Moslem without the Qur’an, it is inspiring in every aspect. It also opened the space layered intrepretation of each generation. Al Qur’an is a baseless and endless sea. Al Qur’an also talks about begging which for some people is a contemptible act. Allah emphasized people not to beg or ask too much with another. The only place to ask is just to almighty rich (Allah/God). The realization of the hard work’s importance -without raise your hand to others- is exemplified by the Messenger of Allah (Allah). he’s poverty (since childhood) does not make him a beggar. Hard work and optimism became an inseparable part of his pride. Disaster or calamity that given by God in any form, should not make a people be a a pessimist and beg the others without shame. Moreover, making the “begging” as a sustainable productive enterprises in various ways.

Abstract

The neglect of the poor is an indicator of the government’s failure in carrying out their functions as protectors of the people, especially in connection with the fulfillment of basic rights such as food, clothing, housing, education and health. The emergence of the poor society is not merely a failure of the low­level society, but also as the impact of uneven distribution policy. Rasul and his companions through their monetary policy provide economic protection for the poor from various country incomes. The sensitivity of poverty was not only shown for the Islamic society but also non­Islamic groups who needed help. Various programs of “anti­poverty” were conducted as a manifestation to protect the lower class.

Abstract

In Minangkabau may not be the only custom that occurs Salingka Nagari, but each country has its unique features. This article describes the religious value of the Datuk burial process in Minangkabau. This study investigates the religious values in the traditional ceremony of the death of a Datuk called Osong Kapali. This study uses qualitative research with data collection using interviews and documentation methods. The first ceremony of Osong Kapali begins with baretong, mangkaji adaik, mancabiakan shroud, Osong Kapali, installation of adaik cloth, maroncak, natural speech, Manigo Ari. In the procession of Adat Osong Kapali there are religious values such as the value of worship, generosity, the value of trust and the value of gratitude for abun and sustenance.

Abstract

Pre-employment program jockey is an agent who seeks a job for the community and obtains a fee from the services. The practice is particularly carried out related to the pre-employment card program launched by the government in 2020. This article describes the practice of pre-employment jockey and to analyze sharia economic law review on the profit. This article implemented qualitative research. The primary data were obtained through interview, observation and documentation, while the analysis was conducted descriptively. The research reveals that the jockey practice has assisted people to register pre-employment card program in 2020. The assistance consisted of account registration, training, and filling survey. The incentive given to the approved people is IDR 3.550.000 but the transparency about the exact number is not precisely informed to the account owner. It can be more than the said amount or, even worse, the jockey got more incentive. This is inappropriate in sharia economic law. Ijarah principles are not applied here because there is no transparency, the willingness of account owner and justice; instead, the service contains ghulûl (corruption) and gharâr (scam) done by the jockey since what they did can be included as treason.

Abstract

Through an examination of the evolution of Imam Shafi'i's philosophy, this paper investigates the sociological distinctions between Qaul Qadim and Qaul Jadid in Islamic legal theory. Although Qaul Jadid is a modification of his views after he went to Egypt, Qaul Qadim refers to the legal opinions he presented while in Iraq. The purpose of this study is to identify the social, political, and cultural factors that shaped the change in Qaul Qadim to Qaul Jadid philosophy. This study analyzes the text and applies a historical approach as a qualitative technique. The findings indicated that in addition to regional variations, certain social and cultural shifts in Egypt necessitated amendments to the legislation to make it more relevant to the local population. The adaptability and flexibility of Islamic law in reaction to societal circumstances are highlighted by this research. It strengthens the debate on the evolution and dynamics of Islamic legal thinking and confirms the need for contextualization in the implementation of shari'ah law. Therefore, the knowledge of how Islamic law evolves and remains applicable in different social situations is greatly advanced by this study. Furthermore, a deep grasp of Qaul Jadid and Qaul Qadim supports Islamic law practices in addressing the issues of the modern world. It facilitates their guaranteeing the validity and relevance of sharia law in the many modern situations.

Abstract

The tradition of khatam al-Qur’an in Minangkabau represents a synthesis of Islamic principles and indigenous customs, forming a unique cultural framework. Its manifestation varies distinctly between the Minangkabau heartland and its peripheral (rantau/Minangkabau migrants living outside their homeland) regions. On one hand, some practices lean heavily toward Islamic orthodoxy; on the other, they are steeped in customary traditions. Numerous studies have explored the tradition of khatam al-Qur’an in Indonesia, but those within the discourse of custom and Islam in Minangkabau has received relatively little scholarly attention. Therefore, this research seeks to explore the dialectic between Islam and adat (customs) in the celebration of khatam al-Qur’an whether the two remain irreconcilable, like oil and water, or harmoniously blend within the socio-religious life of the Minangkabau people. Employing a normative qualitative approach, this research positions Islam as the benchmark for evaluating the authenticity of khatam al-Qur’an as practiced across Minangkabau society. Data were gathered through fieldwork in both luhak (core regions) and rantau (diasporic extensions) of West Sumatra. The luhak such as Tanah Datar, Agam, and Lima Puluh Kota represent the cultural and historical epicenters of Minangkabau, while the rantau including Padang, Pasaman, and other peripheral areas signify its expansion. Insights were drawn from in-depth interviews with individuals directly involved in the khatam al-Qur’an festivities. Findings reveal that the tradition is observed across all Minangkabau territories. In the rantau, the ceremonies are generally modest and restrained. Conversely, in the core regions, especially Agam, Tanah Datar, and Lima Puluh Kota, the events are marked by grandeur and solemnity, sometimes at the expense of Islamic values—evident in practices such as the excessive makan bajamba (communal feasting) and parades that obstruct public roads. Khatam al-Qur'an ceremonies should be restructured into purposeful events that foster religious devotion and community unity, with active support from religious leaders, educators, and local authorities. Tradisi khatam al-Qur'an di Minangkabau merupakan perpaduan antara prinsip-prinsip Islam dan adat istiadat setempat, yang membentuk sebuah kerangka budaya yang unik. Manifestasinya sangat bervariasi antara daerah pusat Minangkabau dan daerah pinggirannya (rantau/perantau Minangkabau yang tinggal di luar kampung halamannya). Di satu sisi, beberapa praktiknya sangat condong pada ortodoksi Islam; di sisi lain, praktik-praktik tersebut sangat kental dengan tradisi adat. Banyak penelitian telah mengeksplorasi tradisi khatam al-Qur’an di Indonesia, namun kajian dalam wacana adat dan Islam di Minangkabau masih relatif sedikit mendapat perhatian akademis. Oleh karena itu, penelitian ini berusaha mengeksplorasi dialektika antara Islam dan adat dalam perayaan khatam al-Qur'an. Apakah keduanya tetap tidak dapat didamaikan, seperti minyak dan air, atau berpadu secara harmonis dalam kehidupan sosial-keagamaan masyarakat Minangkabau. Dengan menggunakan pendekatan kualitatif normatif, penelitian ini menempatkan Islam sebagai tolok ukur untuk mengevaluasi keaslian khatam al-Qur'an yang dipraktikkan dalam masyarakat Minangkabau. Data dikumpulkan melalui penelitian lapangan di luhak (daerah inti) dan rantau (daerah perantauan) di Sumatera Barat. Luhak-luhak tersebut-seperti Tanah Datar, Agam, dan Lima Puluh Kota-mewakili pusat-pusat budaya dan sejarah Minangkabau, sementara rantau-termasuk Padang, Pasaman, dan daerah-daerah periferi lainnya. menandakan perluasannya. Wawasan ini diperoleh dari wawancara mendalam dengan orang-orang yang terlibat langsung dalam perayaan khatam al-Qur'an. Temuan-temuan menunjukkan bahwa tradisi ini dilaksanakan di seluruh wilayah Minangkabau. Di rantau, upacara-upacara yang dilakukan umumnya sederhana dan terkendali. Sebaliknya, di daerah inti, terutama Agam, Tanah Datar, dan Lima Puluh Kota, perayaan ini ditandai dengan kemegahan dan kekhidmatan, terkadang dengan mengorbankan nilai-nilai Islam-terlihat dari praktik-praktik seperti makan bajamba yang berlebihan dan pawai yang menghalangi jalan raya. Perayaan khatam al-Qur'an perlu direstrukturisasi menjadi acara yang bermakna untuk menumbuhkan kesalehan religius dan mempererat persatuan komunitas, dengan dukungan aktif dari para pemuka agama, pendidik, dan otoritas lokal.

Abstract

This study investigates the existence and practice of customary criminal justice in resolving moral offenses within the Mentawai community. Using a field research design with a qualitative approach, primary data were collected through direct observation, in-depth interviews with customary leaders (sikerei), village elders, and community members, as well as focus group discussions conducted in several Mentawai villages. Secondary data were also gathered from local records, case documentation, and previous studies to provide supporting evidence. The findings indicate that the Mentawai customary justice system remains actively practiced and widely trusted by the community, particularly in cases involving sexual harassment, adultery, and premarital relations. Sanctions applied through tulou emphasize reconciliation, compensation, and restoration of social harmony rather than strict punishment. Observations show that these customary mechanisms are perceived as more accessible, effective, and socially relevant compared to the formal criminal justice system, which is often viewed as distant and bureaucratic. The research also highlights the processes, interactions, and roles of community members, demonstrating how customary justice functions as a practical, community-based mechanism for resolving moral disputes. Field evidence reveals the enforcement procedures, decision-making practices, and participation of key actors in the customary process. The study contributes empirically by documenting the ongoing use and social acceptance of indigenous legal practices in Mentawai. Its findings provide valuable insights into how customary criminal justice operates in everyday life, offering data-driven perspectives for understanding the functioning, resilience, and social legitimacy of local legal institutions.
