Abstract

Relasi kekuasaan antar Presiden dan Wakil Presiden dalam sistem ketatanegaraan Indonesia selama ini dapat dikatakan selalu mengalami pasang surut. Persoalan ini disebabkan pengaturan kewenangan Wakil Presiden dalam UUD NRI Tahun 1945 tidak jelas. Penelitian ini bertujuan untuk menganalisis implikasi yuridis dari kekaburan kewenangan Wakil Presiden serta memberikan rekomendasi ke depan bagaimana seyogyanya kewenangan Presiden dan Wakil Presiden dapat diatur dan dilaksanakan secara proporsional. Penelitian ini merupakan penelitian hukum normatif dengan bahan hukum primer berupa UUD NRI 1945 dan bahan hukum sekunder berupa buku dan artikel jurnal berkaitan dengan kewenangan Wakil Presiden. Dari penelitian ini dapat disimpulkan bahwa pengoptimalan kewenangan Wakil Presiden dapat dilakukan dengan mengaturnya di dalam Undang-Undang Lembaga Kepresidenan yang diharapkan dapat membagi secara proporsional kewenangan Presiden dan Wakil Presiden. Oleh karena itu, diharapkan supaya pengaturan Kewenangan Wakil Presiden diatur secara pasti dalam aturan hukum supaya tidak tergantung pada praktik ketatanegaraan serta faktor non hukum, yaitu faktor politik.  Mengingat pentingnya fungsi Wakil Presiden dalam sistem ketatanegaraan Republik Indonesia maka alangkah baiknya, Undang-Undang Lembaga Kepresidenan yang mengatur mengenai pembagian wewenang antar Presiden dan Wakil Presiden segera dibentuk. The power relations between the President and Vice President in the Indonesian constitutional system so far can be agreed to always overcome the ups and downs. The 1945 Constitution of the Republic of Indonesia is unclear. This study aims to analyze the juridical implications of the obscurity of the Vice President’s authority and give approval to the front regarding the authority of the President and Vice President to be able to regulate and implement proportionality. This research is a normative legal research with primary legal material in the form of the 1945 Constitution of the Republic of Indonesia and secondary legal material containing books and journal articles about the authority of the president’s representative. From this research it can be concluded that optimizing the authority of the Vice President can be done with a license in the Law on Presidential Institutions which is expected to allocate proportional authority to the powers of the President and Vice President. Therefore, it is hoped that the Vice President’s licensing can be regulated in regulating legislation not dependent on state administration and non-legal factors, namely political factors. Considering the importance of the function of the Vice President in the constitutional system of the Republic of Indonesia, it would be nice, the Law on Presidential Institutions governing the distribution of powers between the President and the Vice President was immediately formed.

Abstract

Abstract This study aims to analyze the application of morality to legal practice in Indonesia. This is because the reality of the rule of law today is dominated by a positivist-legalistic phenomenon that prioritizes text but darkens morality's meaning in law. Morality in law seems to be immersed in legal practice that deifies the textual law but neglects the law's moral essence. This research is juridical-normative research oriented towards coherence between the principles of law based on morality and legal norms and legal practice in society. This research's novelty is the development of morality in the rule of law practice by prioritizing two aspects, namely the integrative mechanism aspect of Harry C. Bredemeier with the progressive law of Satjipto Rahardjo. This study emphasizes that efforts to develop law must not forget the elements of morality development. This study's conclusions highlight that the development of law and morality will run optimally by upholding the law as an integrative mechanism and applying progressive law as a solution in facing the lethargy of the Indonesian nation.Keywords: integrative mechanism; morality; progressive lawAbstrak Penelitian ini bertujuan untuk menganalisis penerapan moralitas pada praktik berhukum di Indonesia. Hal ini dikarenakan bahwa realitas praktik berhukum saat ini didominasi oleh fenomena positivistik-legalistik yang mengutamakan teks tetapi menggelapkan makna moralitas dalam berhukum. Aspek moralitas dalam hukum seakan tenggelam dalam praktik hukum yang mendewakan tekstual undang-undang tetapi melalaikan esensi moral dalam undang-undang. Penelitian ini merupakan penelitian yuridis-normatif yang berorientasi pada koherensi antara asas-asas hukum yang bersumber pada moralitas dengan norma hukum serta praktik hukum di masyarakat. Kebaruan dari penelitian ini yaitu pembangunan moralitas dalam praktik negara hukum dengan mengedepankan dua aspek, yaitu aspek integrative mechanism dari Harry C. Bredemeier dengan hukum progresif dari Satjipto Rahardjo. Hasil dari penelitian ini menegaskan bahwa upaya membangun hukum tidak boleh melupakan aspek pembangunan moralitas. Simpulan dalam penelitian ini menegaskan bahwa, pembangunan hukum dan moralitas akan berjalan secara optimal dengan meneguhkan hukum sebagai integrative mechanism serta menerapkan hukum progresif sebagai solusi dalam menghadapi jagat kelesuan berhukum bangsa Indonesia.

Abstract

The existence of a maximum age limit for job applications in Indonesia presents societal challenges, as it has the potential to engender age-based discrimination, or ageism. This study aims to analyze the ratio decidendi of Constitutional Court Decision No. 35/PUU-XXII/2024, which addresses the maximum age limit for employment applications, while also examining human rights perspectives and legal comparisons related to maximum age limits in job vacancies in Indonesia. This research employs a normative legal methodology, utilizing case analysis, conceptual frameworks, legislative review, and comparative legal studies. The findings affirm that the ratio decidendi in Constitutional Court Decision No. 35/PUU-XXII/2024 concerning age limitations for certain job applications does not constitute discrimination, as age-based discrimination is not yet legislated in Indonesia. The maximum age limit in job vacancies can be classified as a form of ageism, which represents a type of discrimination based on age that should not be applied in the employment sector. Many countries, including Singapore, the Philippines, the United States, and Germany, have legislatively prohibited ageism and various forms of discrimination in job requirements and employment relationships. This study recommends that lawmakers revise the Labor Law to include ageism as a discriminatory practice. Keywords: Ageism, Human Rights, Employment, Comparative Law.

Abstract

Constitutional changes are part of the political and legal dynamics of a country. Changes to the constitution aim to meet the legal demands and needs of the community so that they are clearly and firmly regulated in the constitution. This paper is oriented towards the idea of a formal review of constitutional changes in Indonesia. This research is a normative legal research. The approach used in this research is a conceptual approach, a comparative approach, and a statutory approach. The primary legal materials in this study include the text of the 1945 Constitution of the Republic of Indonesia, constitutional texts in various countries and the Constitutional Court Decision No. 91/PUU-XVIII/2020. Secondary legal materials include: books, journal articles, and websites related to the constitution and constitutional law. Non-legal materials include legal dictionaries. The results of the study indicate that a formal review of constitutional changes is needed as an effort to maintain the supremacy of the constitution, including also placing the court's function as guardians of the law and the constitution in dealing with the determination of non-legal aspects in constitutional changes

Abstract

This study aims to analyze the reconstruction of Pancasila ideology within the virtual space: from citizen ideology to netizen ideology, and the cultural orientation of digital Pancasila in fostering civility in Indonesian social media. This research is a socio-legal study that emphasizes a literature review and qualitative analysis. The findings underscore that a reconstruction of understanding and education on Pancasila is necessary to ensure its application aligns with contemporary developments. The cultural orientation of digital Pancasila in promoting social media civility can be achieved through digital Pancasila education, which produces influencers among Indonesian netizens committed to implementing Pancasila values on social media, and through the establishment of a Pancasila digital society network.

Abstract

Background: This research aims to analyse the arrangements related to the formation of the Village RKP Compilation Team as stipulated in Permendagri 114/2014 and Permendesa PDTT 21/2020 and to analyse legal harmonisation efforts related to conflicts between Permendagri 114/2014 and Permendesa PDTT 21/2020. Methods: This research is a normative legal research that prioritises conceptual and statutory approaches. Findings: The results confirm that the authority to form the Village RKP Compilation Team has moved to the Ministry of Villages, Development of Disadvantaged Regions and Transmigration so that regulations from the ministry are prioritised for use. Conclusion: The resolution of norm conflicts between Permendagri 114/2014 and Permendesa PDTT 21/2020 regarding the formation of the Village RKP Compilation Team can be done by harmonising regulations using the principle of preference, specifically the principle of lex superior derogate legi inferiori in harmonising authority in village development and the principle of lex posterior derogate legi priori in harmonising regulations on the formation of the Village RKP Compilation Team. Novelty/Originality of this article: Through harmonisation using the principle of preference, the regulation on the formation of the Village RKP Compilation Team regulated by Permendesa PDTT 21/2020 takes precedence over its use.

Abstract

Background: Regional regulations (Perda) in Indonesia often face issues of overlap and inefficiency. Specific Background: The Omnibus Law method, known for simplifying and harmonizing regulations, has been applied nationally but remains underexplored locally. Knowledge Gap: Its practical application at the regional level, including challenges and opportunities, lacks sufficient research. Aims: This study examines the legal reconstruction of Perda using the Omnibus Law to improve regulatory efficiency and alignment with national laws. Results: The method streamlines regulations, enhances coherence, and boosts legal certainty but faces challenges such as stakeholder resistance and capacity limitations. Novelty: The research highlights the method's transformative potential for resolving Indonesia's regulatory complexities. Implications: It advocates for capacity-building, participatory processes, and effective oversight to achieve cohesive and responsive governance. Highlights: Regulatory Simplification: The Omnibus Law integrates overlapping regional laws into a single, cohesive framework. Abstract

Legal Standing is part of human rights which is related to the permission of certain parties to sue in court. In practice at the Constitutional Court, there is confirmation that legal standing is only given to Indonesian citizens, while foreigners do not get the slightest space to proceed in proceedings at the Constitutional Court. This research aims to analyze future regulatory efforts (ius constituendum) regarding limited legal standing for foreigners in the judicial review process. The term ius constituendum is used in this research to emphasize the existence of legal rules that are being initiated or aspired to be related to granting limited legal standing to foreigners in the judicial review process. This research is normative legal research by prioritizing conceptual, case and statutory approaches. The research results confirm that the modern human rights perspective mandates that the universal application of human rights requires the recognition of human rights for every person without the need to look at the background and national origin of each person. The regulation regarding legal standing at the Constitutional Court problematically only recognizes Indonesian citizens as parties who can have legal standing at the Constitutional Court. Based on the results of legal comparisons with Czechia, Germany and Mongolia, in the future it is necessary to regulate limited legal standing for foreigners to emphasize the existence of universal human rights and aim to protect foreigners from discrimination from countries that do not implement legal policies that accommodate the universalism of  human rights.

Abstract

The imposition of a golf tax actually raises legal issues related to the status of golf in connection with the imposition of regional taxes.  The object of this research is the status of golf as entertainment or a sport and the implications of legal uncertainty related to the imposition of regional taxes.  This research is a normative legal study with a historical, legislative, and case approach.  The legal materials used include primary legal materials in the form of legislation and court decisions, secondary legal materials in the form of research results such as journal articles and relevant books, as well as non-legal materials such as language dictionaries. The technique for collecting legal materials is conducted through library research by gathering legal materials from libraries as well as collecting legal materials through national and international journal article websites. The analysis of legal materials is conducted prescriptively, emphasizing legal prescriptions or solutions as answers to legal issues in this research.  The findings of this research emphasize that the legal uncertainty regarding the status of golf as entertainment and a sport in relation to local tax imposition implies that golf, as a sport, can only be subject to VAT and therefore cannot be subject to local tax.  The recommendation from this research is that there needs to be a revision of the legislation in the field of taxation and a clarification that golf can be subject to regional taxes. This research is expected to contribute to the thinking and practice related to the development of tax imposition on golf facilities.
