Abstract

The issue of woman?s and non-Muslim?s leadership seems to be unrest debate in the Islamic world. In Indonesia, the Islamic liberal groups or the modernists will usually accept woman or non-Muslim for being leader of the Muslims community, while the Muslim traditionalists and radical groups will usually show their firm rejection. This study seeks to elaborate the thought of the three Muslim scholars in the Eastern Sumatera, i.e. Abdul Halim Hasan, Zainal Arifin Abbas, and Abdur Rahim Haitami about the leadership of woman and non-Muslim. The article will put the position of thought of these scholars among the discourse of the issue. Employing content analytical method, the study finds that the three scholars reject woman and non-Muslim for being leader, especially state leader, of the Muslims community. They argue that leadership is a privilege honored to man, not to woman. They also assert that principle foundation of the shar??a forbids the Muslims from designating non-Muslim as their leader, except within emergency condition. Although these three Muslim scholars have been mostly influenced by modern thought, they seem to hardly accept woman?s and non-Muslim?s leadership. The ideas they propose will, therefore, contradict to the ideas hold by the liberal Muslim groups or other proponents of democracy.

Abstract

Berbeda dari organisasi Islam lain, Al Jam’iyatul Washliyah tidak banyak mendapatkan perhatian dari masyarakat akademik. Padahal secara kuantitas dan sebaran wilayah, Al Washliyah menempati posisi sebagai organisasi terbesar ketiga setelah Nahdlatul Ulama dan Muhammadiyah. Al Washliyah telah memberikan perhatian terhadap bidang pendidikan, dakwah dan amal sosial, sehingga beberapa peneliti memfokuskan riset mereka terhadap ketiga bidang tersebut. Tetapi, peran Al Washliyah dalam bidang hukum Islam belum dikaji secara akademik mengingat kelangkaan literatur mengenai masalah tersebut. Melalui studi kepustakaan, artikel ini mengajukan temuan bahwa Al Washliyah membentuk Dewan Fatwa sebagai dewan syariah organisasi, dan hanya ada pada level Pengurus Besar Al Washliyah. Dewan Fatwa Al Washliyah memiliki hak mengeluarkan fatwa-fatwa atas dasar mazhab Syafi‘iyyah dalam bidang fikih, dan mazhab Ahlussunnah Waljamaah dalam bidang akidah; dan berhasil memainkan peran sebagai benteng tradisi Sunni di Indonesia. Sejak awal pendirian, Dewan Fatwa Al Washliyah terus merespons segala persoalan global yang sedang dihadapi oleh masyarakat Muslim di level nasional, regional, dan internasional. Lembaga fatwa ini telah banyak menghasilkan beragam produk fatwa dalam bidang hukum dan akidah, meskipun kurang disosialisasikan secara meluas kepada masyarakat Muslim, dan menjadi sebentuk respons terhadap isu-isu global dunia Muslim.

Abstract

Al Washliyah merupakan satu di antara banyak organisasi Islam yang menolak paham dan gerakan terorisme di Indonesia. Artikel ini mengkaji respons Al Washliyah terhadap terorisme. Kajian ini menarik dilakukan, sebab organisasi ini memiliki pengikut yang fanatik dan mengelola amal usaha yang banyak, tetapi masih relatif jarang diteliti oleh para peneliti. Kajian ini merupakan studi lapangan (library research) dimana sumber datanya diperoleh dari kegiatan wawancara dan studi dokumen. Data dianalisis dengan menggunakan metode analisis data menurut Miles dan Huberman: reduksi data, pemaparan data, dan penarikan kesimpulan. Didasari dengan teori Matusitz, Pranawati, dan Golose tentang doktrin terorisme dimana gerakan ini ingin mendirikan negara Islam, memaknai jihad sebagai perang, anti terhadap non-Muslim, dan melegalkan bom bunuh diri, kajian ini akan menelaah respons Al Washliyah terhadap empat persoalan tersebut. Kajian ini mengajukan temuan bahwa Al Washliyah menolak paham dan gerakan terorisme yang muncul dan berkembang di Indonesia, dan para ulamanya menilai bahwa kaum teroris telah salah dalam memahami ajaran Islam. Temuan kajian ini dapat berkontribusi bagi pemerintah dalam upaya menanggulangi gerakan terorisme di Indonesia. Al Washliyah is one of Islamic organizations that rejects the concept of terrorism in Indonesia. This article examines Al Washliyah's responses to terrorism. This study is interesting because this organization has fanatic followers and manages many business charities, but rarely investigated by researchers. This research is field studies where the data sources obtained from the interviews activities and document studies. Data were analyzed by using data analysis method according to Miles and Huberman: data reduction, data display, and conclusion. Based on the theory of Matusitz, Pranawati, and Golose about terrorism doctrine in which the program wants to establish an Islamic state, interpret jihad as war, anti to non-Muslims, and legalize suicide bombings, this study will examine the Al Washliyah's responses to those four issues. This study proposes that Al Washliyah rejects the concept of terrorism which appears and develops in Indonesia, and ulama consider that terrorists have misunderstood on Islamic concept. The findings of this study may contribute to the government in combating terrorism movement in Indonesia.

Abstract

This article examines the works of Al Washliyah ulama in Arabic and Malay written in Arabic script. Their works are commonly referred to as Kitab Jawi. This study adopts a literature research with a historical approach, using Mestika Zed's library research model. It utilizes Al Washliyah ulama’s works as the primary reference. The primary data was then analyzed using the content analysis method. The study corroborates the findings of Martin van Bruinessen, Zamakhsyari Dhofier, and Azyumardi Azra, indicating that Al Washliyah ulama has taught yellow book texts at various levels in Al Washliyah madrasas. On the other hand, they have written books in Arabic and Malay with Arabic script. Some of their works have not been republished and are no longer referenced by current Al Washliyah students. Conversely, some of their other works remain republished and references for Al Washliyah students. Their books may be classified further into elementary, intermediate, and advanced books. The results of this study have implications for the enrichment of Islamic literature, especially those sourced from the work of Al-Washliyah scholars

Abstract

Child marriage has often been one of the most heated debates amongst Islamic jurisprudents (‘fuqahâ’) and is even opposed by various groups for a variety of reasons, including legislative regulations, health, social and economic concerns, and children’s rights. This article examines the legality of underage marriage according to Islamic law scholars. This research is a library-based study using a conceptual and comparative approach. The data sources for this research include the prominent fiqh texts of the Mâlikî, Hanafî, Shâfi‘î, Hanbalî, and Shia Imamiyya schools. The data is analyzed using content analysis methodology. The findings of this study indicate that the four Sunni schools and the Shia Imamiyya school recognize the permissibility of child marriage, with various conditions, particularly regarding the guardian (wali) who performs the marriage and the potential benefits or harms of the marriage. This study complements research on the perspectives of the five major fiqh schools regarding the legality of child marriage. It also provides an alternative perspective for interpreting the legal regulations on marriage in Indonesia.

Abstract

This article examines the opinion of the North Aceh District Ulama Consultative Assembly (MPU) on the marriage of pregnant women outside of marriage. Although it is a field study, it first examines the fiqh perspective on the topic, and then reviews the MPU board's opinion on the topic. The study proposes the finding that in Islamic fiqh, the marriage of a pregnant woman out of wedlock is debated based on the cause of the pregnancy. The Maliki, Hanbali and Abu Yusuf (Hanafi) schools of thought reject the validity of the marriage of a pregnant woman resulting from adultery, while the Shafi'i and Abu Hanifah schools of thought consider it valid. However, the marriage of a pregnant woman is generally considered invalid during the 'iddah period if she is pregnant from a legal or illegal relationship. The MPU of North Aceh stated that the marriage of a pregnant woman out of wedlock is legally valid but haram, as it can lead to the uncertainty of the child's nasab. They recommend that such marriages be avoided to prevent potential problems with nasab and other rights. The implications of this study show the importance of harmonization between fiqh rules and the needs of contemporary society in marriage law, as well as the need for community education to prevent marriages that can cause social and legal problems.

Abstract

Waste is the residue generated from human daily activities or natural processes that is no longer needed. According to data from the Ministry of Environment and Forestry, waste generation in Indonesia reaches 36 million tons per year, with unmanaged waste totaling 13 million tons annually. Inadequate waste management can lead to various issues. One significant source of unmanaged waste is found in schools, attributed to lack of awareness and low concern, resulting in student’s laziness in disposing of waste properly. This project aims to develop a system that assists students in identifying specific waste categories and incorporates a royalty points system to boost student motivation. The method employed is You Only Look Once Version 5 with the Darknet architecture, utilizing an 80% training, 10% validation, and 10% testing dataset split. The results of testing this method at the development stage showed a recall value of 92.4%, precision of 88.4%, and mAP of 96.4%. Meanwhile, at the implementation stage on smartphones, the recall value reached 89.9% with a precision of 94.2%, and an average detection speed of around 1.68 seconds.
