Abstract

Konteks penelitian ini adalah guna menunjang peradilan yang kredibilitas dan akuntabilas di seluruh Indonesia yang lebih baik dan lebih cepat dan Efisien. Mahkamah Agung dengan percaya diri menerbitkan Peraturan mahkamah agung  Tahun 2019 No 1 tentang adminidtrasi perdata secara elektronik yang mana maksud di keluarkannya perma tersebut diharapkan dapat membantu bagi setiap orang yang ingin mencari keadilan di Pengadilan, dan tidak harus pergi setiap akan melakukan persidangan di pengadilan dengan tidak lagi off line melainkan persidangan dengan system online atau e-court di Pengadilan Agama Kota Banjar, sehingga di Era revolusi industri 4.0 seperti sekarang ini yang mayoritas masyarakat menggunakan elektronik, pemerintah dalam hal ini Mahkamah Agung berinisiatif menggunakan alat (e-Court) tersebut untuk dapat diakses dalam hal pengadministrasian perdata di pengadilan. Secara wilayah mungkin masih banyak kabupaten yang minim terkait akses elektronik ini. Akan tetapi tidak menutup kemungkinan setelah perma ini berjalan dalam hal ini pemerintah akan memenuhi kebutuhan masyarakat diantaranya adalah dengan adanya akses jaringan elektronik yang bisa dimanfaatkan dimana-dimana tidak hanya di wilayah kota Banjar, Provinsi Jawa Barat.

Abstract

Cloud Storage (penyimpanan online) merupakan model komputasi awan yang mungkin bisa menjadi penyimpanan data dan file secara online melalui penyedia layanan cloud storage yang bisa anda akses baik melalui internet publik atau jaringan pribadi. Penyedia cloud storage akan menyimpan, memelihara server penyimpanan, mengelola, infrastruktur, dan jaringan dengan aman untuk memastikan client memiliki akses ke data saat pengguna ingin membutuhkannya. Cloud Storage bisa kita gunakan sebagai penyimpanan data pribadi, memberi penggunna skalabilitas, dan daya tahan, dengan akses data kapan saja, dimana pun.

Abstract

Surat Keterangan Pendamping Ijazah (SKPI) mempunyai tujuan untuk meningkatkan transparansi kualifikasi akademik dan profesi yang dihasilkan oleh perguruan tinggi yang yang diuraikan dalam bentuk narasi deskriptif yang menyatakan capaian pembelajaran lulusan pada jenjang Kerangka Kualifikasi Nasional Indonesia (KKNI) maka sejak Agustus 2014, berdasarkan Permendikbud No. 73 Tahun 2013, Permendikbud No. 49 Tahun 2014, dan Permendikbud No. 81 Tahun 2014. kualifikasi akademik dan profesi untuk kampus sebagai implemtasi langsung untuk pengembangan mutu pada perguruan tinggi maka di perlukan suatu sistem untuk penerbitan SKPI pada peguruan tinggi untuk akses langsung oleh mahasiswa secara online dan bisa dilengkapi secara langsung, dimana dengan kemajuan teknologi saat ini maka di perlukannya suatu sistem yang mempermudah proses tersebut dari pihak perguruan tinggi dan mahasiswa lulusan untuk mendapatkan penerbitan SKPI lebih mudah dan bisa mengakses aplikasi surat keterangan permohonan pendamping ijazah menjadi dua arah secara langsung yang mana data bisa diupadate secara online dan memiliki penyimpanan data yang terorganisir

Abstract

Global Awareness of Halal Products in Relation to the Economic Behavior of the Indonesian Society in the Industrial Revolution 4.0 Era, nowadays it has become a demand of the times whose cause is the existence of a great opportunity for the existence and development of the halal industry (sharia economy) in Indonesia. Where an indicator of awareness of halal products in Indonesia is the behavior of consumers or non-Muslim communities in consuming halal products. This library research was obtained from various primary and secondary sources from various literacy such as books, journals and the internet. The results of the study prove that the relevance of global awareness of halal products is related to the economic behavior of the Indonesian people in the era of the industrial revolution 4.0 as it is today, as evidenced by the many potential attractions of halal food in Indonesia which have their own variants in meeting market demand for halal products so that Indonesia as a The largest Muslim population in the world should be aware of their behavior in consuming halal products on the market, meaning that they are not inferior to non-Muslims in developing these halal products. Equally important in forming global awareness of halal products, the economic behavior of the Indonesian people, especially in this all-digital era (4.0), should carry out halal labeling and halal certification in order to be able to compete with market share.

Abstract

Recently, the financial technology (fintech) issue has risen in significance impact. Thus, it cannot be denied, fintech has been involved in daily transaction. It is such as payment, bonds transaction, loan, and other. The society tends to use the non-cash transaction because it gave convenience and time efficiency. The aim of this research is to discuss how the law of the use of E-Money (Electronic money) in non-cash transaction in Indonesia. The method was conducted by library research. The findings of the research; there are the different opinions among academicians and ulamas. The first opinion is based on Hanafi Madzhab and the second opinion is based on Syafei madzhab. The Hanafi Madzhab allows the Electronic money without any doubt, but Syafei Madzhab elaborates that in muamalah transaction so there must be a clear Akad in every transaction

Abstract

Abstract This article will discuss the contestation of Islamic Education in Lombok in post reformation 1998. Namely the contestation of madrasas and schools managed by the Islamic organization Nahdlatul Wathan (NW) and the Salafi-Wahhabi community in East Lombok. By using  qualitative approach in the form of library research, this article focuses on discussing some issues: first, the genealogy of the Nahdlatul Wathan and Salafi Madrasas. Second, Madrasas as the basis for the construction of  aswaja and Salafi-Wahhabi ideologies. Third, the pattern of contestation between Nahdlatul Wathan (NW) and Salafi-Wahhabi. This research  shows: First, the Nahdalul Wathan and Salafi madrasas in Lombok were genealogically founded by Middle Eastern Alumni (haramain). Second, curriculum design both in NW and Salafi madrasas uses for strengthening the ideology, identity and militancy of their own group. Third, the pattern contestation of Nahdlatul Wathan Islamic education vis a vis Salafi-wahhabi does not take place formally in madrasas, but uses the medium of mosques and virtual da'wah as well.

Abstract

Pembahasan tentang kewarisan di Indonesia masih menjadi persoalan yang sering menjadi perbedatan. Dimana dalam hukum Islam sebagaimana disinggung dalam Al-Qur’an surat an-Nisa ayat 11 Pembagian waris yakni 1:2, namun hal ini dirasa belum adil, sehingga keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia perlu dikedepankan. Tujuan penelitian ini adalah untuk membahas tentang prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia. Melalui pendekatan teori maslahah Ibnu Qayyim Al-Jauziyah, peneliti memusatkan perhatian pada masalah pembagian waris yang berlaku di Indonesia dan pendistribusianya dilaksanakan secara berkeadilan (maslahah). Penelitian ini menyimpulkan bahwa : 1) prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia adalah konsep berdasarkan prinsip kesepakatan (musyawarah); 2) penerapan prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia dapat dilakukan dengan cara menerapkan Prinsip kesetaraan gender secara Islami yakni dengan mengedepankan konsep rahmatan lil’alamin. Discussion of inheritance in Indonesia is still an issue that often becomes a matter of debate. Where in Islamic law as alluded to in the Qur'an letter an-Nisa verse 11 the distribution of inheritance is 1: 2, but this is felt to be unfair, so that gender-friendly based justice (maslahah) in the distribution of inheritance in Indonesia needs to be put forward. The purpose of this study is to discuss the principles of gender-friendly justice (maslahah) in inheritance distribution in Indonesia. Through the maslahah theory approach of Ibn Qayyim Al-Jauziyah, the researcher focuses on the problem of inheritance distribution that applies in Indonesia and its distribution is carried out in a fair manner (maslahah). This study concludes that: 1) the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia are concepts based on the principle of agreement (deliberation); 2) application of the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia can be carried out by applying the principle of Islamic gender equality by prioritizing the concept of rahmatan lil'alamin.

Abstract

Purpose – This study explores the transformation of zakat distribution principles as outlined in Nahdlatul Ulama’s Fatwa Bahtsul Masail and its implications for Indonesia's legal regulations. The goal is to understand how these principles can enhance zakat management by addressing social inequality and poverty alleviation.Methodology – A normative juridical approach was used, with a descriptive analytical study based on a literature review. The research focuses on four main aspects: analyzing zakat distribution principles in the context of Indonesian law, examining the legal reasoning (istinbath hukum) behind these principles, identifying factors driving and hindering the transformation, and assessing the significance of implementing these principles in Indonesian legal frameworks.Findings – This study identifies three main principles—justice, equality, and regionality—that should be integrated into regulatory frameworks. It also highlights challenges, including a lack of public participation in zakat distribution through official institutions, such as NU CARE-LAZISNU.Implications – The findings suggest the need for increased socialization of zakat management principles by the National Amil Zakat Agency (Badan Amil Zakat Nasional, BAZNAS), based on both Sharia and secure legal regulations, to enhance the effectiveness of zakat management in Indonesia.Originality – This research provides valuable insights into the evolving principles of zakat distribution and their integration into legal frameworks, contributing to the adaptation of zakat management practices to contemporary challenges in Indonesia.

Abstract

IntroductionWage trading, a practice where agricultural workers sell their future wages before receiving them—often at a reduced value—has become prevalent in the farming communities of Curup, Bengkulu. Although rooted in mutual agreement, this system raises critical ethical and legal questions regarding its alignment with Islamic economic principles, especially those outlined in the framework of Maqashid Shariah, which emphasizes justice and the protection of property.ObjectivesThis study aims to analyze the wage sale and purchase system through the lens of Maqashid Shariah, particularly focusing on whether such practices fulfill the objectives of wealth protection and social justice or contribute to economic exploitation and uncertainty among vulnerable workers.MethodUsing a qualitative case study approach, this research collected primary data through interviews with agricultural workers engaged in wage trading in Curup, Rejang Lebong, and Bengkulu. Secondary data were obtained from Islamic jurisprudence literature on Maqashid Shariah. The analysis applies the five core principles of Maqashid Shariah to evaluate the implications of deferred wage payments and wage sales.ResultsFindings indicate that although wage deferral is seen as a cooperative tradition, it often places workers at risk of financial instability, compelling them to sell their wages at unfair prices. This practice undermines the principle of property protection (hifz al-mal) and the protection of life (hifz an-nafs). It also contradicts the ideals of justice and welfare that Maqashid Shariah promotes. The study emphasizes that the presence of mutual consent does not automatically legitimize practices that may harm the economically disadvantaged.ImplicationsThe analysis suggests that reforms are needed to make wage systems more just and compliant with Islamic economic values. These include timely wage payments and the provision of Sharia-based financial alternatives to prevent exploitation. Educating communities about their economic rights within the Maqashid framework can also foster more ethical labor practices.Originality/NoveltyThis study contributes a unique perspective by applying Maqashid Shariah to assess the socio-economic impact of wage trading. It addresses a rarely examined issue in Islamic economic discourse and offers practical recommendations to bridge the gap between traditional practices and Islamic legal objectives.

Abstract

Abstract: Fairness in inheritance distribution between men and women in Indonesia is still an exciting topic to discuss. It is proven that classical Islamic thought says that men’s and women’s portions in inheritance distribution are final, as stated in the Qur'an Surat an-Nisa verse 11. However, contemporary Islamic thought sees it as a rule that needs to be contextualized to current situations. This progressive thinking about inheritance distribution was pioneered by gender activists who saw that Fiqh Mawaris has a gender bias and discrimination. Therefore, the application of the "gender-friendly justice" concept in the inheritance distribution in Indonesia needs to be put forward. This research analyses the "gender-friendly justice" concept in inheritance law and its application in Indonesia. This study uses Sigmund Freud's gender theory, with an analytic descriptive method focusing on the problem of inheritance distribution in Indonesia. The research results prove that the concept of "gender-friendly justice" in the inheritance distribution refers to the agreement principle and the gender equity principle, where the application is carried out based on the fairness principle. The gender equality principle is implemented by prioritizing the concept of rahmatan lil'alamin, namely equality as servants and caliph of Allah, equality in receiving primordial agreements and cosmic drama events, and reaching achievements.Abstrak: Keadilan pembagian harta waris di Indonesia antara laki-laki dan perempuan masih menjadi bahan diskusi yang menarik. Pemikiran Islam klasik menyatakan bahwa pembagian harta warisan bagi laki-laki dan perempuan sudah dianggap final, sebagaimana disinggung dalam Al-Qur’an surah an-Nisa ayat 11. Namun, pemikiran Islam kontemporer melihat hal tersebut sebagai aturan yang perlu dikontekstualisasikan sesuai per­kem­bangan zaman. Pemikiran progresif tentang pembagian waris ini dipelopori oleh para pegiat gender yang melihat fiqih mawaris masih bersifat bias gender yang dapat menimbulkan diskriminasi gender, sehingga penerapan konsep “keadilan ramah gender” dalam pembagian harta waris di Indonesia perlu dikedepankan. Tujuan penelitian ini adalah untuk menganalisis konsep “keadilan ramah gender” dalam hukum waris dan penerapannya di Indonesia. Penelitian ini menggunakan teori gender Sigmund Freud, dengan metode deskriptif analitik yang memusatkan perhatian pada masalah pembagian waris di Indonesia. Hasil riset membuktikan bahwa konsep “keadilan ramah gender” dalam pembagian harta waris mengacu pada prinsip kesepakatan dan prinsip keadilan gender bagi anak laki-laki dan perempuan, dimana penerapannya dilakukan berdasarkan atas asas keadilan. Penerapan prinsip kesetaraan gender ini diterapkan dengan menge­depankan konsep rahmatan lil’alamin yakni penyetaraan sebagai hamba dan khalifah Allah, penyetaraan menerima perjanjian primordial, penyetaraan dalam peristiwa drama kosmis, dan penyetaraan dalam meraih prestasi.
