Abstract

Law enforcement containing the proportional principle is how law enforcement runs in such a way, so that it does not only enforce the normative rules (aspects of legal certainty) but also the philosophical aspects (aspects and values of justice). Functional differentiation causes law enforcement practices by law enforcement officers to be fragmented and fragmentary because each component of law enforcement has different perceptions and meanings. This has an impact on the difficulty of realizing an integrated and integrated criminal justice system because there are often conflicts of interest and differences in interpretation between law enforcement components so that the products of the judiciary have not been able to meet the expectations of the people seeking justice. So in this systematic framework, the actions of one body will affect the other bodies. Research purposes namely analyzing the harmonization between investigators and advocates in the law enforcement process and analyzing the harmonization and synchronization between law enforcers. The research method in this case combines elements of normative law which are then supported by additional data or empirical elements. The system in the criminal justice system so that in practice it will have an effect on the implementation of the criminal justice system as a whole.

Abstract

ABSTRACTThe existence of the ASEAN community and the global community, which has played an active role in the development of unstoppable, has brought various influences, both positive and negative. The people of Timor-Leste will certainly not be spared and will experience the impact of globalization. Therefore there are 2 important points that must be prepared by the government and parliament. First, the government must take anticipatory steps against transnational crimes in the era of the ASEAN Economic Community (AEC). Second, the Government and parliament must prepare adequate legal products to anticipate transnational crimes that will arise, and also carry out international cooperation to harmonization the law with ASEAN member States. In this study using a normative type of research reciting laws regarding transnational crimes. With the problems that have been explained from the beginning, it is concluded as follows: The responsibility of the government to increase the capacity of law enforcement officials, especially the police, to conduct continuous training to become professionals to combat and anticipate transnational crimes that will arise. Provide supporting facilities for police officers in carrying out their duties. conduct international cooperation among ASEAN member states to strengthen the rules of international law to combat transnational crime. Abstract

Background: The ASEAN Economic Community (AEC) serves as a platform for economic integration in Southeast Asia, aiming for broader global economic synergy. Its blueprint envisions unrestricted movement of goods, services, capital, and investment across national borders. Investment is critical in enhancing Timor-Leste's national economy. However, achieving this requires an efficient licensing bureaucracy, a conducive investment climate, and government commitment to ensuring legal certainty. Objective: This study aims to analyze the role of legal certainty in attracting foreign investment in Timor-Leste, addressing the challenges posed by the ASEAN Economic Community. Methodology: A normative approach was employed, focusing on legal norms and their role in guaranteeing investment security in Timor-Leste within the AEC framework. Findings: First, the government must establish legal certainty to ensure a secure environment for investors, with consistent implementation of existing laws. Second, the establishment of an arbitration body is essential for swift and transparent business dispute resolution, meeting investor expectations. Third, prioritizing strategic economic sectors can effectively attract foreign investment. Conclusion: Legal certainty plays a pivotal role in attracting investors to Timor-Leste. Transparent dispute resolution through arbitration and promotion of priority sectors significantly enhance the country's appeal to foreign investors.

Abstract

The implementation of the Village Head Election is also a manifestation of the community at the village level practicing direct politics. Based on Law Number 6 of 2014 concerning Villages (Village Law), the regulation of village head elections begins with nomination, voting and determination. However, the regulation regarding the resolution of disputes over the results of village head elections is not included in the Village Law. The regulation regarding disputes over the results of village head elections is stated in Article 37 paragraph (6) of the Village Law. In this article, the authority to resolve disputes over the results of village head elections is the authority of the regent/ mayor. Furthermore, regarding the time period for resolving disputes over the results of village head elections for 30 (thirty) days. This research is based on reports of disputes over village head elections. For this reason, it is necessary to resolve disputes over village head elections in accordance with procedures and laws and regulations. This research is anormative research. The results of this study are expected to be the Settlement of Village Head Election Disputes in accordance with applicable Procedures and Laws.

Abstract

Plagiarism is a detrimental act in the world of education, especially in the digital era that facilitates access to information. Technological advances make people tend to choose shortcuts by copying other people's work without mentioning the source. Plagiarism reduces critical thinking, which should be part of the learning process, and inhibits the development of creativity and intellectual abilities. This practice not only damages academic integrity, but also lowers the quality of education and the reputation of the institution. This research uses a normative legal research method that analyses the applicable legal rules and evaluates the provisions regarding plagiarism in education, especially in the digital context. This research discusses how the phenomenon of plagiarism in education reflects the lack of clear regulations regarding the threshold of plagiarism in Indonesia. This lack of clarity causes difficulties in distinguishing between legitimate use of information and plagiarism, especially in the midst of easy digital access. In addition, more sophisticated plagiarism detection technology and digital ethics education need to be strengthened as preventive measures. International co-operation is also important to address cross-border plagiarism. A holistic approach is expected to create a more honest, transparent, and integrity-based educational environment.

Abstract

Social stereotypes, both positive and negative, play an important role in shaping individual perceptions and interactions between groups in society. These stereotypes often limit social, educational, and employment opportunities for stereotyped individuals, exacerbate social inequalities, and increase discrimination. In an educational perspective, for example, stereotypes can hinder individual academic performance, especially in minority groups that are stereotyped as less capable. In the world of work, stereotypes can also affect the selection and promotion process so that stereotyped groups are often overlooked even though they have equivalent qualifications. In addition, social stereotypes exacerbate social polarization by creating greater gaps between groups and hindering the process of fairer social integration. For this reason, it is important to understand how social stereotypes can affect individual opportunities and well-being and how they contribute to existing social inequalities. This article proposes an education-based approach and inclusive policies to reduce the negative impact of social stereotypes, which is expected to encourage more positive interactions between groups and improve existing gaps in society. This study identifies the importance of deconstructing social stereotypes to create a more inclusive, fair, and equal society.

Abstract

Climate change has had a significant impact on various sectors of life, requiring the development and implementation of adaptation technology as a strategic solution. This research aims to analyze the role of adaptation technology to deal with climate change and its impact on the social and economic life of the community. Using a literature research approach, this research explores the challenges in the development of adaptation technology, the effectiveness of implementation in various sectors, and its contribution to social and economic resilience. The results show that adaptation technologies play an important role in enhancing the productivity of the agricultural sector, strengthening infrastructure against natural disasters, and creating adaptive financial systems to reduce economic risks due to climate change. Adaptation technologies also contribute to raising community awareness of climate change risks and supporting sustainable development policies. Challenges in the implementation of these technology are still great, including limited funding, gaps in access to technology, and lack of policy coordination between central and local governments. More effective strategies are needed to accelerate the adoption of adaptation technology through enhanced investment in research and development, integration of ecosystem-based policy, and active community participation in adaptation planning. With a more inclusive and evidence-based approach, it is expected that adaptation technology can provide more optimal solutions to the challenges of climate change and improve the social and economic resilience of the community

Abstract

This paper investigates the complex relationship between legal frameworks and the sustainability of digital platform business models, with a focus on application-driven start-ups in emerging digital economies. By employing a qualitative literature study and thematic synthesis, the research dissects how statutes addressing consumer protection, personal data management, and competition law affect the operational certainty and continuity of digital enterprises. Findings reveal that most legal systems are still evolving, struggling to reconcile the unique characteristics of digital commerce with outmoded legal paradigms and fragmented regulatory oversight. Inadequate harmonization, resource scarcity, and gaps in institutional capacity further exacerbate these issues, imposing substantial burdens on start-up compliance and inhibiting technological innovation. The research demonstrates that sustainable solutions require not only legislative renewal and harmonization but also active collaboration between stakeholders, ongoing capacity building, and adaptive regulatory innovation. Recommendations include modular reforms, increased emphasis on technology-driven oversight, stakeholder-inclusive policy processes, and development of regulatory sandboxes to bridge the gap between innovation and public interest. The outcomes highlight the necessity for flexible, knowledge-based, and principle-driven governance structures that support both entrepreneurial dynamism and societal protection in the rapidly shifting digital economy
