Abstract

Increased awareness of environmental issues is leading to the introduction of environmental education. This article discusses some of Indonesian legislations that accompany the introduction and development of environmental education. Research results concluded that environmental education has been mandatory in various Indonesian legislations which has? been observed with vertical and horizontal synchronization, in accordance with the purpose and scope of the environmental protection and management in article 3 and article 4 of Act Number 32 the year 2009.

Abstract

The method used in this research is normative juridical approach is prescriptive to examine the sources of literature relevant to the theme of research, including research on the general principles of law, legislation, as well as provisions on the cash receipts from the tax sector property. Implementation of the UN tax collection and BPHTB include data collection, assessment, determination, administration and comprehensive services, of course this is not easy and has many obstacles. The obstacles encountered in the area of property tax collection comes from internal and external side. In terms of internal investment required a high cost in the provision of facilities, shortage of human resources in collecting taxes, updating the data base, while in terms of the external is the awareness of the community in paying taxes, their mode of misappropriation of law and the administration of the taxpayer, as well as the role of  notary still less than the maximum help in the collection of property taxes.

Abstract

The purpose of this study is to look at how regulations regarding forced agency (gijzeling / hostage-taking) based on Articles 209 to 224 HIR and Articles 242 to 258 R.Bg, are things that are contrary to human rights and other related regulations. Normative Juridical Approach, namely research focused on studying the application or rules or norms in positive law. There are 2 (two) data collection methods, namely the library research method and the field research method. The results and discussion through the process of developing regulations that apply to forced agency (gijzeling), at this time, this has been revived with the enactment of the Supreme Court Regulation (PERMA) No. 1 of 2000 concerning Forced Institutions, and has been absorbed by the bankruptcy law itself. The issuance of this regulation created the birth of a situation regarding the regulation of the problem of detention of a debtor in Indonesia, which in general has been regulated in Law No. 8 of 1981 concerning Criminal Procedure Law, it is necessary to have restrictions such as what to implement these two regulations, so that it becomes a differentiator in its enforcement.

Abstract

Transportation Agency is an organization that serves to held public services in road freight traffic. One of the programs the Department of Transportation that is the setting of public transport (people) through the testing of motor vehicles. Given the need for transport is a top priority in fulfilling the needs of daily life - a good day for work, school, college, and the other, the number of accident victims bring people, besides the risk of air pollution was inevitable. It was all no existence apart from motor vehicles both for public transport and private interests.

Abstract

This article or writing aims to reveal the form of solidarity of the Madurese community in Watu Ulo Hamlet in the Pethik Laut tradition/ceremony. Researchers took this location as a research point because based on previous research, the literature on social solidarity in traditional community traditions is still limited. In addition, the researchers also studied the Pethik Laut in Watu Ulo Hamlet, Ambulu, Jember because so far the research on the Pethik Laut in Jember is still small. The problem is focused on the form of social solidarity of the Madurese community in Watu Ulo when carrying out this tradition. To approach this problem, Emile Durkheim's theoretical reference on the concept of social solidarity is used. The data were collected through the synthesis of online interviews and literature study, and analyzed qualitatively. This study concludes that attachment to values and social reality also forms solidarity. For example, there is a form of social solidarity among the Madurese in this tradition, namely solidarity in determining and preparing ceremonies, such as withdrawing funds, making food, and managing activities. Thus, the social solidarity of the Madurese community is included in the Durkheim type of mechanical solidarity.

Abstract

ABSTRAKPenelitian ini merupakan penelitian yuridis normatif dan bersifat deskriptif analitis menggunakan pendekatan perundang-undangan (statute approach), dengan memaparkan serta menganalisis peraturan-peraturan dan pasal-pasal yang berisi kaidah-kaidah hukum yang mengatur tentang pengawas ketenagakerjaan, reposisi dari pengawas ketenagakerjaan dari kabupaten/kota ke provinsi, serta dalam pengawasan dalam penegakan undang-undang ketenagakerjaan khususnya di Provinsi Sumatera Utara.Hasil penelitian disimpulkan, bahwa reposisi pengawas ketenagakerjaan di Indonesia terjadi sejak berlakunya UU No.23 Tahun 2014 tidak bertentangan dengan kaidah hukum yang ada, pelaksanaan penegakan Undang-Undang Ketenagakerjaan di Sumatera Utara dilakukan dengan adanya penggunaan upaya hukum, termasuk hukum pidana, salah satunya untuk mengatasi masalah sosial. Provinsi Sumatera Utara membuat beberapa kebijakan dalam penyelanggaraan penegakan hukum, salah satunya adalah dengan dibentuknya Unit Pelaksana Teknis (UPT) di Provinsi Sumatera Utara berdasarkan pada Peraturan Gubernur Sumatera Utara Nomor 59 Tahun 2018 tentang Tugas, Fungsi, Uraian Tugas dan Tata Kerja Dinas Tenaga Kerja Provinsi Sumatera Utara Pasal 2 ayat (4). Oleh karena itu, di Provinsi Sumatera Utara terdapat enam (6) wilayah UPT yang ada di beberapa kabupaten/kota. Selain itu ada beberapa faktor penghambat, salah satunya yakni faktor sumber daya manusia, serta agenda perbaikan dalam penyelenggaraan pengawasan ketenagakerjaan di Provinsi Sumatera Utara untuk meningkatkan efektivitas penyelenggaraan penegakan Undang-Undang Ketenagakerjaan di Provinsi Sumatera Utara, salah satunya yaitu dengan penguatan sumber daya.Kata Kunci : Pengawasan, Penegakan, UU Ketenagakerjaan, di Provinsi Sumatera Utara

Abstract

PT INALUM (Persero) is in reality a BUMN. Differences in the application of Article 9 paragraph (3) of North Sumatra Governor Regulation no. 24 of 2011 with other BUMN will cause discrimination related to calculation of surface water tax. Based on this, PT INALUM (Persero) filed an objection to the Provincial Government of North Sumatera on the SKPD issued and subsequently rejected through the Letter of Objection. The Letter of Objection Resistation, PT INALUM (Persero) filed an appeal to the Tax Court and is still in court process.

Abstract

A notary is obliged to report any changes of his registered office address to the Regional Supervisory (henceford refrered to as MPD). Pursuant to the regulations of the Minister of Law and Human Right Number 15/2020 on the procedures of inspections by supervisory council, MPD gives a notary a minimum of 1 (one) regular visit a year. This Research is encouragedby the experience service user who misses out a notary’s new office address to MPD. This Research problems are how to changes to a notary’s registered office address are regulated by the law, how legal sanctions are regulated by the law to a notary for not reporting changes to his registered office address, and what efforts are made by MPD to enforce the law against any notary who does not report changes of his registered office address. Emprirical Normative research method is employed as this research studies primary legal materials such as the Law Number 4/2014, the Regulations of Minister of Law and Human Right Number 19/2019, and the Minister of Law and Human Right Number 61/2016, as well as references and secondary materials supported with interviews with informans. The objective of this research are to investigate and to analyse the laws and to a notary for not reporting changes of his registered office address, and the efforts made by MPD to enforce the againsts any notary who does not report changes of his registered office address. The research concludes that the obligation of a notary to report changes to his registered office address is specified in Regulations of the Minister of Law and Human Right Number 19/2019 and the other notar;s obligations are stipulated in the Law on Notary Functions. The imposition of sanction such as a registered office address is obstructed by the long-winded bureaucracy causing difficulties to MPD in supervising notaries and enforcing the fulfilment of laws and regulations concerning notary’s obligations be synchronized, bureaucracy process to impose the sanction of written deterrant to notaries be steamlined, facilities and insfrastucture required by MPD to perform their duties be completed, and double functions of members of MPD be avoided that the supervision over notaris can be more optimal.

Abstract

Village-Owned Enterprise (henceforth referred to as BUM Desa) as one of rural development programs is established grounded on Village Regulations (henceforth referred to as Perdes), yet its operating activities such as opening a bank account and registering a taxpayer identification number requires a notarial deed its establishment, and so does Mencirim Mandiri and Annur BUM Desa. This research analyzes the roles of a notary related to legality of establishment of Mencirim Mandiri BUM Desa in Sei Mencirim Village and Annur BUM Desa in Purwodadi Village. This research employs normative juridical method. It uses secondary data supported by primary data collected through library study and interview and analysed by qualitative analysis method. The legal grounds for establishment of BUM Desa are Law No. 6/2014 on Village, Law No. 11/2020 on Job Creation, and Government Regulation No. 11/2021 on BUM Desa. BUM Desa can be established grounded on Perdes and is registered electronically. The legal grounds for a notary are not stipulated in Law No. 11/2020 on Job Creation and Government Regulation No. 11/2021 on BUM Desa in term of establishment of BUM Desa, yet as a public official, a notary plays a role in drawing the deeds of establishment of units of BUM Desa. Mencirim Mandiri and Annur BUM Desa were initially established grounded on Village Regulations. The organizers of BUM Desa encounter obstacles to take legal actions with other parties as they require a notarial deed. A notary actually plays a role concerning the units of BUM Desa, in form of legal entities, in line with Government Regulation No. 11/2021 on BUM Desa. It is suggested that Government socialize the Law on Job Creation related to BUM Des and Government Regulation No. 11/2021 on BUM Desa to relevant parties, so that they, particularly the BUM Desa in Sunggal Subdistrict, will properly implement the prevailing laws and regulations and will not mistake the legal entities of BUM Desa from private legal entities.

Abstract

A notary as a general official who makes the deed is given the authority to legalize an underhand deed for every appearer who comes to him. Legalization carried out by a Notary basically must be carried out with the principle of prudence in order to avoid legal conflicts that have the potential to be present in the legalization of the deed. Examples of legal issues related to the legalization of private deeds can be seen in decision number 598 K/PDT/2017. The decision stated that the Notary had committed an unlawful act against the legalization of the sale and purchase agreement letter of the kiosk which was basically a joint property in which one of the parties was not involved in the sale and purchase agreement of the kiosk. Thenotary in the decision number 598 K/PDT/2017 can be observed that for his negligence in determining the objective conditions of the contents of the agreement, the judge was decided to commit an unlawful act by the judge on the basis of Article 1365 of the Civil Code. The precautionary principle is the standard of assessment in determining that a notary has committed an unlawful act in legalizing a sale and purchase agreement. The legal force of legalizing a letter of sale and purchase of a kiosk that is legally flawed is that the deed does not have perfect proving power. The parties who play a role in causing harm to the plaintiff for the sale and purchase must be categorized as parties who commit acts against the law for the sake of legal certainty as referred to in Article 1365 of the Civil Code
