Abstract

This article aims to identify and analyze the urgency and future of fiqh legislation for halal products in Indonesia. In addition, this article also aims to identify and analyze whether Law no. 33 of 2014 concerning the Guarantee of Halal Products is the result of authoritarianism in the name of Islamic law in Indonesia or is a constitutional guarantee for the majority of Muslims. The conclusion of this study shows that the effort to enact the jurisprudence of halal products through the Halal Product Guarantee Law is a constitutional necessity for Indonesian citizens who are predominantly Muslim. The regulation of halal certification in the Halal Product Guarantee Law is a form of legal certainty and constitutional protections for the majority of Muslims as consumers in Indonesia. In addition, the existence of the Halal Product Guarantee Law is also considered to provide benefits economically, socially, and healthily, which applies universally regardless of religion. Even the accusation that the Halal Product Guarantee Law is a product of authoritarianism that harms non-Muslims cannot be justified. Because the producers of food and medicine that are widely circulating in supermarkets and mini-markets in Indonesia are actually non-Muslim owners. Even with this halal certification, their products can enter the world market, especially in Muslim countries.

Abstract

This study aims to determine and analyze the theological construction of Muslim and Christian religious leaders in FKUB Malang about the necessity of proselytizing mission on one side and the need to care for harmony on the other side. In addition, this study also seeks to explore how the strategic steps of Islamic and Christian leaders in FKUB Malang in bridging the necessity of the proselytizing mission and the need to care for harmony. This research is a qualitative research with a phenomenological approach. The results of this study are for FKUB Malang that the mission of proselytization in Islam and Christianity is a theological necessity. But in the process, it should not ignore the aspect of the plurality of Indonesian society which is also a theological necessity on the one hand and a sociological necessity on the other. So that for religious leaders in FKUB Malang, the necessity of proselytization which has the impact of inter-religious conflict must be avoided and prioritizes theology of peace building in a multicultural life. Because, the Principle of Love in the teachings of Jesus and the principle of al-salam in the teachings of Muhammad are universal principles in hacking religious conflicts that often occur in Indonesia. The proselytization strategy offered by religious leaders in FKUB Malang in building harmony among religious communities is to foster the quality of religious diversity of each adherent, as well as awareness of the heterogeneity of plural and inclusive communities in Malang. In addition, for Malang FKUB proselytizing efforts should not be made against people who are already religious. To realize this strategic effort, a redefinition of the interpretation of stray sheep which often becomes an exclusive and orthodox turbine driving force is needed.Keywords: Proselytization, Islam, Christianity, Caring for Harmony.

Abstract

Waqf (Islamic endowment) is considered one of the alternative solutions to environmental problems in Indonesia. One of the examples is through the establishment of a waqf forest, a conservation initiative in the form of developing forests on waqf land. The development of waqf forests needs to pay attention to the legal side in accordance with the laws and regulations of Indonesia. Previous studies discussed the process of legalizing waqf land in Indonesia, but research about the legalization of waqf forest land is still scarce. This study aims to determine the process of legalizing waqf forests on the basis of Indonesian laws and regulations. On the basis of the results of literature studies and expert interviews that were analyzed descriptively, the process of legalizing waqf forest is one of the main tasks of a nazir (waqf manager). The process involves at least three government agencies: the Ministry of Religion, the Ministry of Agrarian Affairs and Spatial Planning (National Land Agency), and the Ministry of Environment and Forestry. The waqf forest legalization process begins with making a waqf pledge deed at the local Office of Religious Affairs, followed by creating a waqf land certificate at the local Land Offices. A crucial step is to clarify that the represented land must be located outside the forest area through a statement from the Ministry of Environment and Forestry. The legalization of waqf forests will guarantee the sustainability of the forest because this process makes waqf forest legal under Islamic law and the law of the Republic of Indonesia.

Abstract

Many circles consider that Islamic family law in Indonesia must be renewed. But Islamic family law renewal is not an easy matter. The rejection of various parties to the Counter Legal Draft-Compilation of Islamic Law (CLD-KHI), as an effort to renew Islamic family law, become evidence of the difficulty of the renewal. Rejection of the CLD-KHI on the other hand also shows that Islamic family law reform must be carried out with approaches and methodologies derived from the tradition of Islamic thought itself. In this context, ijtihad based on maqashid syari'ah acts as a conceptual basis for the methodology of Islamic family law reform. This article aims to examine how the formulation and methodological contribution of maqashid syari'ah-based ijtihad in the development of Islamic family law. This study is normative juridical with a statute approach and analytical approach. The analysis is carried out with a qualitative descriptive method to describe the methodological contributions of ijtihad based on maqashid shari'ah in the formulation and development of Islamic family law.

Abstract

Since the past, stigma and various forms of discrimination have continued to haunt disabled groups. They become a group that is marginalized from society due to the limitations they experience. Diffable groups should be seen as part of a society that has different abilities. In Islamic doctrine, marginalization and discrimination against these disabled groups is an act that is blamed and prohibited because basically all humans have the same position before God and the only difference is the degree of holiness. Therefore, Islamic law through fiqh products must participate in legitimizing the fulfillment of rights for disabled groups from a religious perspective. This paper will examine the importance of the formulation of fiqh with disabilities as part of respecting human values ​​taught by Islam. Using the theo-anthro-juridical term, this paper will also describe the foundations in formulating the fiqh of persons with disabilities, including theological, humanist, and legal foundations.

Abstract

This study examines the theological principles underlying the social empowerment efforts implemented for the punk community at Pondok Tasawuf Underground Jakarta, focusing on articulating theological values in the context of empowerment and their implementation in daily life. Employing a qualitative phenomenological approach, several data in this study were collected through in-depth interviews with the founder and members of the punk community, participatory observation, and document analysis. The findings reveal that the theological principles underlying empowerment at Pondok Tasawuf Underground are rooted in holistic hijrah, encompassing both spiritual and social transformation. The "Roadmap to Return" program serves as the core agenda, consisting of two main paths: the Roadmap to Return to Allah, which emphasizes religious education and spiritual awareness, and the Roadmap to Return to Family, which underscores social responsibility and family relationship restoration. The principle of human equality serves as the theological foundation of this empowerment effort, affirming the universal dignity of every individual regardless of their background. The implementation of the theology of empowerment includes skill training, social assistance, and spiritual strengthening, significantly transforming the punk community from a marginalized group into productive individuals.

Abstract

The Bajo community, as a traditional maritime group, has long practiced marine environmental conservation, such as avoiding marine pollution and protecting endangered species. However, these conservation efforts are often perceived as lacking a firm legal foundation within both formal legal systems and Islamic law, making local wisdom-based conservation initiatives susceptible to neglect by both the government and the broader society. This study aims to analyze the marine environmental conservation practices of the Bajo community from the perspectives of Islamic environmental jurisprudence and the concept of green constitutionalism. The study conducted a qualitative approach. Data were collected through interviews and Focus Group Discussions (FGDs) with Bajo community members, religious leaders, and relevant stakeholders. The findings reveal that the unwritten customary regulations of the Bajo community emphasize the sanctity of the sea and promote a subject-to-subject relationship between humans and nature. The conservation practices of the Bajo community align with the principles of Islamic environmental law (fiqh al-bi’ah), particularly the principle of prioritizing environmental sustainability for the welfare of humanity. Furthermore, the study finds that Bajo conservation traditions have adopted the principles of green constitutionalism enshrined in Article 28 H of the 1945 Constitution of Indonesia, which ensures the right to a healthy and sustainable environment.

Abstract

This study examines the nexus between peace education and economic empowerment in the deradicalization of terrorism convicts, with a case study of the Yayasan Lingkar Perdamaian (YLP) in Lamongan, Indonesia—an institution founded by former terrorism perpetrators who have transformed into peace agents. Radicalism, rooted in ideological rigidity and socio-economic disparities, requires a multidimensional approach that goes beyond ideological deconstruction by integrating humanistic and welfare-oriented strategies. This research aims to analyze how YLP combines peace education and economic empowerment to dismantle residual extremism while reconstructing the social identity of former convicts as legitimate members of society. Using a qualitative case study method, data were collected through participatory observation, in-depth interviews, and document analysis. The findings reveal that experiential peace education, spiritual narratives, and transformative dialogue, when coupled with economic initiatives through social entrepreneurship and community networks, create restorative spaces that facilitate identity recovery and social reintegration. This study recommends the mainstreaming of cultural-humanistic approaches in national deradicalization policies and emphasizes the critical role of former perpetrators as key actors in peacebuilding. The novelty of this research lies in highlighting the synergy between ideological reconciliation and economic empowerment as a grassroots paradigm for sustainable deradicalization. Penelitian ini mengkaji keterkaitan antara pendidikan perdamaian dan pemberdayaan ekonomi dalam proses deradikalisasi narapidana terorisme melalui studi kasus Yayasan Lingkar Perdamaian (YLP) di Lamongan, Indonesia—sebuah lembaga yang didirikan oleh mantan pelaku terorisme yang telah bertransformasi menjadi agen perdamaian. Radikalisme yang berakar pada rigiditas ideologis dan kesenjangan sosial-ekonomi memerlukan pendekatan multidimensional yang tidak hanya berfokus pada dekonstruksi ideologi, tetapi juga mengintegrasikan strategi humanistik dan kesejahteraan. Penelitian ini bertujuan menganalisis bagaimana YLP menggabungkan pendidikan perdamaian dan pemberdayaan ekonomi untuk melemahkan sisa-sisa ekstremisme sekaligus merekonstruksi identitas sosial mantan narapidana sebagai anggota masyarakat yang sah. Dengan menggunakan metode studi kasus kualitatif, data dikumpulkan melalui observasi partisipatif, wawancara mendalam, dan analisis dokumen. Temuan menunjukkan bahwa pendidikan perdamaian berbasis pengalaman, narasi spiritual, dan dialog transformatif, ketika dipadukan dengan inisiatif ekonomi melalui kewirausahaan sosial dan jejaring komunitas, mampu menciptakan ruang restoratif yang mendorong pemulihan identitas dan reintegrasi sosial. Penelitian ini merekomendasikan pengarusutamaan pendekatan kultural-humanistik dalam kebijakan deradikalisasi nasional serta menekankan pentingnya keterlibatan mantan pelaku sebagai aktor utama dalam pembangunan perdamaian. Kebaruan penelitian ini terletak pada penegasan sinergi antara rekonsiliasi ideologis dan pemberdayaan ekonomi sebagai paradigma akar rumput untuk deradikalisasi yang berkelanjutan

Abstract

This study addresses the challenge of maintaining integrity and judicial ethics in Indonesia’s Religious Courts, which are often threatened by social, political, and economic pressures. In response to the modern crisis of spirituality, Sufi education offers a prophetic paradigm that emphasizes purification of the soul, honesty, and justice as divine orientations. This research, based on library study of classical and contemporary Sufi literature alongside legal regulations on judicial ethics, argues that Sufi education provides a spiritual foundation for strengthening judges’ moral integrity and professional ethics. The findings reveal that the internalization of teachings such as tazkiyat al-nafs, muraqabah, and ihsan can enhance ethical awareness, foster judicial independence, and reduce the risk of abuse of authority. Rather than replacing formal codes of ethics, Sufi education complements them with a deeper spiritual framework. The study recommends integrating Sufi educational modules into judicial training and continuous professional development. Its novelty lies in framing Sufi education not merely as private spirituality but as an institutional instrument for building a clean, dignified, and just Religious Court system in Indonesia. Penelitian ini membahas tantangan menjaga integritas dan etika peradilan di Pengadilan Agama Indonesia yang kerap terancam oleh tekanan sosial, politik, dan ekonomi. Di tengah krisis spiritualitas modern, pendidikan tasawuf menawarkan paradigma profetik yang menekankan pensucian jiwa, kejujuran, dan keadilan sebagai orientasi ilahiah. Dengan menggunakan metode studi pustaka terhadap literatur tasawuf klasik dan kontemporer serta regulasi hukum terkait kode etik hakim, penelitian ini menegaskan bahwa pendidikan tasawuf dapat menjadi fondasi spiritual untuk memperkuat integritas moral dan etika profesional hakim. Temuan menunjukkan bahwa internalisasi ajaran seperti tazkiyat al-nafs, muraqabah, dan ihsan mampu meningkatkan kesadaran etis, menumbuhkan independensi peradilan, dan meminimalisasi potensi penyalahgunaan kewenangan. Pendidikan tasawuf tidak dimaksudkan menggantikan kode etik formal, melainkan melengkapinya dengan kerangka spiritual yang lebih mendalam. Penelitian ini merekomendasikan integrasi modul pendidikan tasawuf dalam pelatihan calon hakim maupun pengembangan profesional berkelanjutan. Kebaruan penelitian terletak pada argumentasi bahwa pendidikan tasawuf bukan sekadar urusan spiritualitas privat, tetapi juga instrumen institusional untuk membangun peradilan agama yang bersih, bermartabat, dan berkeadilan.
