Abstract

Entering the era of MEA, HR Indonesia absolutely must be improved in order to be on par with SDM countries in the ASEAN region. Socio-cultural aspects necessary for the development of human resources (HR) through education. With hope, when the ASEAN community-level human resources is equivalent (equal), will furtheraccelerate economic integration as the main pillars of the ASEAN Community.Therefore, it is important the holding of the ASEAN countries to increase cooperation in the field of education. This cooperation is to improve the quality of human resources, especially pupils and students in the ASEAN region. This study discusses the regulatory history of education in Indonesia and the implementation of the regulations of national education to develop human resources capable of competing in the MEA.

Abstract

AbstractThis study aims to determine how the implementation of the provision of leave rights for pregnant women workers by companies, one of which is an ice cream company in Bekasi and what form of legal protection is provided by the government to protect pregnant women workers if their leave rights are not fulfilled. This study on cases of miscarriage and infant mortality at an ice cream company in Bekasi is the basis for research on how to apply the provision of leave rights and protection for pregnant women workers in these companies in accordance with Law Number 13 of 2003 concerning Manpower. The method used by the researcher is the normative juridical method that is included in the interview, focusing on legal provisions such as laws, and literature related to legal protection of workers after which it is linked to the case that is the subject of the review. The results showed that the rights granted by ice cream companies to pregnant women workers regarding reproductive rights, namely the right to leave are in accordance with statutory provisions and the status of workers as indefinite time workers or permanent workers, only the implementation is still not in accordance with the provisions. Law No.13 of 2003 concerning Manpower, this is influenced by the absence of a collective labor agreement (PKB) between employers and workers / labor unions which makes workers not know exactly what rights and obligations are obtained outside of Law No.13-2003 so that workers or laborers suffer losses because they cannot get their rights in full. Legal protection provided by Law No.13-2003 is in the form of criminal sanctions and / or fines imposed on employers who violate statutory provisions. The form of legal protection for pregnant women workers is the provision of rights and obligations.Keywords: legal protection; pregnant women workers; reproductive rightsAbstrakPenelitian ini bertujuan untuk mengetahui bagaimana penerapan pemberian hak cuti bagi pekerja perempuan hamil yang dilakukan oleh para perusahaan salah satunya adalah perusahaan es krim di Bekasi serta bentuk perlindungan hukum apa yang diberikan pemerintah untuk melindungi para pekerja perempuan hamil jika tidak terpenuhi hak cuti nya. Kajian mengenai kasus keguguran dan kematian bayi pada perusahaan es krim di Bekasi ini menjadi dasar penelitian bagaimana penerapan pemberian hak cuti dan perlindungan bagi pekerja perempuan hamil pada perusahaan tersebut sesuai dengan Undang-Undang Nomor 13 Tahun 2003 tetang Ketenagakerjaan. Metode yang dipakai oleh peneliti ialah metode yuridis normatif yang disertakan oleh wawancara, berfokus pada ketentuan hukum seperti undang-undang, dan literatur-literatur berhubungan dengan perlindungan hukum terhadap pekerja setelah itu dihubungkan dengan kasus yang menjadi pokok ulasan. Hasil penelitian menunjukkan bahwa pemberian hak yang dilakukan oleh perusahaan es krim terhadap pekerja perempuan hamil mengenai hak reproduksi, yaitu hak cuti nya sudah sesuai dengan ketentuan perundang-undangan dan status pekerja sebagai pekerja waktu tidak tertentu atau pekerja tetap, hanya penerapannya masih belum berjalan sesuai ketentuan Undang-Undang No.13 Tahun 2003 tentang Ketenagakerjaan hal ini dipengaruhi oleh tidak adanya perjanjian kerja bersama (PKB) antara pengusaha dengan organisasi serikat pekerja/buruh yang menjadikan buruh tidak mengetahui secara pasti hak dan kewajiban apa yang didapatkan diluar dari UU No.13-2003 sehingga pekerja atau buruh mengalami kerugian karena tidak dapat mendapatkan hak nya secara penuh. Perlindungan hukum yang diberikan oleh UU No.13-2003 berupa sanksi pidana dan/atau denda yang dijatuhkan kepada pihak pengusaha yang melanggar ketentuan perundang-undangan. Bentuk perlindungan hukum bagi pekerja perempuan hamil berupa pemberian hak dan kewajiban.

Abstract

National development carried out so far has been an ongoing development effort in order to create a just and prosperous society based on Pancasila and the 1945 Constitution. To achieve this goal, the implementation of development, including in the economic and financial fields. Economic activities that occur in society are essentially a series of extraordinary legal actions of various types, varieties, qualities and variations that are carried out between individuals, between companies, between countries and between groups in various volumes with high frequency at any time in various places. The role is good in terms of collecting funds from the community and channeling available funds to finance existing economic activities. Many forms of crime are committed within the scope of a country, whether committed by individuals or corporations. This form of crime produces considerable wealth, such as corruption, smuggling of goods or labor, embezzlement, narcotics, gambling, tax crimes, and so forth. In order not to reveal who is the perpetrator, the assets obtained from the above crimes are hidden from the origin by entering the assets into the financial system, especially in the banking system. This form is called money laundering. In this writing, the author wants to formulate a problem statement that will be discussed, namely concerning the role of banks in preventing money laundering. In this section the methods of conducting research is normative juridical. The role of banking institutions to prevent and detect the flow of dirty money that tries to enter the financial system.

Abstract

 Keadaan pandemi Covid-19 sebagai bencana non alam dan terjadi secara kebetulan, menimbulkan hubungan hukum atas pemenuhan prestasi perjanjian yang mengikat antara dua pihak. Hal demikian membuat permintaan akan oksigen meningkat. Penelitian ini dimaksudkan untuk melihat dan menganalisis mengenai tidak terpenuhinya prestasi pada suatu perjanjian jual beli oksigen selama masa pandemi yang termasuk ke dalam keadaan memaksa serta akibat hukum dalam penerapan keadaan memaksa dalam perjanjian jual beli oksigen di masa pandemi. Kebutuhan oksigen dalam masa pandemi Covid-19 merupakan suatu kebutuhan pokok atau primer yang penggunaan-nya tidak dapat digantikan oleh barang lain. Metode penelitian ini adalah Normatif Yuridis dilengkapi dengan wawancara dari distributor oksigen dengan kajian dari regulasi serta literatur terkait. Objek penelitian adalah perjanjian jual beli oksigen yang terjadi pada masa Covid-19. Kesimpulan penelitian ini menunjukan bahwa sesuai Keppres 12/2021, keadaan memaksa relatif dapat dijadikan alasan atas tidak terpenuhinya prestasi pada perjanjian jual beli oksigen pada masa pandemi Covid-19. Akibat hukum keadaan memaksa relatif membuat produsen tidak dapat dituntut ganti rugi dari wanprestasi karena hal tersebut terjadi diluar kendali manusia.Kata-Kunci: Kelangkaan Oksigen, Covid-19, Perjanjian, Keadaan Memaksa.The Covid-19 pandemic is a non-natural disaster that accidentally happened also creates a legal relationship of fulfilment for the binding agreement between the two parties. That makes the demand for oxygen increasing. This research aimed to see and analyze the non-fulfillment of achievements in an oxygen sale and purchase agreement during the Pandemic period which is included in Force Majeure as well as consequences the law in application of circumstances coerced into agreement during the pandemic. The need for oxygen during the pandemic is basic or primary and unable replaced by other goods. Various policies issued by distributors, oxygen suppliers and the government aimed to overcome oxygen scarcity for meeting people's needs, even though still not maximized yet. This research method is Normative Juridical with a review of statute, literature and supported by interviews with oxygen distributors. The object of research is the purchase contract that occurred during the Covid-19 period. This study shows that according to Presidential Decree 12/2021, the relative Force Majeure  can be used as an excuse for not fulfilling achievements in the oxygen purchase agreement during the Covid-19 pandemic. The legal consequences of the relative Force Majeure make producers unable to be sued for compensation from defaults because it occurs beyond human control.Keywords: Oxygen Scarcity, Covid-19, Contract, Force Majure

Abstract

Dalam dunia jual beli Online sering terjadi pelanggaran terhadap konsumen. Pelanggaran yang sering terjadi melalui platfrom E-commerce. E-commerce merupakan bentuk perdagangan yang mempunyai karakteristik tersendiri yaitu tidak bertemunya penjual dan pembeli, dengan menggunakan media internet. Menurut Pasal 1 angka 2 Undang-undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen yang dikatakan konsumen adalah seorang yang pemakai barang dan jasa yang tersedia dilingkungan masyarakat, baik dari kepentingan pribadi, keluarga mapun orang lain. Salah satunya adalah kasus Pembelian masker secara online di marketplace, metode yang digunakan dalam penelitian ini adalah metode pendekata yuridis normatif karena penelitian hukum ini menggunakan data sekunder yang berasal dari bahan hukum primer maupun bahan hukum sekunder. Hasil penelitian ini menyatakan bahwa dalam undang-undang perlindungan konsumen Seharusnya pelaku usaha sadar bahwa konsumen marketplace dilindungi oleh Undang-undang, dengan adanya undang-undang tersebut diharapkan pengguna marketplace mendapatkan barang yang dibeli dari plafrom online marketplace dengan mutu berkualitas sehingga tidak lagi ada lagi kasus yang merugikan pengguna marketplace.

Abstract

The world is currently facing the same problem, namely the coronavirus or Covid 19. During this pandemic, all sectors of the economy are very influential on survival.  The existence of Large-Scale Social Restrictions (PSBB) has caused people to panic buying. So, in other words, there has been a new problem, carrying out the activities of hoarding staple food carried out by entrepreneurs, suppliers, and traders. The hoarding results in losses to the community or business actors. By conducting juridical normative research methods based on applicable laws and regulations, law enforcement is needed to realize justice, certainty, and benefits. The policy in tackling the crime of food hoarding in Indonesia has been regulated in Law Number 18 of 2012 concerning Food and Law Number 7 of 2014 concerning Food. Moreover, it has also regulated in Government Regulation No. 17 the Year 2015 on Food Security and Nutrition, which regulates the mechanism, procedure, the maximum amount of staple food storage by businesses. Business actors who deliberately hoard food may be sentenced to imprisonment for a maximum of 7 (seven) years or a maximum fine of Rp. 100,000,000,000.00 (one hundred billion rupiah). It can be concluded that criminal law policy-related efforts to combat the crime of hoarding of food have been regulated in the Law of Food and Trade Act.

Abstract

Komunikasi merupakan hal mendasar yang melekat pada diri manusia dan memiliki peranan penting dalam kehidupan manusia. Dalam komunikasi massa, televisi merupakan salah satu media massa yang umum digunakan dan merupakan media massa yang efektif karena memiliki sifat audio-visual. Televisi kini menjadi bagian yang tidak dapat dipisahkan dari kehidupan manusia. Dari banyak program acara televisi Indonesia, sinetron masih tetap menjadi primadona banyak pemirsa. Hampir setiap televisi nasional di Indonesia menayangkan program acara sinetron dengan berbagai judul andalan. Gambaran tentang adegan kekerasan di televisi lebih merupakan pesan simbolik tentang hukum dan aturan. Dengan kata lain, perilaku kekerasan yang diperlihatkan di televisi merupakan refleksi kejadian di sekitar kita. Tujuan pengabdian kepada masyarakat ini adalah memberikan pengetahuan dan wawasan kepada masyarakat mengenai siaran televisi yang dapat memengaruhi perilaku anak. Dengan demikian, pengabdian kepada masyarakat ini diharapkan dapat meningkatkan pemahaman serta kesejahteraan masyarakat ketika telah mengetahui upaya pencegahan terhadap siaran televisi yang mengandung perilaku bullying.

Abstract

Abstrak: Undang-Undang Republik Indonesia Nomor 36 Tahun 2009 tentang Kesehatan, menegaskan bahwa pemerintah membutuhkan imunisasi dan memiliki peran penting dalam menjaga kesehatan masyarakat, salah satu upaya yang dilakukan dengan pemberian vaksin. Terkait hal ini, orang menjadi takut dan bahkan menolak untuk divaksinasi. Dengan diselenggarakannya pendampingan ini akan meningkatkan kepedulian masyarakat untuk mengikuti vaksinasi yang diselenggarakan pemerintah. Adapun beberapa hoaks yang disebarkan adalah suntikan vaksin pada pria harus di penis, vaksin covid-19 dapat merekayasa genetika, mati, memusnahkan penduduk asli, mengandung sel vero dari monyet hijau Afrika dan hanya Indonesia yang memesan vaksin Covid-19. Sasaran kegiatan pelayanan ini adalah masyarakat Kelurahan Pangkalan Jati, Kota Depok. Di mana sejumlah komunitas ini mulai terpengaruh oleh hoaks tentang negatifnya vaksin Covid-19 Metode yang digunakan dalam pelaksanaan pengabdian pada masyarakat ini merupakan kombinasi antara pendidikan masyarakat dan dialog. Hasil survei di Kelurahan Pangkalan Jati Bantuan Dampak UU Penolakan Vaksinasi selama Pandemi Covid 19 menunjukkan pemahaman peserta tentang dampak hukum penolakan vaksinasi menyentuh angka sempurna sebesar 100%. Serta survei lainnya menunjukkan bahwa kesediaan peserta untuk mengikuti vaksinasi adalah 92,3%. Abstract: Law of the Republic of Indonesia No. 36 of 2009 on Health, affirms that the government needs immunization and has an important role in maintaining public health, one of the efforts made by giving vaccines. The target of this service activity is the community of Pangkalan Jati Village, Depok City. Where a number of these communities began to be affected by hoaxes about the negative Covid-19 vaccine The method used in the implementation of community service is a combination of community education and dialogue. The results of the survey in Pangkalan Jati Village Helped The Impact of Vaccination Rejection Law during the Covid 19 Pandemic showed participants' understanding of the legal impact of vaccination rejection touched a perfect figure of 100%. As well as other surveys showed that the willingness of participants to take vaccinations was 92.3%.

Abstract

The price policy is an inseparable part of business competition. The price policy is not solely related to efforts to maintain prices or even control prices at a certain level but is an effort to generate profits that are proportional to social welfare. Since the entry of business competition regulations in Indonesia, with the increase in airline business actors, the competition between them has become more profitable for consumers. With high competition and competitive prices, airlines, especially national airlines, show that the target of this airline is the middle market share. In this paper, we will discuss the determination of the lower tariffs for air transportation issued in the Regulation of the Minister of Transportation of the Republic of Indonesia and regarding its application and impact on consumers and business actors in the aspect of business competition. Research result The stipulation of the lower limit rate stipulated in the Regulation of the Minister of Transportation Number 14 of 2016 is basically against the provisions of the business competition law, particularly about the prohibition on price-fixing as regulated in Article 5 Paragraph (1) of Law No. 5/1999. The effect of Regulation of the Minister of Transportation Number 14 of 2016 on airline business actors and consumers, among others, is that the freedom of business actors to determine their fares is reduced, this results in not achieving price efficiency.

COMMUNITY ASSISTANCE IN PANGKALAN JATI VILLAGE REGARDING THE LEGAL IMPACT OF REFUSAL TO VACCINATION DURING THE COVID-19 PANDEMIC. Law of the Republic of Indonesia No. 36 of 2009 on Health, confirms that the government requires immunization and has an important role in maintaining public health, one of the efforts made by the provision of vaccines. In relation to this, people become afraid and even refuse to be vaccinated. As for some hoaxes that are spread is injections of vaccines in men must be in the penis, covid-19 vaccine can engineer genetics, die, exterminate the indigenous population, contain vero cells from african green monkeys and only Indonesia ordered the Covid-19 vaccine. This is the basis of the community's assistance, because of the many fake news (Hoaxes) that are spread massively. The news is spread through whatsapp group, facebook and various other applications. The method used in the implementation of worship in this society is a combination of community educationand dialogue. Community service activities are carried out starting from the stage of preparation, implementation and evaluation. The target of this service activity is the community of Pangkalan Jati Village, Depok City. Where a number of these communities began to be affected by hoaxes about the negatives of the Covid-19 vaccine. The survey in Pangkalan Jati Village Community Assistance on the Impact of Vaccination Rejection Law during the Covid 19 Pandemic showed that participants' understanding of the legal impact of vaccination rejection touched a perfect figure of 100%. As well as other surveys showed that the willingness of participants to follow vaccination was 92.3%. This survey aims to be an indicator of the success or understanding of each participant present on the day.
