Abstract

Dengan adanya Putusan MK Nomor 25/PUU-XIV/2016, yang menyatakan bahwa frasa “dapat” dalam Pasal 2 ayat (1) dan Pasal 3 UU PTPK inkonstitusional terhadap UUDN RI Tahun 1945 dan tidak memiliki kekuatan hukum mengikat, maka secara yuridis, berimplikasi yuridis pada karakteristik delik pasal tersebut, yang semula sebagai delik formil berubah menjadi delik materil dengan mensyaratkan adanya akibat yaitu unsur kerugian keuangan negara harus dihitung secara nyata/pasti (real) oleh lembaga yang berwenang. Karenanya, MK memutuskan aparat penegakan hukum harus membuktikan adanya kerugian keuangan negara sebelum dilakukan penyidikan perkara tindak pidana korupsi. Sebab, tanpa perhitungan yang real dari auditor negara perbuatan yang disangkakan belum dapat dikategorikan sebagai tindak pidana korupsi karena tidak terpenuhinya unsur kerugian keuangan negara.

Abstract

With the enactment of Law Number 11 of 2020 concerning Job Creation, it has become a positive turning point in the Government's efforts to increase the number and value of investment in Indonesia while at the same time responding to challenges according to current developments with the method of resolving investment disputes by prioritizing deliberation and consensus up to the court mechanism. The purpose of this legal research is to analyze the legal certainty regarding the settlement of disputes between investors and indigenous peoples and to analyze the policies taken by the Government and Regional Governments in the context of resolving disputes in the perspective of legal pluralism. The research method used in this research is the normative legal method. According to the author, this is needed in order to provide guarantees for the basis of legal certainty, namely legal certainty and strengthening as well as the presence of the State in providing policy directions, commitments and joint responsibilities of the Government, Regional Governments in supporting and carrying out the process of forming laws and regulations that are in harmony and balance so that ensure the existence of public law and order in providing legal certainty in investing for investors, the community and the Government as well as the Regional Government in the context of improving regional economic development and community welfare in a fair and equitable manner.

Abstract

Diki Yanto, 2021, Implementasi   fungsi   pemerintahan   adalah   merupakan   hal kunci penting dalam pembangunan khususnya dalam penerbitan PBG dalam tesis ini dikhususkan pada penerbitan PBG di Kabupaten Katingan Permasalahan yang diangkat adalah Bagaimana implementasi fungsi pelayanan Pemerintah Kabupaten  Katingan dalam  pemberian Ijin Persetujuan Bangunan Gedung (PBG) di Kabupaten Katingan, Kendala-kendala apakah yang dihadapi oleh Pemerintah Kabupaten Katingan dalam Implementasinya terhadap Ijin Persetujuan Bangunan Gedung (PBG)  sebagai bentuk tanggung  jawab  pemerintah  dalam mewujudkan  harapan masyarakat  di Kabupaten  Katingan dan Upaya apakah yang dilakukan Pemerintah   Kabupaten   Katingan   dalam   rangka   mengatasi   kendala menuju pada standard pelayanan pemberian Ijin Persetujuan Bangunan Gedung (PBG). Metode penelitian  yang  digunakan   adalah  yuridis  empiris  yaitu menggunakan  pendekatan  pada  kenyataan  melalui  data primer  dan  data sekunder yang diperoleh. Penyelenggaraan fungsi pelayanan pemerintah dalam pemberian Ijin Persetujuan Bangunan Gedung di  Kabupaten  Katingan telah  mendasarkan  pada peraturan perundang-undangan yang berlaku dan asas-asas umum pemerintahan yang baik agar tercapai kesejahteraan masyarakat Kabupaten Katingan Kendala implementasi pemberian PBG di  Kabupaten  Katingan disebabkan  oleh beberapa  faktor. Faktor-faktor  penyebab  implementasi pemberian PBG oleh  Pemerintah Kabupaten  Katingan   belum   efektif adalah   faktor   peraturan   perundang-undangan yaitu lemahnya   aspek sosiologis dalam peraturan daerah Kabupaten Katingan tentang PBG karena kurang sosialisasi, faktor aparat yaitu petugas pelayanan PBG dan Satpol pp sebagai lembaga penegakan hukum perda PBG belum berfungsi secara optimal,  dan  faktor  Kesadarah  hukum  masyarakat  yaitu  kurangnya  taraf kesadaran   dan   kepatuhan   hukum   masyarakat   Kabupaten   Katingan Berkaitan dengan kesadaran mengajukan permohonan PBG Upaya upaya dilakukan untuk mengoptimalkan implementasi pemberian ijin Persetujuan Bangunan Gedung (PBG) di Kabupaten Katingan adalah dengan peningkatan  pengawasan  sebagai instrumen kendali   disiplin aparat  pelayanan   permohonan  PBG Kabupaten  Katingan,   penerapan pola  pembinaan   yang  tepat  dan  berdaya  guna  dengan pendisiplinan yang  manusiawi  dalam  meningkatkan kualitas pelayanan  permohonan PBG kepada  masyarakat,  keteladanan  pimpinan  dalam  menyegerakan melayani pemohon PBG Penulis  memberikan   saran  agar  implementasi penerbitan  PBG berjalan dengan baik  maka Pemerintah Kabupaten Katingan agar memperbaiki dan melengkapi faktor-faktor yang menjadi kendala penebitan PBG,  salah  satunya  adalah  dengan  mengefektifkan  Peraturan   Daerah tentang PBG melalui penerapkan sanksi yang lebih berbobot untuk menimbulkan efek  jera,  meningkatkan   sosialisasi   peraturan   daerah tentang  PBG guna  kesadaran  hukum  masyarakat  Kabupaten  Katingan  Dalam kegiatan membangun bangunan dan melakukan upaya-upaya dengan  peningkatan pengawasan sebagai instrument kendali Pegawai Negeri Sipil; penerapan pola pembinaan yang tepat dan berdaya guna dengan pendisiplinan yang manusiawi; Serta keteladanan para pimpinan.

Abstract

Corruption crimes that have been occurring widely, not only harm the state's finances, but also have been a violation of the social and economic rights of the community at large, so corruption crimes need to be classified as crimes whose eradication must be carried out extraordinarily. Every person convicted of corruption is sanctioned in accordance with the provisions of the laws and regulations. One form of sanctions imposed by judges related to corruption cases is the Conditional Criminal verdict, which means that the criminal does not need to live inside the Correctional Institution. The verdict is indeed the power of the judge guaranteed in the Law of Judicial Power as well as related to conditional criminality as stipulated in Article 14a of the Criminal Code, but in the Corruption Crimes Act, there is no mention of criminal threats with conditional criminals. In other similar cases, there is a judge's ruling that does not impose a conditional criminal sentence but provides a prison sentence for the accused of corruption, resulting in inconsistencies in the application of the law by the judge in sending the accused to corruption. Therefore, with a conditional criminal conviction will have implications on the principle of justice and legal certainty for convicted other corruption cases, as well as for the Government and society in general in preventing and eradicating corruption cases.

Abstract

Given the complexity of the problem of corruption, it must be treated seriously through a balance of rigorous and precise steps. This step is not only taken by the government and law enforcers, but also by involving the participation of indigenous peoples. In the indigenous Dayak Ngaju community, they are familiar with the principle of not having a bahadat. This principle means that the behavior of life that upholds honesty, equality, togetherness and tolerance and obeying the law (state law, customary law and natural law). According to the author, the existence of the principle of Belom Bahadat can be used as a preventive instrument for the prevention of corruption by government officials in Central Kalimantan Province. This means that there is a contribution of customary law norms to the government's efforts to prevent the occurrence of criminal acts of corruption through the initiation of the belom bahadat principle of Dayak Ngaju customary law.

Abstract

The Covid-19 pandemic that hit Indonesia has caused major changes in the legal world. The enactment of social distancing/physical distancing rules and Large-Scale Social Restrictions (PSBB) ultimately forced the Supreme Court to make a legal breakthrough by issuing PERMA No. 4 of 2020 concerning the Administration and Trial of Criminal Cases in Courts Electronically, the purpose of which is to fill the legal vacuum in the Criminal Procedure Code and guarantee the right of the accused to immediately obtain legal certainty for the crime he is accused of through trial without undue delay, with fair treatment. and impartiality (fair trial) , which is a guarantee for the protection of the rights of everyone in the judicial process. PERMA No. 4 of 2020 concerning the Administration and Trial of Criminal Cases in Courts Electronically guarantees a fair and impartial electronic trial that meets the principles of justice and legal certainty, by clearly stipulating the rights of defendants in electronic criminal case trials, namely the right to obtain legal assistance, the right to defend, the right to be tried in a court session which is open to the public, and the right to immediately receive an examination in court for legal certainty. Then to fill the legal vacuum in the Criminal Procedure Code, and in the future, electronic criminal case trials must be strictly regulated to become the new norm in the revision of the Criminal Procedure Code.

Abstract

Main hakim sendiri merupakan suatu perbuatan pidana yang dapat menimbulkan kerugian bagi pelaku, bahkan hal tersebut menjadi preseden buruk bagi masyarakat lain. Akibatnya, perbuatan itu ditiru apabila masyarakat tersebut, menjumpai atau menemukan pelaku-pelaku kejahatan yang kebetulan sedang melaksanakan aksi kejahatan dilingkungan mereka. Atas kondisi demikian, peran dan fungsi dari kepolisian menjadi penting untuk menanggulangi perbuatan yang mengarah pada main hakim sendiri. Berbagai upaya dapat dilakukan, baik melalui upaya perventif maupun represif. Secara preventif dapat dilakukan melalui penyuluhan/sosialisasi tentang kesadaran hukum, sedangkan upaya represif dilakukan melalui penegakan hukum dengan cara menindak para pelaku main hakim sendiri.

Abstract

Sexual crime against children is a social phenomenon that is rife in Indonesia. This causes the government to be again required to formulate regulations to reduce the sensation of sexual crimes against children. Child protection activists are pushing for the castration of perpetrators of sexual crimes against children. The insistence on forming regulations related to castration is as if it is a cruel punishment aimed at perpetrators of sexual crimes against children. The question that arises from the discourse on the implementation of the castration sentence is, "Is the castration punishment by the principle of justice?".

Abstract

Politics of regional quarantine law with PPKM approach based on Level 1- 4 as an effort by the Government to suppress the increase in positive cases of the Coronavirus (Covid-19). The policy is decided, of course, by considering health, economic aspects, and social dynamics. Determine the status of the district/city level of the pandemic situation. It is based on indicators regarding the adjustment of public health efforts and social efforts in dealing with the pandemic, which was adapted from the recommendations of the World Health Organization (WHO).

Abstract

To be able to have a driver's license for drivers of various types of vehicles must meet the conditions that have been set. Similarly, with driver's license C, one of the conditions that must be met is a minimum age of 17 years. It becomes a problem when the driver's license issuance applicant is a minor. Until now, there are still parents or applicants themselves who do the act of ageing to be able to issue a driver's license. In fact, Law No. 22 of 2009 concerning LLAJ and Perkapolri No. 9 of 2012 concerning driver's license has set the age limit allowed to apply for the issuance of driver's license C is 17 (seventeen) years. The formulation of the problem taken is what efforts are made by the Palangka Raya City Resort Police Traffic Unit to prevent age falsification by applicants for the issuance of a Two-Wheeled Motor Vehicle Driving License (driver's license C). This type of research uses juridical-empirical methods by looking at the application of rules in the field. The results found that the efforts made were to conduct law enforcement in the form of preventive approaches such as attaching additional conditions for applicants to issue new driver's license C indicated to be minors, the use of technological advances through the detection of NIK from driver's license C applicant ID cards online, as well as socialization through the installation of banners or banners in the Regident Satlantas Unit of Palangka Raya Police and through social media to prevent age falsification by reducing the age of the driver's license applicant.
